INTRODUCTION
This report concerns the recent inspection our firm performed of the soil conditions at
the above referenced project. Authorization for the work uras received on April 13, 1973.
No deep soil penetration borings were put down for this construction. However, according
to our available geologic information, the surficial soil in the area is sandy glacial
till deposited by the Superior lobe of the Wisconsin glaciation.
We understand the addition will be a one-story, slab-on-grade structure. The exterior
walls will be approximate7y 17' high and the roof will be of bar joist construction. The
finished floor will be at elevation 100'. The structure will be supported on exterior
continuous spread footings and interior isolated column pads designed to rest on soil
having an allowable bearing capacity of 3000 psf. The interior and exterior footings
will be at elevation 97.6' and 95.0', respectively.

INVESTIGATION METHODS.AND RESULTS
On April 13 and 77, 1973, we performed visual inspections of the excavation. The exposed
soils were visually and manually classified in accordance with the Unified 5oi1 Classifi-
cation System and estimates were made of their strength properties. Several shallow hand
auger borings were also put down to further determine local subsurface soil conditions.
At the southeast corner of the addition, our hand auger boring encountered ]' of so`t,
brown, silty clay overlying clean, fine to medium-grained sand. We indicated to
Mr. Bernie Rimnac of Suburban Cement, the soft, silty clay should be removed prior to
placement of concrete. We recommended that either the footings be 7owered to the under-
lying sands, or a granular fill, with adequate lateral oversizing,be placed to original
grade. Mr. Rimnac decided to step the footings down to the under7ying sand.
Hand auger borings put down along the north and west footing trenches encountered 1.5' of
clean, medium-grained sand overlying a relatively stiff, brown sandy clay. Similar soil
conditions were encountered at the interior column pad locations.

Based on thQ results of our inspection and recommendations, it is our opinion the soil
system inspected should be adequate to support the design unit loading without detrimental
settlement.
As no deep soil penetration borings were put down for this construction, we cannot warrant
conditions below the depths of our shallow hand auger borings. Based on our knowledge of
the surficial soils in this area, the likelihood of inferior soil occurring at depth is
quite remote.

At a special City Council meeting'held on November 14, 1979, the
request of Peace Reformed Church to locate a 24 foot by 46 foot
mo6ile home unit for purposes of providing portable classrooms on
the north side of the church was approved.
It is the understanding of the City that the mobile home will be
used for that purpose for approximately two to three years while
the Church is planning a large addition to the present Church
structure.
There were no conditions attached to the granting of the permit,
please contact Mr. Dale Peterson, Building Inspector, when you
are ready ta proceed with locating the mobile unit on your
property. A building permit will be issued and processed by
his department.

I am writing to you because of my concern over the possihle
sale of the old Peace Reformed Church site to the On-Belay
treatment center for chemical dependency.
As you know, our area i.s zoned residential. Our homes are
literally on the doorstep of that property. If the sale is
approved it would do a tremendous amount of damage to residents
whose rights must be considered.
1. Our property value would be greatly decreased.
2. We could not feel safe in our own homes.
3. We would be afraid to leave our home empty when we
went on vacation.
4. We would be afraid to leave doors or windows open
in the summer. ,
5. We could not let our children play around there as they have always done before.
6. We were told it would be sold to another church
or school.
7. The B. Robert Lewis Shelter has already been
built by us - that is enough.
8. Just 6ecause our area is one of the older parts of
Eagan doesn't mean that our property value is not
important. . ,
I realize there is a need for chemical dependency treatment..
centers but they do'not belong in an established residential
area.

I hope that this matter never gets as far as the Planning Commission,
but if it does I hope that it is considered with the residents
of the surrounding homes in mind. We have been in the community
for a long time and have always supported it. Now we need
help when this and any other future offers for the sale of
this property are considered.
This issue has already caused a great deal of strife in our
community. I hope it can be settled before any more harm is
done.

Dear Reverand Muiskens:
The petition that you submitted to the City of Eagan on Jan-
uary 13th was presented to the City Council for formal con-
sideration at their meeting on January 18th. I regret to
inform you that the City Council, in reviewing your petition-
did not authorize the preparation of a£easibility report to
eliminate the referenced Nicols Road service drive south of
Marble Lane. The following reasons are cited for not further
pursuing this reauest:
1) While the elimination of the frontaqe road would affect
11 existing homeowners in addition to the church, the
church were the only signatures on the petition request-
ing the elimination.
2) Because there appears to be a certain amount of objec-
tion from the existing homeowners pertaining to the elim-
ination of their £rontage road, the City is reluctant
to expend the estimated $1,100.00 cost associated with
preparing a detailed feasibility report necessary to
hold the requested public hearina to discuss the request-
ed improvements. The petition submitted did not make any
reference to reimbursement of these costs should the pro-
ject not be approved by Council action subsequent to the
public hearing process.
3) While the petition requests inclusion into the improve-
ments proposed under Project 342 for the rehabilitation
of the streets within the Cedar Grove lst and 2nd Addi-
tion, this service road south of Marble Lane is within
the Cedar Grove 4th Addition. As such, it is outside
the limits of the proposed scope of the project and will
not be included within Project 342. The proper timing
for consideration of this frontage road without majorify
support will be with the proposed improvements to the

streets within the Cedar Grove 4th Addition at some
future date.
4) Because the petitioned improvements are primarily for
the benefit o£ the church parking lot circulation,
the Council feels that all costs associated with this
iriprovement should be the responsibility of the church.
After considering the above-referenced facts, the Council elect-
ed not to proceed any further with consideration of your peti-
tion. However, if you would like to pursue the subject fur-
ther, the City Council would consider the receipt of a petition
relating to the improvements as a separate project with the
related assessments reflecting the total costs associated with
the petitioned improvements.
If you would like to have further clarification pertaininq to
the Council's position in response to your petition, please
feel free to contact me for further clarification. In the
meantime, no further action will be pursued by the City with-
out further written requests from affected property owners.

The Couneil next renewed its disevssian concerning the.Wind Energy System
._? and Radio T.V. Tower Ordinance last presented at the September 7, 1982 meet-
ing. At that time questions were raised concerning the structural strength of
the windmill base and the language regarding a profassional engineer's inspec-
tion of the windmill. A report from Administrative Intern Mike Johnson vas
submitted concerning his contacts with the Jacobs Windmill dealer and made
suggested changes to the Ordinance. Certain other changes were discussed and
Wachter then moved, Thomas seconded the motion to approve the Ordinance as
revised to include changes recommended with the understanding the staff uill
reviex them to determine whether they are in conflict with any other ordi-
nances. A resident of the City appeared and made certain additional recom-
mendations for changes which will be submitted to staff for redraft. All
voted in favor.

Peace Reformed Church representatives had approached the City Planner
regarding a plan to expand the present church facility located on Yicols Road
by adding a general meeting room and an area which could be used for activi-
ties related to the church. Because the property is not zoned Public Facili-
ties, and the fact that the church has purchased property across Nicols Road
for a new Church facility, the Planner and City Administrator requested the
Council direct the procedures to follow eoncerning expansion plans. There
were no reoresentatives from Peace Reformed Church and the Council continued
the matter until later in the meeting.

Staff has been contacted by the Pastor of Peace Refornied Church in reyard
to expanciing the present church facility tn add on a general meeting roan
and an area which can be used for activities related to the church.
As you may recall, Peace Refornied Church has purchased the area on the west
side of Nimis Road for a new church facility. Hawever, it is staff's un-
derstanding that the church wishes to add on to their present facility in-
stead of building a new church an the land on the west side of Nicols Road.
It is more eoonanical for the Church to make an addition instead of breaking
groi.md for a whole new facility. The request fron the Pastor is in regard
to caould the Ci.ty allaa an addition to be oonstructed at the present site.
In reviewing the zoning of the parcel, the Church property contains Iots
(712=16 arid I,ots 20-24, Block 6?-Cedar Grove No. 4. _) The zonuxJ of the pro-
'perty is presently R-?l, Resideritial Single District, and would not allaa a
church facility. There£ore, staff cannot allaa any additims or perntits
for this new oonstruction. Before the Church prepares detailed plans for
this addition, the Church is requesting that the City Council review the
issue arid possiUly make a reconrendation as to whether.they would or would
not allow an addition to the Churrh.
Staff is suggesting that if the Council elects to allcw the Church txo build
an addition to the present structure, that the Church sulsTut an application
and rezone the property fmn R-1, Residential Single District, to P, Public
Facilities District, which would then zorie the property in accordance with
the present use. Oriae the properiy is zoned properly, the Church would then
be able to obtain a building nPm+;t through staff if all of the ordinance
requirarents are mt. If ordinance requiramnts are not met, then the Church
would then have to apply for the proper variances in order to obtain a build-
ing pennit. It is too early for staf£ to ]maa if the Church will be able to
meet all the ordinanoes at this time and staff would then perfonn the detail-
ed review when the site plan has been su]snitted for the building pernut re-
quest.
If the City Council wnuld give an indicaticn vjhether they would or would not
allow the addition to the Church, the Churrh would then ]maa whether to pro-
ceed with the detailed plans for the addition or other possible alternatives.

PARTIES: The CITY OF EAGAN, 3830 Pilot Kno6 Road, Eagan, Dakota County,
Minnesota, called "Eagan"; and LIVING WORD LUTHERAN CHURCH, 4300
Nicols Road, Eagan, Minnesota, called "Living Word".
RECITALS:
1. Living Word Lutheran Church has submitted an application for rezoning
of the property formerly owned and occupied by Peace Reformed Church with
address at 4300 Nicols Road, Eagan, Minnesota, and more particularly described
as Lots 12 through 16, and Lo[s 20 through 24, Slock 6, Cedar Grove No. 4,
Dakota County, Minnesota From R-1 (Single Family) to PF (Public Facilities).
2. A public hearing was held on the application before the Eagan Advieory
Planning Commission on Dctober 28, 1986 at which time the Advisory Planning
Commission recommended approval of the application for rezoning with certain
conditions.
3. The application was next heard before the Eagan City Council at its
meeting on November 18, 1986 at which time the Eagan City Council approved the
application, subject to certain conditions.

COVENANTS: In consideration of the mutual obligationa of the partiea hereto,
Eagan and Living Word hereby agree as follows:
1. The above-described application for rezoning to Public Facilities, be
and it hereby is approved, subject to compliance with the applicable Eagan
ordinances.
2. The lots described above included in the application of Living Word,
shall be combined as a single identification parcel for tax purposes with the
County of Dakota.
3. The property which is the subject of the application, shall be used
solely for worship and church-related purposes, unless the City Council
approves uses other than worship or church-related purposes after hearing held
following notice to neighboring property owners of such proposed change in
uses.
4. The undersigned hereby agree that [his agreement may be recorded with
the Dakota County Recorder and that the partiea ahall execute any and all
documents necessary to implement the recording of,this agreement.
5. The undersigned herehy agree that the provisiona of thia Agreement
shall run with the affected land described above in the application, and ahall
bind the heirs, succeseors and assigns of such land until terminated by
written agreement of the parties hereto.
6. This Agreement may be amended at any time by written agreement of the
partiea.

THIS ADDENDUM to Agreement dated November 18, 1986, by and between Living
Word Lutheran Church (Living Word) and the City of Eagan (Eagan).
WHEREAS, the parties intend to enter into an agreement allowing certain
property located at 4300 Nicols Road, Eagan, Minnesota and more particularly
described as follows:
Lots 12 through 16, and Lots 20 through 24, Block 6, Cedar
6rove.No. 4, Dakota County, Minnesota
to be re-zoned from R-1 to PF, and
WHEREAS, paragraph number 3 of the covenants of said Agreement refer to the
use of said property,
IT IS HEREBY AGREED:
1. That said paragraph number 3 of the covenants of the Agreement dated
November 18, 1986 shall be expanded to allow Living Word to use the property for
daycare/child care facilities and K-12 educational facilities, together with any
activities related thereto, without the prior approval of the Eagan City Council
or notice to neighboring property owners of such use.

1. An Agreement was entered into dated November 18, 1986 between Living
Word Lutheran Church and City of Eagan covering property located at 4300
Nicols Road, Eagan, Minnesota.
2. In addition, an Addendum to said Agreement was entered into dated
February 10, 1987 between the same parties regarding the same property.
3. The parties desire to amend the original Agreement and Addendum to
Agreement regarding the stoxm sewer trunk assessments applicable against the
property that are described in the principal Agreement.
COVENANTS: In consideration of the mutual covenants of the parties, Eagan and
Living Word hereby agree as follows:
1. Living Word Lutheran Church hereby agrees to be assessed for its storm
sewer trunk area assessments levied by the City of Eagan, against the property
at 4300 Nicols Road, Eagan, Minnesota, consisting of Lots 12 through 16, and
Lots 20 through 24, Block 6, Cedar Grove No. 4, Dakota County, Minnesota.

2. City of Eagan agrees to levy the storm sewer assessments applicable at
the rates in effect in 1986.
3. Living Word Lutheran Church hereby waives all objections to the storm
sewer area assessments to be levied against the applicable property.
