hearing regarding the application of U-Haul of Minnesota for conditional uae
permit for a rental U-liaul facility with outeide storage at 3890 Cedar Avenue
at the interaection of Highway q13 and aleo application for rezoning from
LB. Limited Businese to I-1, Limlted Industrial was convened. Mr. Hemmond
appeared for the applicent with a plan for the proposal including 12 truck
parking locatione, 30 trailer etalls, 4 employee and 4 customer parking spaces. He noted only that repair work would be done on their owa vehicles and trailere
and all rrork would be done in the eervice bays. There would be an encloeed
trash bin at the rear. The Planner'e report of June 22. 1978, was zeviewed.

City Council minutes
GEORGE SAAD CONDITIONAL USE PERMIT. Mr. and Mrs. George Saad appeared on
behalf of their application for conditional use permit for restaurant with on-
sale wine and 3.2 beer at 1665 Yankee Doodle Road. The Advisory Planning Com-
mission recommended against approval. Mr. Saad submitted some revised plans of
the site indicating parking changes and they were reviewed by Puhlic Works
Director Cblbert. Mr. Colbert indicated that he recommended the Council con-
sider the plan providing for parking extended to the West with S foot variance
on the North lot line with provision for 40 foot frontage road on the South.
Mr. Saad indicated that there would be no objection to the 40 foot frontage road
and provision would be made for it on the plan. After considerable discussion
concerning the revised plans, questions from the audience including objections
from neighboring property awners, Smith moved and Parranto seconded the motion
to approve the plan providing for no setback variance on the North according to
the plan dated February 2, 1979, and sub3ect to compliance with all necessary
ordinances. All members voted in favor. Mr. Saad indica[ed that the restaurant
would be open until 1 a.m. with the exception of Sundays with the closing at 12
p.m. There was concern about lighting the outside of the premises and Kr. Saad
indicated that he would comply with the necessary Eagan City ordinances. Parranto
moved and Smith seconded the motion to amerid the original motion to limit the
seating to 51 persons, that curbing 6e installed by 7uly 1, 1979, and that build-
ing pexmits be required for any alternations or modifications to the interior of
the building. All members voted in favor of the amendment and all voted in favor
of the motion as amended. Parranto then moved and Wachter seconded the motion,
with all members voting in favor, to approve the conditional use permit for on-
sale wine and 3.2 beer license with the condition that there be no standup bar
on the premises. Mr. Saad indicated that there would be no standup bar and all

At the July 1, 1980 City Council meeting, concerns were brought forth re-
garding the conditional use permit issued to the U-Haul Company of hAinnesota.
The City Council directed the Staff to research the conditions of the condi-
tional use and to inspect the site to see that all conditions are being met.
According to the minutes, the conditions set forth in the conditional use
permit are as follows:
1. Concrete curbs along the perimeter of all surfaced areas.
2. That existing trash receptacle be used or similar structure to screen
trash.
3. Trucks and trailers shall be parked only on areas designated on the
site plan.
4. Honeysuckle hedge be planted for screening where sumac is proposed.
5. A$1,000.00 landscape bond to insure landscaping as shown on the plans
be submitted by the petitioner for one growing season and landscaping
to be completed within six (6) months after the property is occupied.
6. Subject to all City ordinances and with the understanding also that
' site will be maintained in a neat and orderly manner at all times.
On July 2, 1980, I made a visual inspection of the U-Haul site to see if all
the conditions set forth above were being met. Upon this visual inspection,
it appears that all conditions are being met except number 3; trucks and
trailers shall be parked only on areas designated on the site plan. According
to the plans submitted in July of 1978, they only allowed twelve (12) trucks,
thirty (30) trailers, four (4) emPloyee and four (4) customer parking spaces.
In this visual inspection performed on July 2, 1980, there appeared to be many
more trucks and trailers parked on the site than what was approved. 'I'his
specially relates to all the trucks which are not on the site but are parked
on the vacated portion of Cedarview Drive.
The City Staff will report back to the City Council on July 15, 1980 as to
the conditions approved for U-Haul of Minnesota. Therefore, Staff is request-
ing that condition 3 relating to the nvmber of trucks and trailers allowed on
site,be reduced to twelve trueks, thirty trailers, and eight parking spaces
prior to July 15, 1980 so Staf£ can indicate that all conditions of the condi-
tional use permit are being met. If the trailer and trucks are not reduced to

LEXINGTON AVENUE ERTENSION. City Administrator Hedges presented financial ,
-? statistics for the Council's information regarding funda on hand for construction of Lexdngton Avenue between County Roada 530 and U32 as requested by the developers
of Lexington South. It was noted there was about $1.5 mi.llion available for major
road construction through 1980 from various funds with estimated costs of improve-
ments of approximately the same amoant. The.City Engineer is preparing a five
year•capital street improvement program for the City. After diacussion, the
Engineer wae requested to contact P41/Dot District 9 concerning the proposal of
upgrading Highway 013 to 4-lane from Silver Bell to Yankee Doodle Road, with the
anticipated improvements to Highway 513. Egan moved and Wachter aeconded the
motion, all membera wted in favor, to requeat the Engineer to make the contact
and request 2v/Dot to appear regarding the request at a later Council meeting.
Smith moved and Parranto seconded the motion, all membere voted yea to proceed

person is generally considered legally responsible for a tank release if the
person owned or operated the tank either during or after the release.
Ve are aware that an initial investigation of the site has occurred and
petroleum contaminated soil and/or ground water has been identified. The MPCA
staff is therefore requesting you to take the necessary steps to investigate
and clean up the release in accordance with the enclosed NPCA technical
documents. If you have not already done so, we recommend that you hire a
q.Qiified -o^s'?lting firm who has experience in conducfing petroleum release

If you do perform the requested work, the state may reimburse you for a major
portion of your costs. The PetroleUm Tank Release Cleanup Act establishes a
fund which in certain circumstances provides pariial reimbursement for
petroleum tank release cleanup costs. This fund is administered by the Petro
Board. More specific eligibility rules are available fiom the Petro Board

If you do not respond within 30 days, MPCA staff will assume you do not intend
to comply with this request. In this event, the MPCA Commissioner may order
you to take corrective action at the site. If you do not comply with the
Commissioner's order, it may be enforced in court or, alternatively, the MPCA
could spend iis own money cleaning up the release and then seek to recover its
costs from you or other responsible persons through legal action. Failure to
cooperate with the MPCA in a timely manner may also result in reduced
reimbursement from the Petro Board.

regarding the utilization oE Minnesota State Aid Funds noting there were not
sufficient funds to handle all of the costs for the road. A representative of
Lexington South, the primary property owner on either side of the road, Rod
Hardy, was present. He has proposed to assess at a residential rate the
entire length of the road and to use the fronts to construct the improvements
to the east line of Wedgwood Addition. The balance would he mnstructed from
State Aid Funds when they become available. Councilmembers had questions as
to propriety of cons xuction at the present time and the precommitment of MSA
funds. Colbert explained the reasons for construction at the present time and
stated there would not be sufficient MSA funds beyond present City commitments
for the next few years. It was recommended that the hearing be continued so
that the staff could prepare a complete memo on MSA fund availability with
expected receipts and uses for the funds in futur.e years. In addition, it was
requested that the storage capacity of adjacent lakes be reviewed; a deter-
mination be made as to the legality of preassessments and whether the City
would be compelled to construct the balance of Wilderness Run Road if the
property is assessed for residential purposes and later owners would demand
ttr_ construction; further, whether the established high water marks on the two
lakes would be affected by the proppsal.
Smith moved, Egan seconded a motion to continue the hearing until the
next re9ular meeting.

?Councilmember Wachter vacated his chair and presented the application for
proposed preliminary plat approval of Norvin Oaks Addition. The Planning
Commission recommended approval at its June 23, 1981, meeting subject to
certain conditions. Mr. Wachter requested that the application for plat
approval be withdrawn ars9 that the Council grant a variance to allow one more
residential building permit and that the third other parcel not be built on or
that a permit be issued until the sewer and water is available to the site.
P,Pter considerable discvssion concerning access of sanitary sewer to the '
azea, Parranto moved, Eqan seconded a motion to continue the application for
an additicnal 30 days to allow the staff to submit the proposal for sanitary
sewer into the area. All voted in favor except Wachter who abstained.

The application of U-Haul Corporation for a freeway sign permit at its
site m Old Cedar and Highway #13 was rlext considered. Mr. Aedges introduced '•
the anplication and Ben Hammond of U-Haul was present. He presented a pic- torial gcaphic of the site elevations to determine how the sign would be
viewed from new Trunk Highway 413 and new Cedar Avenue. The sign would be 25
feet high and the sign would be six feet higher than any point in the inter-
change. After discussion, Nachter moved, Egan secondec3 a motion to approve
the apolicatirn subject tA the following conditions:

T2e applicaticn of McDOnald's Corporation for a conditional use permit
for a drive-through facility at 1995 Silver Bell Road was next considered.
The Planning Commissicn had considered the aoplicaticn on April 26, 1981, and
at its meeting on July 28, 1981, and recommended apprwal subject to certain
conditions. Mr. Engstrom of McDOnald's Corporation was present. Council-
members discussed the proposal in detail and after discussion Smith moved,
Wachter seconded a motion to deny the application noting a double traffic
pattern around the building construction would be required. Mr. Engstrom
indicated that it would not be economical to do so and would cause major
remodeling. It further wouid eliminate about 50 seats if the alternate pro-
posal were used. The reasons for the decision were based upon safety'noting
the drive-in entrance is in the wrong side and would impede traffic; that the
area already is a very congested corner; there is insufficient stacking area;
it will possibly generate more traffic in the area, and may tend to block
traffic i.n arr3 out of the site. Ali voted in favor.

Tho- appliratian of Joyce Meissner for a special use permit for a mobile
home located at 3240 Dodd Road.in Joyce Addition was next considered. The
appZication had been denied by the Council at an earlier meeting. Mrs.
Meissner was present and requested that the application be granted for
security reasons for the family television business next to the mobile home.
She stated the trailer is usually occupied hy an employee of the TV shop.
Parranto mov?d, Smith seconded the motion to deny the applicatinn because
there is no employee living in the mobile home and further that the residence
next door to the TV shop is occupied by the Meissner's two sons which could
fulfill the need for security; further, that granting the permit would act as
a Precedent; further, that the present mobile home be removed within 90 days.

meeting held on August 18, 1981, a sign permit to allow a freeway business
identification sign for the U Haul Corporation at the intersection of T. H.
13, Old Cedar Avenue and the new Cedar Freeway was approved. The sign
permit was approved with the following conditions: ?
1. That the pylon sign may not be located within 300 feet of any
