In October of 2003 a$S,OOO landscape security deposit was submitted to the City of
Eagan in conjunction with issuance of the building permit for construction of the building ,
at the above referenced location. These funds aze eligible for release to the depositor at
this time.
Please note that the property owner continues to be responsible for maintaining the health I
of all plantings on the property. In accordance with section 11.70 of the Eagan City Code,
the property owner must maintain all landscaped areas, and install healthy replacement
plants for any plants that die or aze removed due to disease. Maintenance shall include I
removal of litter, dead plant materials, unhealthy or diseased trees, and necessary
pruning.
An inspection will be conducted by city staff next spring/summer to verify that the i
condition of the landscaping is acceptable under city code. Thank you for your attention '

I have reviewed the above referenced plans for building pernut for compliance with the I
City's zoning codes and the CondiUonal Use Permit (CUP) issued in 2002 for the car i
wash addition. The following items aze either incomplete or unsatisfactory. Please ?
address these deficiencies and submit two sets of revised plans as soon as possible.
The CUP requires that a landscape island be constructed along the southem property line
where the three pazking stalls are shown. This change should be reflected on both the
Site Plan and the Landscape Plan. Landscape materials within this island should consist
of shrubs hearty enough to survive winter snow storage, and large enough to provide a,
buffer and screening between this lot and the adjacent parcel to the south.
The four Amur Maples shown on the Landscape Plan (specification is listed as an 18" ?

pot) appeaz to be a clump shrub variety and should instead be a larger tree, either an
ornamental if overhead utility lines are a concern, or a shade tree variety. Omamental
trees must be a minimum size of 1-1/2" at time of planting, and shade trees 2-1/2". '

I understand there is an Engineering "hold" on the building permit for
the proposed car wash at 4205 Nicols Road. Tom Colbert, Bob Bauer,
and I met with applicant and his attorney today to work through issues
relatinq to setback variances, trail easements, platting, etc.
The group decided that the building permit review should proceed so it
can be issued and the applicant will enter into an agreement with the
City to guarantee the property gets platted at a time in the future and
the other outstanding issues are dealt with.
Tom and Bob feel free to chime in if this information doesn't ring true
John please release the "hold" and Craig, please review the plans.

Variance request on having

This is to request a variance allowing us to have one restroom due to the
follawing:
1) Ours is not a transient freeway location. Most of our
business is local, where use oF restrooms is limited, due
to their proximity to their own homes. Dur experience
has actually been that they are rarely used.
2) Similiar locations we have in erooklyn Center and Spring
Park have one restroom and work out very nicely. We are
also converting at other locations of ours.
3) The purpose Ear this remodeling was to increase the size
of our showroom area so we can properly display our product
and where we have room to show the customers the product (tires).
Prior to this, there wasn't proper room without a customer
feeling cramped (service station facilities have long been too
small in the showroom area). '
4) A serious problem also exists in that the work has been
performed already:
a. We began prior to getting our permit due to confusion

and I thought he was to get. ?
ti. When we did secure the permit (in the middle of remodeling):
t. we were told no plans were needed
2. we paid a penalty due to what I was told was for
"lack of ability to properly inspect."
Our request is that the two restroom requirement be waived due to errors
which resulted in our completing this job without two restrooms, and due
to the expense involved (it ended up being more costly than anticipated?.-
$ 8,600 with plumbing being a big part of it). Also due to the fact that
no plan considered would have allowed us to cost effectively done the job
with two restrooms (enough additional showroom could not have been obtained
to cost justify the pro,ject).
Believe me, we would not have done this if we hadn't analyzed usage and
thought it would result in customer dissatisfaction, because it would only
harm us. In addition, from a community image standpoint, we have always
tried to enhance our corner. When a tornado ripped our building apart, we
rebuilt an attractive earthtone building which Standard Oil haA advised us
is one of the most attractive buildings in the country in which there is
gas out front.
Please allow us to try this completed set up and if we encounter problems,
let's discuss it at that time.

Per your request, I contacted Will Dahn, Building Official
of Brooklyn Center, on the referenced company. The building
referred to was an old building and there was only one rest-
room to begin with and the remodeling was so minor that it
would not have required a second restroom anyway.
If you wish to pursue the issue and force a hearina on the
service station's special use, the Building Code Division
will back the two restroom provision. I have enclosed and
hiqhlighted the two codes that would pertain to the restroom
requirements for yours and the City Attorney's use.
In conclusion, it was interesting to note that Tires Plus
followed the same unpermitted procedures in Brooklyn Center
as they did here. Hopefully, this will answer all of your
questions.

Dear Tom:
2 have been asked to review the status of the conditional use permit for this
station in light of remodeling that has oecurred there without the issuance of
a valid building permit. We have further been advised that the owner has been
required to pay double the normal building permit fee as a penalty for failure
to obtain the necessary permit. Because the owner has already been penalized,
it would appear inappropriate to attempt to again penalize the owner by revo-
cation of its conditional use permit. Further, the issuance of a permit at
that time estops the City from such action.
As you are probably aware, there appear to be no specifie conditions attaehed
to the cond3tional use permit and if there are any restrictions, they would
have to be derived from specific ordinanee provisions. It might be argued
that a conditional use permit without any specifie conditions attaehed thereto
is implicitly conditioned upon compliance with City ordinanee requirements.
As a result, it is being suggested that the failure to provide separate rest
room facilities in the newly remodeled service station represents non-
compliance with Eagan City Code, whieh ineorporates State Building Code.
Section 7.05 of the Uniform Building Code provides that "Every building or
portion thereof where persons are employed, shall be provided with at least
one water closet. Separate facilities shall be provided For each sex, when
the number of employees exeeeds 4 and both sexes are employed."
It would appear that the Amoco station does employ more than 4 people and it
does employ members of each sex. Therefore, the station is in vlolation of
City Code and as a result may have violated an implicit condition of its
conditional use permit.
Although the issuanee of a building permit may be an acquiescence to the
U.B.C. violation, the City may choose to take some action in regard to the
conditional use permit, including but not limited to the following:

1. Advise the service station owner his conditional use permit will not be '
renewed on the next renewal date unless the condition complained of is ?
remedied. The City Council then could determine prior to or at the next !
permit renewal that one of the conditions of all conditional use permits
is compliance with the Eagan City Code including UBC by referenee.
2. The service station owner could be put on notice and advised to remedy '
the problem complained of, being advised that the condStional use permit ?
will not be renewed at the next renewal, based on the City's opinion that
conditional use permits are explicitly conditioned upon compliance with
all ordinance requirements. The Code and USC violation should be appro-
priately cited. ?

Dear Mr. Gegax:
Please be advised that it has been brought to the attention of the City that
you have remodeled the service station without the appropriate building
permit. It appears that the Building Inspection Department has penalized
you for the appropriate fee for failure to obtain the permit prior to
commencement of construction.
It has also been brought.to our attention that during the remodeling process
you eliminated one of your restroom facilities leaving only one facility in
the structure. It would appear that this is a violation of the Uniform
Building Code requiring two such facilities where an employer employs more
than four people and includes employees of both sexes. The UBC by reference
is a portion of the Eagan City Code. Therefore, you are in violation of the
City Code.
It is the City's position that the conditional use permit is implicitly
conditioned upon remaining in compliance with the existing code. Therefore
you are required to correct the violation prior to renewal of your conditional
use permit or accept the possibility of nonrenewal by the City Council.

your requests for a variance from the Uniform Building Code provision requir-
ing two bathrooms in the Tires Plus Standard service station at 4205 Nichols
Road in Eagan, and also a variance to allow an additional sign on the free-

This letter is notice to you that the City Council will consider the revoca-

You asked that I give you a report concerning the conditional use permit for
the pylon sign at the Tires Plus Amoco Station on Nicols Road and Diffley Road.
There seems to be quite a bit of history concerning this sign including the
ground sign that is now located at the corner and the pylon sign located on
Cliff and new Cedar Avenue. The application was first submitted for a
conditional use permit for a pylon sign by Thomas Gegaac on August 10, 1981,
and indicates that both Leroy Signs and Lawrence Signs would be installing
the sign for a single pylon sign according to the application. They sent a
photograph of the existing sign which showed a Standard logo and a reader board
below it. Also, they enclosed a Tires Plus Auto Service Center pylon sign
that was 26 feet high with a reader board enclosed as part of the Tires Plus
logo portion. Below that is an existing self-serve price sign that was
requested. The Planning Commission heard the application on August 25, 1981;
and it was an application for a single pylon sign adjacent to the freeway and
the proposal was for revision of the sign, removing the 6-foot by 10-foot
Standard logo and replacing it with an 8-foot by 8-foot Tires Plus business
sign with four rows of changeable lettering. The 6-foot by 10-foot Standard
logo was proposed to be utilized for a 27-foot pylon sign adjacent to the
freeway.
Also, the request appeared to indicate that it was intended to include a var-
iance to include two pylon signs on the premises and a variance regarding the
300-foot spacing requirement for pylon signs. The Planning Commission
recouunended denial for lack of hardship and the precedence problem that would
be created hy the two variances that would be requested.
The City Council, on September 15, 1981, granted the application for condi-
tional use permit to allow a pylon sign on new Cedar Avenue and ground sign
on Nicols Road subject to several conditions:

1. That the freeway pylon sign not exceed 27 feet in height from ground
level and not exceed 60 square feet per side.
2. That the signs conform with all applicable ordinance requirements.
That approval seemed to provide for the freeway sign of 27 feet and it was
at that time that the sign ordinance committee was requested to review the
ordinance and adopted a change in the ordinance to provide for an exception
for pylon signs beyond 27 feet along freeways. In any event, on October
26, 1981, a letter was received from Leroy Signs asking for a variance for
a 50-foot height pylon sign because of sight-distance factors. Del Schwanz
prepared some cross sections and the request was then submitted by a memo
from Dale Runkle dated October 30, 1981, indicating that staff had been out
to review the location and that in order for proper sight visibility, 50
feet would be necessary.
On November 4, 1981, the application then came before the City Council and
a motion was made that on the basis of hardship due to the depression of the
freeway, that the request for a 50-foot height be approved subject to ordi-
nance compliance in all other respects.
A letter of September 22, 1981, from the staff following the September 15,
1981, Council approval indicated "this freeway sign-.would allow signage
for the Amoco Service Station and a pricing sign underneath. With the pylon
sign and pricing sign, the Eagan City Council recommended that the ground
sign be placed on the old Cedar Avenue side."
The definition of "sign area" is the"gross area, exclusive of supportive
frame, which contains copy or identifying features such as logo, character
or identifying figure. The gross area shall be calculated as an enclosed
area bounded by no more than 12 straight lines. " This would appear to mean
that there could be three square signs per side if permission is granted by
the Council and if it qualifies for the 125 square-foot maximum area per
side for a pylon sign.
The confusing part is whether the September 15, 1981, restriction that the
pylon sign not exceed 60 square feet per side conforms with the 125 square
foot maximum. The current Amoco freeway sign has, I understand, 60 square
feet for the logo and 60 square feet for the reader board which would conform
with the maximum ordinance provision. The ultimate sign that was installed
was not similar to the existing pylon sign with the Standard logo and price
reader board prior to 1981, nor was it similar to the Tires Plus diagram that
was prepared by Lawrence Signs and dated August 5, 1981.
This information is being submitted at the request of the Council and if there
are questions, certainly get in touch with me.

In official action that was taken by the Eagan City Council at
a regular meeting held on Tuesday, August 7, 1984, the conditional
use permit to allow Tires Plus Standard to operate a service
station was continued until the September 4, 1984, meeting.
As indicated in your letter of July 30, 1984, Mr. Thomas Gegax,
President, Eagan Tires Plus, is agreeable to fulfilling requirements
under the City Code by constructing a second bathroom at the
Eagan Tires Plus building.
The City Council continued this item until the September 4, 1984,
to give Mr. Gegax time to apply for the building permit and demon-
strate good faith that the restroom facility will be constructed
as soon as possible. -
Regarding an issue that was raised at the City Council meeting
concerning the number of nonconforming signs at the Tires Plus
Standard, our Chief Building Inspector, Mr. Dale Peterson, has
been asked to serve notice to the Tires Plus Standard that all
signs that have not been approved by the City Council or signs
that are not in compliance with the City Code must be removed
within ten (10) days upon receipt of notification by that office.
If you have questions reqarding the building permit for the addition
of a restroom facility or which signs are in compliance at the
Tires Plus Standard, please contact our Building Inspections
Department for clarification.

Petroleum Storage Tank Release Investigation and
Corrective Action
The City received notice from the Minnesota Pollution Control
Agency (MPCA) that a release of petroleum occurred from the
storage tanks at the Amoco Station, 4205 Cedar Avenue. The
MPCA's Tanks and Spills Section is currently working with Amoco
oil Company on establishing a schedule for investigatinq the
release. Such an investigation involves determining the extent
of soil contamination at the site and identifying methods to
clean up the contamination. The initial investigation may take
in excess of 60 days and MPCA staff has indicated that Eagan will
be kept informed of the progress.

Apparently the Amoco Station was in the process of replacing its
storage tanks when the contamination was discovered. The
installation of new tanks has been completed.

The Minnesota Pollution Control Agency (MPCA) has received your notification
that a release of petroleum has occurred from storage tank facilities which you
have owned. The first report of the release was made to HPCA staff on
October 10, 1988. The tank facilities are located at:

Eagan, Minnesota
Federal and state laws require that persons legally responsible for storage tank
releases notify the MPCA of the release, investigate the extent of the release
and [ake actions needed to ensure that the release is cleaned up. A person is
generally considered legally responsible for a tank re]ease if the person owned
or operated the tank either during or after the release. Excerpts from the
state law establishing cleanup liability, with a limited exception for certain
owners who were unaware they owned a tank, are enclosed with this letter. In
addition, the Petroleum Tank Release Cleanup Act requires that any person
furnish upon request from the MPCA Commissioner whatever information that person
may have or may reasonably obtain that is relevant to the release.
Ae are aware that underground storage tanks have been removed and approximately
550 cubic yards of petroleum contaminated soils have been removed. Additionally

experiencing contamination originating from an off-site source. The MPCA is
therefore asking you to sign and comply with the enclosed Letter of Intent to
Proceed with the necessary investigative and corrective action at the site.
If you do perform the requested work, the state may reimburse you for some of
your costs. The Petroleum Tank Release Cleanup Act establishes a fund which in
certain circumstances provides partial reimbursement for petroleum tank release
cleanup costs. This fund is administered by the Petroleum Tank Release
Compensation Board (Petro Board). The section of the law that discusses who is
eligible for reimbursement from this fund is enclosed. More specific
eligibility rules are available from the Petro Board (612/297-3238).

cost reimbursement, reported to the Petro Board. The Petro Board would
decide whether or not you received any reimbursement of your costs, in
par[ based on your cooperation with the MPCA.
- the MPCA will not issue a formal order to you to undertake the required
investigation.
- the MPCA will not take the required investigation itself, and will not
seek to recover its investigative costs from you by legal action.
- the MPCA will review your plans and reports and will comment on your
recommended investigations. We may suggest or require changes to ensure
adequate investigation and corrective action.
If you do not sign the enclosed Letter of Intent to Proceed:
- the Commissioner of the MPCA may formally order you to take the required
actions. Failure to comply with a formal order is a violation of
federal and state law.
- the MPCA may take the required actions itself and recover the costs from
you through legal action commenced by the Attorney General.
- the HPCA may request the Attorney General to commence a legal action to
compel you to take the required actions.
As you review the Letter of Intent to Proceed with your insurance
representative, attorney, and consultant you may wish to propose minor
modifications to the MPCA Project Manager. Any such modifications shall not be
effective until accepted by the MPCA Project Manager.
Signing the Letter does not prohibit you from taking investigative or corrective
actions more quickly than is required by the Letter of Intent to Proceed as long

the Letter. You may also exceed the requirements for investigations and
corrective actions described by the enclosed.
The MPCA may require additional investigation, corrective action or information

If you conclude now or at any point in your investigation that the release in
question is not from any tank which you have owned or operated, please notify
the MPCA immediately and explain the basis of your conclusion. The MPCA Project
Manager may authorize you to stop your investigation.

free product, installing or sampling monitoring wells and excavating soil. I

It has come to my attention that the remodeling is possibly violating the Con-
ditional Use Permit for the referenced station originally issued in 1970. The
following conditions must be met to retain the permit:
1) You must have a minimum of two service bays. `
2) You cannot sell grocery items - bread and milk, etc..
3) You must provide a r.estroom for each sex.
4) You must meet the requirements of the R.B. zoning district.
I have been informed that the remodeling has eliminated one res[room and this
can not be. If you wish to amend your Conditional ?se Permit, you will have
to appear before the A.P.C. and the City Council for their approval or disapprov-
al. I woUld suggest that you cease further construction until these approvals
are obtained. If you wish to continue business as usual, you may by restoring

Tom Hedges submitted to the City Council a proposed 1985 Budget which has
been drafted by the office of the City Administrator with the assistance of
the Director of Finanee during the months of July and August. The budget
being presented was for $5,776,000.00 for General rund Departmental Operations
and the City Council has recommended that it be reduced to approximately
$5,275,000.00. There were no comments or suggestions from members of the
audience and after discussion by the Council, Egan moved, Thomas seconded the
motion to approve the budgetary process to date and direet flarther considera-
tion of the budget by.the City Council. It_.was noted that a copy oP the
proposed budget is available at the City Hall for review by members of the
public. All voted in favor.
TIRES PLIIS ST9lm9RD - AlOCQ STATION - CONDITIONAL IISE PSRKLT
On August 7, 1984, the City Council diseussed the conditional use permit
application for Tires Plus Standard on Cedar Avenue and further investigation
by the staff was requested at that time. Mr. Hedges understood that a new
owner has purehased the station and intends to comply with all City require-
ments. There were no appearances. Waehter moved, Egan seconded the motion to
renew the conditional use permit for a 90 day period with the understanding
that the owner will, within that time, comply with the City ordinanee require-
ments for signs and bathroom facilities, and in the event that there is no
compliance, the conditional use permit will be terminated. All voted in
favor. -
BOATIHG AHD RELATED iIATSR ACTIt1ITIES ORDINANCE
The issue concerning the Boating and Related Water Activity Ordinance was
brought before the Council and Mr. Hedges recommended that the Council con-
tinue consideration until a completed draft is submitted for review. Egan
moved, Wachter seconded the motion to accept the recommendation to continue
the consideration until the Ordinance draft is completed. All voted in favor.

The application of Dominium Group by Jack Safar for preliminary plat
approval of Thomas Lake Place consisting of 238 multiple dwelling units on
approximately 17.5 acres was considered by the Council. Mr. Hedges introduced
the subject and Dale Runkle, City Planner, detailed the application for the
Council. The Advisory Planning Commission recommended approval sub,ject to
conditions. The pro,ject is part of the Blackhawk Park Planned Development

In official action that was taken by the Eagan City Council
at a regular meeting held on Tuesday, September 4, 1984, the
service station conditional use permit for Tires Plus Standard
was approved. That approval was subject to the following condi-
tions: 1) All outdoor business signs must be in conformance
with the sign ordinance, and 2) a second restroom must be recon-
structed to allow restroom facilities for both women and men.
The Eagan City Council has approved the service station renewal
based on the two aforementioned conditions and is expecting
that action will be taken to satisfy both of these items within
ninety (90) days or, at the latest, December 15, 1984.

install the second restroom facility or comply with the sign i
ordinance, contact Mr. Dale Peterson, Chief Building Inspector ,
for the City of Eagan, at 454-8100. ,

1982. Wachter moved, Egan seconded the motion to approve the low bid of
Parrott Construetion Co., including the alternate for construction in the

The application of Lawrence Miller and Gary Lowe for conditional use ;
permit to provide for more than three amusement devices at the A& W Restau- ?
rant at 3998 Sibley Memorial Highway was next considered. The Planning Com- '
mission reviewed the application on Oetober 27, 1981 and recommended approval, i
subject to certain conditions. Both Mr. Lowe and Mr. Miller were present.
They explained the problem of reduced business due to the relocation of Cedar
Avenue and Highway #13 in the area and stated thaE the applicants will comply
with all applicable ordinances, but requested the restaurant be permitted to
continue to be open until 12:00 p.m, on Friday and Saturday nights. They
stated that the machine portion of the restaurant, however, eould be closed at
10:00 p.m. to comply with the required ordinances. Smith moved, Egan seconded
? the motion to approve the application, subject to the review by staff as to ?
the maximum number of machines that could appropriately 6e placed in the (
establishment and further, that the portion of the building used for the ,

Mr, Tom Gegax, owner of the Amoco Oil Station at Idicols Road and Diffley ;
Road appeared and requested a variance to provide for a 50 foot sign at the j
freeway side along Cedar Avenue. A site distance survey was submitted by Mr.
Gegax, done by Del Schwanz, Surveyor, indicating that a 50 foot high sign
would be required in order to see the sign from the depressed freeway. Noting
the hardship due to the depression of the freeway, Smith moved, Wachter sec- I
onded the motion to approve the application, su6,ject to ordinance compliance
in a11 other resQeets. All voted yea. '

Bids were received on October 29, for the utilities, grading and gravel
base for Improvement Projects 340 and 341 consisting of Improvement #81-13 in
Windcrest 2nd Addition and Windtree 2nd Addition. The low bidder is Erickson
Construction Co. in the $186,609.00. It was noted that the easements had not
been acquired for ponding purposes nor have the Development Agreements for
either of the additions been executed and signed by the Developer. Smith
moved, Egan seconded the motion to approve the low bid of Erickson Constrac-
tion Co., sub,ject to compliance with ail ordinance requirements, including
_ final plat and development agreements and execution of the necessary storm
sewer easements. All voted in favor.

Silver Bell Road and Cedarvale Boulevard/Cedar Grove Parkwav:
The extension of the westbound right-tum lane to provide a minimum of 600 feet is
needed to accommodate future a.m. peak hour traffic volumes.
Blackhawk Road/Silver Bell Road
• Instal'lation of a traffic signal.
• Exiension of the northbound left-turn lane to provide a minimum of 250 feet. Installation
of a 300-foot southbound right-turn lane is also recommended.
Nicols Aoad/Difflev Road
• Installation of an additional eastbound left-turn lane to provide dual left-turn lanes, one
through lane and one shared through/right-turn lane on this approach.
In addition to these recommended improvements from the 2002 AUAR, the following additional
roadway improvements aze needed for all intersections to operate at an acceptable LOS D or
better during the a.m. and p.m. peak periods for future 2015 build conditions. All recommended
improvements are shown in Figure 5.
Silver Bell Road and Cedarvale Boulevard/Cedar Grove Parkwav:

through lane and dual right-turn lanes on this approach.
Nicols Road/Difflev Road
Installation of northbound and southbound lefr-harn lanes. The north and south
approaches would then each consist of one left-turn lane, one through lane and one

and one right-turn lane on this approach
The analysis results shown in Table 3 indicate that with these recommended improvements, all
key intersections are expected to operate at an acceptable LOS D or better under year 2015 build
conditions. It is important to note that some of the intersection Level of Service (LOS) results
are near the threshold of acceptable operations (D/E). Therefore, as development plans move
forward, the City may want to consider replacing some of the general residential housing to
senior housing, which would generate fewer trips and improve overall peak hour operations in
the study area.

- The purpose of the City of Eagan's Cross Connection Control Program, as defined in the local Cross
Connection Control Ordinance, is to help eliminate possible contamination of the public water
distribution system;
An inspection of your facility's internal water distribution system was completed
on 04/11/2018. Inspectors reviewing your water system found connections that could possibly
contaminate the public water distribution system. Below are the requirement(s)found during the •
inspection.
Requirement(s) on this list must be addressed using only State approved backflow prevention
devices and State licensed plumbers.Some backflow prevention devices (assemblies)also require
testing by a State Certified Tester. We suggest that the licensed plumber installing the testable
assemblies also have the state certification to test assemblies. All testable assemblies must be tested
immediately at the lime of installation.
These requirement(s) must be completed by 05/18/2018. Once the requirement(s) have been
corrected, please call HydroCorp at 800-315-4305 or visit www.schedulemyinspection.net to
schedule a compliance inspection. If you are unable to complete the work within this time, please
contact HydroCorp to discuss an extension.
