The purpose of this memorandum is to provide a brief update regard-
ing staff activities associated with the monitoring of outside
storage practices at the Brad Ragan Tire Center and Field Mainte-
nance, Incorporated (3815 Nicols Road).
On Tuesday, April 22, a site review of the property was conducted
per arrangements made in previous correspondence with Mr. Bob
McCormick. Upon conclusion of the site review, a discussion was
held with Mr. McCormick in which measures were further defined for
the purpose of improving outside storage practices at the Brad
Ragan Tire Center and Field Maintenance, Incorporated site. Based
upon this conversation, an agreement is presently being prepared
which includes conditions that Mr. McCormick has agreed to imple-
ment in accordance with a strict timetable. This agreement will
be shared with you and Mr. David Keller of the City Attorney's
office for the purpose of soliciting comments prior to its implemen-
tation.
It is my understanding, based on a conversation with City Adminis-
trator Hedges, that this topic will not be placed on the May 6,
1986 City Council agenda. Mr. McCormick, of Brad Ragan Tire
Center, and adjacent residents will be notified of this action and
staff will attempt to respond to concerns that may arise as a
result.

I am writing in response to my meeting with you and Mr.Sheldon
Ramnarine on Wednesday, April 2, 1986 regarding the outside
storage practices of the Brad Ragan Tire Center and Field
Maintenance Inc. located at 3815 Nicols Road (Section 19, Lot 20,
Block 25). The purpose of this letter is to review the topics
discussed during the meeting and to what degree the City of Eagan
is able to address your concerns.
At our April 2nd meeting, you and Mi. Ramnarine suggested several
methods for improving the outside storage arrangements at Brad
Ragan and Field Maintenance, and included:
1. The City of Eagan require a setback of at least 29 feet
from the slope on the north side of the property for
outside storage;
2. That landscaping (i.e. berming) and additional
vegetation be required along the entire nozth perimeter
of the property;
3. That noise levels emitted by the two businesses be
substantially reduced during and after normal business
hours. Further, that a board fence of at least 10 feet
in height be installed along the north side of.the site
to assist with noise abatement.

The following ace observations regarding your suggestions based
on my knowledge of the site, review of the Eagan Zoning Code and
conversations with the City's legal staff.
1. Setback from the north side slope.
Brad Ragan Tire Center and Field Maintenance are located on a
site that is near your place- of residence. The interesting
feature in the zelationship between the two properties is that
your residence is 39 to 40 feet lower than the Brad Ragan/Field
Maintenance property (an elevation change from 760 to 790 and 802
feet).
Because of this dramatic change in elevation the requirement for
a? outside storage setback from the north side slope is an
excellent idea and one the Eagan Planning Department will
assertively pursue with officials of Bzad Ragan Tire Center and
Field Maintenance. It is anticipated that a setback from the
north slope will achieve the following:
a, reduce the negative visual impact of outside storage;
b, reduce the need for berming and other landscaping
techniques to minimize the negative visual impact of
material stored outside;
c. reduce the potential of property damage, should material
stored outside be displaced during a violent storm.
2. Gandscaping and berming
Your suggestion for landscaping and placement of additional
vegetation along the north side of the property was for the
purpose of minimizing the visual impact of material stored
outside. As stated above, however, this objective will be
achieved by requiring a setback along the north boundary of the
property and as a consequence there is little need for
landscaping, pazticul.arly in view of the fact that the area is
heavily wooded.
3. Noise
The problem of noise emitted by business (commercial and
industrial) establishments is a concern the City of Eaqan is very
sensitive to especially when single family neighborhoods are
negatively impacted. One of the puzposes foz land use zoning and

comprehensive planning is to encourage compatible land
development. For example, the placement of single family
neighborhoods in proximity to each other is considered a
compatible land use whereas land uses which have diverse needs
and result in conflicting activities, such as industrial sites
near zesidential neighborhoods, are considered incompatible land
uses. •
Unfortunately, you live in a part of Eagan that is experiencing
an incompatibility in land uses. Your residential neighboxhood
is surrounded by land zoned light industrial (LI) and high
density residential (apartment) development. These two zoning
designations permit a wide variety of activities generally
associated with apartment dwellings and industrial businesses,
for example, noise levels that would not otherwise be considered
acceptable in a single family neighborhood.
Since the zoning is appropriate for Brad Ragan Tire Center and
Field Maintenance, the issue to be addressed is whether noise
emitted by a business can be regulated via a conditional use
permit for outside storage. Section 11.20 subdivision 16 part C
of the Eagan Zoning Code (page 312) states in part that the
conditional use process regardinq "Industrial" districts may
regulate a vaxiety of activities, none of which, however, address
the issue of business related noise. While Section 4.30
subdivision 5(page 72) alludes to the issue of noise
precipitated by excavation and construction activities this is
not comparable to the issue at hand and there is little question
the two businesses do not violate the Noise Pollution Control
Section of the Minnesota State Regulations published by the
Minnesota Pollution Control Agency. As a zesult of reviewing the
aforementioned documents, it is my opinion and that of City legal
staff that business zelated noise cannot be regulated by a
conditional use permit fox outside storage given that said
business is in compliance with all zoning ordinances.
The Eagan City Council tentatively plans to discuss the outside
storage practices of Brad Ragan Tire Center and Eield Maintenance
at its regularly scheduled Tuesday, May 6, 1986 meetinq. You are
certainly encouraged to attend this meeting and share your
concerns with the City Council. In preparation for the May 6th
meeting, City staff will prepare a report regarding this issue.

i am writing in zesponse to your February 3, 1986 lettet to Mayor
Bea Blomquist which alleged that improper outside storage was
occurring at 3815 Nicols Road (Section 19, Lot 20, Block 25).
This matter has been refexred to the planning department, and the
intention of this letter is to officially communicate the
activities which have transpired since receiving your letter.
A lettet was sent on February 24, 1986 to Mr. Bob McCormick,
owner of Brad Ragan Tire Center, indicating that a complaint
regarding improper outside storage had been filed with the City
of Eagan. A meeting was held with Mr. McCormick and Mr. Wallace
J. Williams, Regional Managez for Brad Ragan, Inc. on Tuesday,
February 25 foz the purpose of reviewing your complaint, the
conditional use peimit issued for the parcel in 1981 which
permits outside storage at the site, and the "Light Industrial"
(LI) portion of the Eagan Zoninq Code. Further, the Eagan City
Council discussed your concerns regarding Brad Ragan's, Inc.
outside storage practices at the March 4 City Council meeting.
On Tuesday, March 4, 1986 a site
was conducted for the purpose of

1. At present, the site is occupied by two parties: Brad
Ragan Tire Center (Bob McCormick, owner) specializes in
tires for all types of vehicles, especially
construction equipment; Field Maintenance (Clint Rau,
owner) maintains and zepaizs heavy equipment and
tractoz/trailer units;

2. Primary items stored outside the Tire Center aze new
tires and a small number of empty 55 gallon barrels
which contained polyurethane while Eield Maintenance
park tractor/trailex units outside. According to Mr.
McCormick, used and retread tires are removed by
American Recycling Corporation of Savage, Minnesota and
the 55 gallon barrels are removed by Barrel
Reconditioning located on Mike Collins Drive in Eagan.
3. Stacks of scrap metal and other related miscellaneous
material were located on the west side of the site;
along the property's perimeter and on the west and
north side of the building;
4. Storage of tites was disorderly with some being stacked
four high (this being a particular problem with over-
sized tires for large construction vehicles);
5. An unsightly white 8,090 gallon tank and several white
55 gallon barrels containing calcium chloride (salt
water) were located on the west side, adjacent the
building;
6. Several discarded vehicles were located on the north
and west side of the site, next to the property's
perimeter;
7. The south (along Highway 13), east (facing Nicols
Road), and the northeast sides of the property had
inadequate vegetation for screening from adjacent land
and the dogwood plantings referenced in the June 2,
1981, City Council minutes have not been planted;
8. No evidence of illegal or hazardous waste dumping was
found.
In a verbal conversation, Mr. McCormack has agreed to complete
the following by May 1, 1986 with another site review 'scheduled
fox mid-April: -
1. All over-sized tires shall not be stacked over two high
and undex no circumstances will any tires be stacked
higher than six feet;
2. All tires will be neatly stacked in an orderly fashion.
Used and retread tires will not be stored in the open
outdoors (with outside storage permissible so lonq as
contents are placed in one semi-trailer which must be
parked next to the building) and must be removed from
the property on a scheduled basis;
3. The white trailer, discarded vehicles, scrap metal, and
other miscellaneous material not directly related to
business activities will be removed from the site;

4. All 55 gallon barrels containing polyurethane and salt
water, and empty 55 gallon barrels will be stored in
the building. Empty 55 gallon barrels will be removed
fzom the property in a timely manner;
5. The white 8,000 gallon tank containing salt water is to
be painted a color that matches the color of the
building;
6. To the extent that it is possible, materials, vehicles,
and machinery located on the north, west, and east
permiters of the site will be moved next to the
building;
7. Landscaping will be discussed in May for the purpose of
designing a plan that screens the south and east parts
of the site from adjacent land uses. In concept,
however, Mr. McCOrmick has agreed to plantings along
the south (Highway 13), east (Nicols Road) and
northeast portions of the property.
The Eagan City Council tentatively plans to address the outside
storage practices of Brad Raqan, Inc. of 3815 Nicols Road at the
regularly scheduled April 1, 1986 City Council meeting. Youz
continued input regarding this matter is encouraged and will
provide the greatest benefit to the City if comment is made on
conditions 1-7 prior to the April lst City Council meeting. A
written reply regarding these conditions must be received by
March 26, 1986 to be incorporated in city staff reports, though I
encourage you to contact me by telephone on or before April lst
if this deadline cannot be met. It is hoped that an agreement
can be reached that does not unduly restrain Mr. McCormick's
business activities, yet results in a site which is orderly and
poses no threat to adjacent land uses.
I encourage you to remain in contact regarding this issue and
look forward to receiving your comments.

4!e want to take this opportunity to express our concerns and to inform you of
two companies who we believe are abusing the city's outdoor storage rules and
regulations.
The companies are located at 3815 Nicols Road, Eagan. They are:
1) Brad Ragan Tire Co.; Bob McCormick, Manager
2) Field Maintenance; Clint Rau, Owner
For over a year, thgy have used their location as a"tiuiup" site for truck
tires, barrels, and numerous other things. They have many vans, trucks,
semi-trailers, and other vehicles "parked" for weeks, months, and even up to
•
a year before they are moved. They were even using Nicols Road as a place to
park their semi-trucks until we informed the Eagan police.
Between September and December, 1984 (when the companies first moved to
Eagan) we nade several contacts over the phone and in person, asking them to
please move their parked vehicles from the edge of the hilltop which
overlooks and borders our property. We were concerned with both the safety
and the aesthetics of the situation. They did not responded to our pleas.
We requested the help of the Eagan's City Hall. Greg Ingraham (formerly with
city hall) called an informal meeting on Dec. 18, 1984. After he heard both
sides to the story, viewed some photos, and visited the site; he determined
that they were in violation of city's outdoor storage ordinances. He
recommended that the vehicles, etc. be moved closer to the building and that
in the spring a wall, berm or some other kind of retainer would have to be
built for protection and to keep the noise level contained within their
boundaries.
• Since that meeting nothing has been resolved. The noise continues to be a
" problem. At times we can hear sounds of hammers and impact wrenches past 10
pm weekdays and weekends. Occasionally, we can even hear their public
address systen. -
We are enclosing a few photos taken from our property looking up towards the
hill. The pictures are of the north and west sides of the compound.
However, if you want a better idea of their mess, just drive north or south
on Cedar Avenue or Highway 13 and glance at those sides of the building.
We are turning to you, Mayor Blomauist for help in this matter since you have
been very responsive in the past concerning other issues that we have brought
before you. We would appreciate your assistance in resolving this situation.

that they were in violation of city's outdoor storage ordinances. He
recommended that the vehicles, etc. 6e moved closer to the building and that
in the spring a wall, berm or some other kind of retainer would have to be
built for protection and to keep the noise level contained within their
boundaries.
Since that meeting nothing has been resolved. The noise continues to be a
problem. At times we can hear sounds of hammers and impact wrenches past 10
pm weekdays and weekends. Occasionally, we can even hear their public
address system.
We are enclosing a few photos taken from our property looking up towards the
hill. The pictures are of the north and west sides of the compound.
However, if you want a better idea of their mess, just drive north or south
on Cedar Avenue or Hi9hway 13 and glance at those sides of the building.
We are turning to you, Mayor Blomquist for help in this matter since you have
been very responsive in the past concerning other issues that we have brought
before you. We would appreciate your assistance in resolving this situation.

Subject: Special Assessment for Storm Sewer Against Property Described as
District 10, Section 0-1900, Parcel 0-2025
TO WHOM IT MAY CONCERN:
On a recent appearance that I made before the City Council of the City of Eagan,
Dakota County on Thursday, September 28, 1978, on the hearing on the above referenced
matter, I was advised that I should put in writing the oral objections that I made
to the amount of the assessment against the above referenced property.
I will repeat the objections I gave at the City Council meeting on that particular
night. When the land was purchased in 1962 from Mr. Charlie Reuger, Mr. Bernstein
and I only wished to purchase the "buildable land" which is the top of the bluff,
overlooking the Minnesota river bottom on the west side of Cedar Avenue on the
north side of the Cedar Grove Sewage Treatment Plant. The amount of the ground
that was on top of tfie bluff that was buildable was a little over four acres.
Mr. Reuger said he would charge us as much for the four acres as he would for the
whole seven acres, as the rest of the land was no good to him. The reason the
land would be no good for him is because there is a steep drop off towards the
riyer bottom on the north part of the property. Furthermore, at the bottom of the
cliff, there are several springs which would make it difficult or next to impossible
to build a bui:lding on that marshy land.
The parcel owned by us will not be increased in value by the $8,794.96 you are
proposing to assess for the storm sewer. That is especially true of the bottom
land on the north side of the property and also the cliff. They are for all intents
and purposes, not usable for normal commercia7/industrial type buildings.
I understand that Cedar Avenue is going to be blocked just south of our property,
which is going to make it further difficult for us to gain access to our building.
At the present time, we have tried to lease the building during most of 1978. We
haye been unsuccessful for a number of reasons. One, is the Sewage Treatment Plant
next door. Two, is the escavated gravel pit across Cedar Avenue. Three, the
freeway construction behind us. In general, the area looks like a diseaster area.
I wi_11 repeat what I stated at the meeting. I am not objecting to the storm
sewer project. I'm only objecting to my seven acres, more or less, being valued
on a fully pro rated basis with other coimnercial/industrial land.

To orient to you on the location of this property from the topographical map, I am
going to give you the following instructions. Please place the map in front of you
with the north pointing away from you. Now, if you wi11 look at the upper left hand
corner of the plot, you will see where the two springs are and tfie creek. This is
the marshy 6ottom land wfiich I was referring to in tlie body of the 7etter, You will
notice the flat portion of the land is somewhere around 895 to 900 feet in elevation.
You will further note how quickly and steeply it drops off from the 845 foot elevation.

In other words, the slope is a6out 45 degrees. It is almost impossible to even walk
down tha slope, it is so steep. To further orient to you, the railroad tracks will
be slightly north and west of our parcel of property, running from the southwest to
the northeast.
If you are holding the map as I descritSed with the north pointing away from you,
the boundary toward you, where it reads "441.5 feet", th.is is the 6order abutting the
old Cedarvale 5ewage Treatment Plant. T think that-witfi the two references that I
have made plus Cedar Avenue running in front of it on the easterly 6order and the
new Cedar Avenue bridge coming along the westerly side of the property a6out 500 feet
or so west of the westerly boundary of our property, I think you will 6e able to
understand the location of the property.
1345.1500 MECHANICAI. SYSTEMS
In addition to the vrntilation requirements, exhaust gases from the intemal
combustion engines being tested shall be discharged to the outdoors through a
?. duct or flexible hose of noncombustible material of suitable size attached as an
extension to the exhaust pipe. Repair stalls may be located adjacent to an
outside wall so that ten feet or less of extension duct will reach the autdoors
through openings not more than one foo[ above floor level. If repair stalls are
not so located, each stall shall be provided with a suitable exhaust extension duct
or flexible hose which shall be equipped with a device for connecting it to [he
exhaust pipe of the vehicle and the exhaust system. Each outlet shall be
provided with a shutoff valve which may be closed when not in use. The
mechanical exhaust system shall have a capacity in accordance with the following
table:

Subp. 8. No basement repair. No basement or subbasement garage shall
be used for the repair of motor-driven vehicles.
Subp. 9. lnspection and repair pits. Inspection and repair pits shall be
provided with a ven[ilating system capable of assuring one complete air change
every five minutes. Floors of such pits shall have a minimum pitch of one inch
for each ten feet. The exhaust air inlet opening ot openings shall terminate in a
grille which shall be perpendicular to the floor. The bottom of the openings
? shall extend to the floor at the lowest poin[ or points of the pit.
Su6p. 10. Service stations. Buildings of this classification shall include
liquid fuel dispensing stations where vehicles can be driven in[o the building fot
washing, greasing, oil change, [irq or battery replacement or similaF operations.
' All service rooms ar work areas shaD be provided with a tempered supply of
outside air of not less than onahalf cubic fnot per minute per square foot of
floor area and wi[h the necessary gravity or mechanical vent or vents exhausting
the same volume of air from a point not more than 18 inches above the floor.
Subp. 11, G¢neral requirements. Ventilation shall be provided for
showrooms or offices where such occupancies are located adjacent to repair or
live storage areas and would require ventilation in accordance with part
1345.1380 unless the openable area or outside doors and windows exceed three
percent of the floor areas. This requirement does not apply to service stations.
There shall be no recirculation of air from any repair, live storage, or service
area during periods of occupancy except where the total amount oF air in
circulation is in excess of the quantity required by this part, [he excess air may
be recirculated.
The air that is exhausted from the repair, live storage, and service areas in a
building shall be removed at a point not more than 18 inches above the tloor
through properly distributed vent ducts located in areas of greatest
?;??:? contamination. Where the exhaust is by gravity, the vent duct or duc[s shall

seconded the motion to close the hearing and to continue it until the final
plat for Pilot Knob Center has been approved by the Council. All voted in

outside storage in the Globemaster Building at 3850 Nicols Road was next
discussed by the Council. The Cour.cil had reviewed the request on May 19 and
the Advisory Planning Commission had recommended approvai uith certain condi-
tions. Mr. +JiLliam 9er.jamin was preseat and indicated a meeting had been held
uith the staff regardir.g the information requests of the Council.
Pictures were suCmitted and plans and drawings of the layout including
. storage, site visibility f^om Cedar Avenue freeway, berming, trees, bushes,
etc. Mr. Benjamin stated there would be a 10-foot be^a with hedge on top o_°

to approve the application subject to the follouing:

Comaission held its publie hearing on April 28, 1981 and recommended approval
