'Che yard is in violation of the City ordinance. It is the responsibility of

single family lots on a 40 acre parcel. Wachter moved to accept the report and
schedule a public hearing for May 16, 1978 at 7 p.m. at the City Hall. Parranto
seconded the motion; all members were in favor.
OAK POND flILLS 2ND ADDITION PRELIMINARY P7,AT. The preliminary plat for Oak
Pond Hills 2nd Addition, North of Cliff Road, was next reviewed by the Council.
Floyd Forsberg, the develoner, was present. The Council reviewed the recommenda-
tions of the APC which recommended approval. There was discussion conceming
the Park Committee recommendation of a 100 foot trail access through the develop-
ment to the Dakota County park to the South. Parranto moved and Murphy seconded
a aotion fo approve the preliminary plat, subSect however, to the recommendations
of the Advisory Planning Comnission and subject, however, to satisfactory comple-
tion of park dedicatioa requirements. Those in favor were: Murphy, Parranto and
Smith. Against: Wachter. There were objections from cerCain Council members
conceming the size and extent of the park dedication requirement particularly
adjacent to Cliff Road.
CAPP HOP4S SUBDIVISION WAIVER. Councilman Parranto absented himself from any
consideration concerning the application of Capn ftomes for waiver of subdivision
regulations to divide Lot 3, Block 8, Cedar Grove No. 3. Attorney Mike Perlstein
appeared on behalf of the applicant and indicated that all conditions recommended
by the Eagan Planner and the Planning Commission will be met by the developer.
Wachter moved and Smith seconded a motion to anprove the application, subject
to Planner and APC recomnendations. Those in favor were: Wachter, Smith and
Murphy. Not voting: Parranto.

recacmendation. On April 18, 1978, the Eagan City Council also apprwed tr,e
waiver of plat subjeet to the Planner's recam.iendations. Flzclosed for your

In this report oonditian nimber 3 states only one ground sign should be allowed
for the proposed facility. Aceording to Ordinance 16, Signs, Section 16.01,
Subdivision 2e, defihes free standing ground signs as "a business sign erected
on free standing shafts, posts or walls which are solidly affixed to the 9round
and conpletely independent of any building or structure. Any business free
standing ground sign which pmjects more than 7 feet ahove the grourr3 level is
wnsidered a pylon sign.

T-Mobile USA is proposing to place a communication antenna on an existing gas station sign at
the EZ Stop station located at 4197 Nicols Road. 'i'his installation includes an antenna panel and
coax cables attached to an existing, privately-owned pylon sign. In addition, this installarion
requires a small uiility cabinet to be located near the pylon sign base which will be mounted Yo
the gcound with two sign posts that will be anChored in the ground with cement This instaIlation
is very small, and will not require a building. Nor will it require sewer or water hookups, or add
to any drainage issves on the site.
Based on ow discussions in the past regarding this installation, it is our understanding thst the
City of Eagan will not require a building permit or inspections for this iristallation. 7o that end,
