Mr. and Mrs. George Saad appeared on behalf of their application for conditional use permit for restaurant with on- sale wine and 3.2 beer at 1665 Yankee Doodle Road. The Advisory Planning Com- mission recommended against approval. Mr. Saad submitted some revised plans of the site indicating parking changes and they were reviewed by Puhlic Works Director Cblbert. Mr. Colbert indicated that he recommended the Council con- sider the plan providing for parking extended to the West with S foot variance on the North lot line with provision for 40 foot frontage road on the South. Mr. Saad indicated that there would be no objection to the 40 foot frontage road and provision would be made for it on the plan. After considerable discussion concerning the revised plans, questions from the audience including objections from neighboring property awners, Smith moved and Parranto seconded the motion to approve the plan providing for no setback variance on the North according to the plan dated February 2, 1979, and sub3ect to compliance with all necessary ordinances. On July 2, 1980, I made a visual inspection of the U-Haul site to see if all the conditions set forth above were being met. Upon this visual inspection, it appears that all conditions are being met except number 3; trucks and trailers shall be parked only on areas designated on the site plan. According to the plans submitted in July of 1978, they only allowed twelve (12) trucks, thirty (30) trailers, four (4) emPloyee and four (4) customer parking spaces. In this visual inspection performed on July 2, 1980, there appeared to be many more trucks and trailers parked on the site than what was approved. 'I'his specially relates to all the trucks which are not on the site but are parked on the vacated portion of Cedarview Drive. The City Staff will report back to the City Council on July 15, 1980 as to the conditions approved for U-Haul of Minnesota. August 18, 1981 regarding the utilization oE Minnesota State Aid Funds noting there were not sufficient funds to handle all of the costs for the road. A representative of Lexington South, the primary property owner on either side of the road, Rod Hardy, was present. He has proposed to assess at a residential rate the entire length of the road and to use the fronts to construct the improvements to the east line of Wedgwood Addition. The balance would he mnstructed from State Aid Funds when they become available. Councilmembers had questions as to propriety of cons xuction at the present time and the precommitment of MSA funds. Colbert explained the reasons for construction at the present time and stated there would not be sufficient MSA funds beyond present City commitments for the next few years. It was recommended that the hearing be continued so that the staff could prepare a complete memo on MSA fund availability with expected receipts and uses for the funds in futur.e years. In addition, it was requested that the storage capacity of adjacent lakes be reviewed; a deter- mination be made as to the legality of preassessments and whether the City would be compelled to construct the balance of Wilderness Run Road if the property is assessed for residential purposes and later owners would demand ttr_ construction; further, whether the established high water marks on the two lakes would be affected by the proppsal. Smith moved, Egan seconded a motion to continue the hearing until the next re9ular meeting. The Planning Commission recommended approval at its June 23, 1981, meeting subject to certain conditions. Mr. Wachter requested that the application for plat approval be withdrawn ars9 that the Council grant a variance to allow one more residential building permit and that the third other parcel not be built on or that a permit be issued until the sewer and water is available to the site. P,Pter considerable discvssion concerning access of sanitary sewer to the ' azea, Parranto moved, Eqan seconded a motion to continue the application for an additicnal 30 days to allow the staff to submit the proposal for sanitary sewer into the area. All voted in favor except Wachter who abstained. £' 9 v The application of U-Haul Corporation for a freeway sign permit at its site m Old Cedar and Highway #13 was rlext considered. Mr. Aedges introduced '• the anplication and Ben Hammond of U-Haul was present. He presented a pic- torial gcaphic of the site elevations to determine how the sign would be viewed from new Trunk Highway 413 and new Cedar Avenue. The sign would be 25 feet high and the sign would be six feet higher than any point in the inter- change. After discussion, Nachter moved, Egan secondec3 a motion to approve the apolicatirn subject tA the following conditions: 1 C 1. T2e applicaticn of McDOnald's Corporation for a conditional use permit for a drive-through facility at 1995 Silver Bell Road was next considered. The Planning Commissicn had considered the aoplicaticn on April 26, 1981, and at its meeting on July 28, 1981, and recommended apprwal subject to certain conditions. Mr. Engstrom of McDOnald's Corporation was present. Council- members discussed the proposal in detail and after discussion Smith moved, Wachter seconded a motion to deny the application noting a double traffic pattern around the building construction would be required. Mr. Engstrom indicated that it would not be economical to do so and would cause major remodeling. It further wouid eliminate about 50 seats if the alternate pro- posal were used. The reasons for the decision were based upon safety'noting the drive-in entrance is in the wrong side and would impede traffic; that the area already is a very congested corner; there is insufficient stacking area; it will possibly generate more traffic in the area, and may tend to block traffic i.n arr3 out of the site. Mrs. Meissner was present and requested that the application be granted for security reasons for the family television business next to the mobile home. She stated the trailer is usually occupied hy an employee of the TV shop. Parranto mov?d, Smith seconded the motion to deny the applicatinn because there is no employee living in the mobile home and further that the residence next door to the TV shop is occupied by the Meissner's two sons which could fulfill the need for security; further, that granting the permit would act as a Precedent; further, that the present mobile home be removed within 90 days.
