No. 342, File No. 49229 Gerald Solheim Driveway Complaint Solheim complained about a crack in his driveway (letter dated July 31, 1985 - of which the original is returned herewith for your file) and questioned whether the City will repair the crack or have the contractor. As you requea- ted, I have inspected Mr. Solheim's driveway and have the following comments and recommendationa to offer. The driveways in question were constructed under public improvement contract 83-09. The work was performed during fall, 1983 and the project was accepted on February 7, 1984. By the provisions of the contract, the contractor must warrant his work to be free of defects"for a period of two years after project acceptance. Therefore to the extent that the work is defective, it is the contractor's responsibility to correct the problem at no expenae to the City. Having inspected the driveways, it is my opinion that they are in good condi- tion. They do not.exhibit excessive wear or cracking. There are"hair line° cracks (one per driveway) at the Location of ditch fill/existing subgrade match point. The cracks could be cauaed by aettlement as Mr. Solheim sug- gests, by differential frost heave or other factors such as a gas.or electri- cal cable trench. However, these cracka do not indicate that the drivewaya were improperly deaigned or constructed or that there will be a maintenance cost to be incurred by these cracks. I do not believe that any action is neceasary on the City's part. The crack does not conatitute evidence of defective conatruction and I, [herefore, can- not inatruct the contractor to correct the work as a part of his obligation under the warranty provisiona of the contract. I do not think theae cracke will cause an additional maintenance liability for the property owner other than thoae which are inherently a part of asphal[ driveway. We feel that a ; full width 20 foot driveway, rather than the 30 foot width propoeal would mske the traderoff a bit more fair. Several other questions that ehould be addreeaed are: Who legally will own the property between the preaent aervice drive and Nicola RoadY If it will be the home owner, what will we have to show for proof of owner- ship and how will it affect our taxes4 What obligatidn will the city have to restore our lawne when they have to dig them up far sewer maintenanceY If we do end up with a 75-80 foo-t driveway, how much say will we have as to the quality of the work that vill be done7 You cextainly caa realize our reason for concern, as the coat of redoing that eize of driveway would be a very large expenae, eapecislly if, because of inferior work, it would have to be redone before we even got our asaeeamant paid up. ? There would be a very eharp d1p in each driveway. More im- portant, the alope of the land in thia neighborhood is auch that there wauld be a aignificant erroeion problem. T6e only way to avdid that is to plan for a large amount of fill and elope the land gradually Erom the creat downward tovard Nicols Road. Each property is huild that vay now, so erroaibn is not a major problem. If the land architecture becomes diattlqbed, it could be a massive problem unlese certain precautiona are taken. i; . a.
