Dick Schweim stated he had no direct access to Nichols Road and
that the City built more road than was needeci. Mayor Ellison
questioned if there was a standard to aesess front footage with no
access. Mr. Colbert stated for commercial, there was. He stated
access is allowed.
Councilmember Wachter stated the ownership of the road had
changed. Mr. Colbert stated access was available. The petitioner
again argued there was no benefit to his property. Councflmember
Gustafson questioned if the City was charging double if he already
had access. Mr. Colbert stated no, he would have been obligated
regardless of the access.
Councilmember wachter questioned if that when the plat was
adopted, the road was planned. Mr. Colbert stated the rosd was
planned at the adoption of the plat. Councilmember McCrea questioned
if it was Schweim's iesponsibility. Mr. Colbert questioned who else
would pay for the assessment. Mayor Ellison questioned if the City
picked up oversizing. Mr. Colbert stated not on a commercial
propeity. Councilmember Egan stated they shoulci not change the zoning
for assessment purposes.
!layor Ellison stated Nichols Road should have been upgracied and
that the Council should abide by the assessment policy. Mr. Schweim
stated he would be willing to pay one-half of the assessments.
8gan moved, Wachter seconded, the motion to close the public
hearing ana approve the final assessment roll for Project 460A
(Nicbols Road) as it pectains to Lot 1, Block 2, Cedar Ridge lst
Addition, as recommended by the Special Assessments Committee, and
suthocize its certificstion to the County. All voted in favor.

Public Works Director Tom Colbert informed the Council the
assessments were properly calculated in accordance with all
appropriate special assessments policies and procedures for property
of like zoning. He stated the corner lot parcel was similarly
assessed to other corner lot properties located at other intersecting
roads along the improvement. Based on the City's appraisal verifying
that the increase in market value was at least equal to the amount of
proposed assessment, the staff recommended that the original proposed
assessments be reaffirmed.
Harold Mason stated hie pzoperty received no benefit from the
road. !layor Ellison questioned the zoning on the property. Mr.
Colbert stated it was Limited Business.
John Dean, FHA appraiser, questioned if the properties located
at the end of the circle were being assessed. Mr. Colbert stated they
Were receiving no assessment as they had no access.

Public Works Director Tom Colbert advised the Council that staff
recommended that Special Assessment Policy 82-2 be made available to
reduce the assessment obligation as referenced with the difference
being postponed until a change in use at a later date. Further, he
recwnmended that the application for senior citizens' deferment be
approved which would defer the reduced assessment until the senior
citizens' deferment ordinance.
Sgan moved, Wachter seconded, the motion to close the public
hearing and approve the final assessment roll for Project 442
Alternate, (Becker Road) as it pertains to Lot 4, Block 1, Loren
Place, as recommended by the Special Assessments Committee, and
subject to Policy 82-2 and a senior citizen deferment, and authorize
its certification to the County. All voted in favor.

Public Works Director Tom Colbert explained to the Council that
the assessments were calculated in accordance with past City policies
and procedures uniformly against all similarly zoned property.
However, because the apparent present use of the property is
under-utilized from its allowable zoning, the City's appraisal had
indicated that the increase in market value in its present state was
only S25,000.00. Therefore, it was recommended that the proposed
assessment be proportionately reduced according to the estimated
increase in market value of $25,000.00 and that the remainder be
postponed until such time that the property developed to a higher or
more intense use which would then reactivate the postponed portion of
the assessments.
John Bannigan, Attorney, stated they had retained their own
appraiser. He stated that 525,000.00 was acceptable, 6owever, he
recommended his clfent not sign the agreement.
Egan moved, McCrea seconded, the motion to close the public
hearing and approve the final assessment roll for Project 442
Alternate (Becker Road) as it pertains to Lots 1 and 2, Block 1, RSTP
Addition, in the amount of $25,000.00, and authorize its
certification to the County. Al1 voted in favor.

BACKGROUND INFORMATION
Project 460A provided for the upgrading of Nicols Road (Old Cedar
Avenue) from a rural County road ditch section to an urban street
with concrete curb and gutter and bituminous trailways. This
project was originally approved at a public hearing on February
18, 1986, with construction completed in early 1987 and the final
as essment hearing held on September 15, 1987. Enclosed on page
is the written objection submitted by t e property owner at
that public hearing. Enclosed on pages through -qD are
maps showing the location of the proper y to the proposed
improvemwents as well as calculations used to arrive at the f*n?
assessment amount. Also enclosed on pages through
are excerpts of the property appraisal performed for the City
evaluating the increased value of the property in relationship to
the proposed assessments.
The previous restrictions for direct access onto Nicols Road
(previously Cedar Avenue - County Road 23) were requirements of
Dakota County as a part ot the platting process. With the
subsequent revocation of this County road and the jurisdictional
turnback to the City of Eagan, there no longer exists the
restriction for this access.
STAFF RECOMMENDATIONS
The assessments were properly calculated in accordance with all
appropriate special assessments policies and procedures for
property of like zoning. This corner lot parcel was similarly
assessed to other corner lot properties locating at other
intersecting roads along this improvement. Based on the City's
appraisal verifying that the increase in market value was at
least equal to the amount of the proposed assessments, the staff
recommends that the original proposed assessments be reaffirmed.

my only access was and is Cedar Ridge Circle. This re-uired me
to pay $10000.00 for the construction of Cedar P.idge Circle.
Further, I had to request special assignment o£ my address to
be "Cedar Avenue" instead of Cedar Ridge Circle so my patients
could see I was still in the sarne area as I was before the
Highway construction moved us,

I am not interested in donating to Nicols Road improvement as
my property and access is on Cedar Ridge Circle. Plainly.,this
road impr.avement is for the benefit of Cedarvale Shopping Center
and the Federal Land Bank properties on Cliff Road. This road
improvement does not benefit my property or my Dental Practice,
as I have established clientl.e who find me sNecifically.
In closing, I hope that this letter covers all bases. I do not
feel that my property on Cedar Ridge Circle should be aGsessed
any more than any property located on Diffley or Cliff Road or
any other intersecting road. '
If the assessemnt of my property is not drojped completely, 2
will have to seek help from several other proyerties that fall
into my same catagory to secure 2ega1 help in settling this.

In accordance with your request, I have made an inspection
and a preliminary appraisal of the property located at 4355 -
4357 Nicols Road, Eagan, Minnesotl.
The purpose of this prel.iminary appraisal is to eslimate
the market value of the fee simple interest in the property ancl
to determine the benefits, if any, accruing to the property by
virtue of the upgrading o'f Nicols Road to a 9-tan collector
street under City of Eagan Pcoject #460A.
I have analyzed the value of the property before the
upgrading of Nicols Road and the value of the property after the
upgrxdinK of Niculs Road and £eel that ihe, proposed special
assessroents of $10,329.51 can be substantiated as of September
15, 1987.
In the before situation the property was served by a rural
roadway which has severe cracking with the pavement life having
lie.en exceeded. This was a 24' wide bituminous roedwaY wiLh gravel
shoulders and a drainage ditch. According to a feasibility study
the road was originxlly graded in 1935 and surfaced in 1942. The
road was overlaid in approximately 1962.
In the after situation the subject property is now servecl
6y a 9-ton collector road with concrete curb and gutters. This
i:; a 52' wide bituminous road with storm sewer laterals.
In the both the before and after situations the site is
surved by a 16" Nutc:r line, sanii:ary sewer, and trunk storm
sewer.
The sitcK=is 1 206.E9' X 210.77' parcel which is improved
witli a one story office building which was constructed in 1997.
The huilding contains a total of 2,304 S.F. and has a full
basement. The building is of wood frame construction with a
brick veneer. Heating is provicled by two forced air furnaces.
There are Cwo air conditioning The overall conditiun of
the buildinq is mostly good. (s)
Cunstruction costs for the upgrading of Nicols Road have
been estimated at $1,178,816. Assessments will generate $746,927.
or E3% of the total project cost. The remaining 37% or $431,889.
will come from Municipal State Aid funds. Commerical properties,
such as the suhject property, fronting on Nicols Road will be
assessed at the rate of $78.45/front foot. This rate includes
all street construction costs to build a 52' wide bituminous
r•oadway of 3-ton design, 50% of the grading, but not the 8'
trailway. Retnining well construction has been assigned to part
of the grading costs.
The rate of $78.45/front foot is in line wilh rates
r.liarged by many other municipalities and, as previously
mentionecl, is felt that 6enefits of at least $10,329.51 cun be
substantiated.
It shoulcl be clearly understood that this letter
constitutes only a statement of the final value estimate, and
that said value has been based upon a complete written appraisal.
The written appraisal, although in rough form, has been prepared
and retained in my files. Should you require a more formal
report, the same is available to you upon request.
I hereby certify that I have no present or contemplated
future interest in the real estate that is the subject of this
report and that 2 have no personal interest or bias with respect
to the subjec.t matter o£ this report or the parties involved and
that the amount of the fee is not contingent upon reporting Fa

Dear Dr. Mason:
At the formal public hearing before the City Council, you
submitted a written objection to the proposed final assessments
against your property for the improvements associated with that
project. Subsequently, the Council deleted your property from
the final assessment roll that was formally adopted and certified
to the County for certification onto the tax rolls. Your
objection was then referred to the Special Assessment Committee
for an in-depth review of the improvements, the related benefit
to your property and the proposed assessments.
This Special Assessment Committee is comprised of two Council
members, two Planning Commission members and three residents of
the community. After their review, they will forward a
recommendation to the City Council for formal consideration of
final adoption of the proposed assessments. The Council's
consideration of the Special Assessment Committee's
recommendations will be held at a future formal public hearing
and mailed notification similar to the public hearing process you
recently completed.
While there is no definitive schedule for the Special Assessment
Committee meetings, it is not anticipated that this item will
come before that Committee any sooner than April of next year.
In the interim, the City will be performing a formal appraisal of
your property to verify that the benefit to your property through
increased value was at least equal to the amount of the proposed
assessments. This appraisal prbcess will be coordinated through
our City Attorney's office during the ensuing months.
When the Special Assessment Committee meeting has been scheduled,
you will be so notified in writing with a request to provide any

In accordance with your reqnest, I have made an inspection
and a preliminary appraisal of the property located at 4355 -
4357 Nicols Road, Bagan, Minnesota.
The purpose of this preliminary appraisal is to estimate
the market value of the fee simple interest in the praperty and
to determine the benefits, if any, accruing to the property by
virtue of the upgrading of Nicols Road to a 9-tan r.ollector
street under City of Eagan Project #460A.
I have analyzed the value of the property before the
upgrading of Nicols Road and the value o£ the proparty after the
upyrading of Nicols Road and feel that the proposed special
assessments of $10,329.51 can be suUstantiated as of September
15, 1987.
In the before situation the property was served by a rural
roadway which has severe r.racking with the pavement life having
Leen exceeded. This was a 24' wide bituminous roadway with gravel
shoulders and a drainage ditch. According to a feasibility study
the road was originally graded in 1935 and surfaced in 1942. The
road was overlaid in approximately 1962.
In the after situation the subject property is now served
6y a 9-ton collector road with concrete curb and gutters. Thi.s
is a 52' wide bituminous road with storm sewer laterals.
In the both the before and after situations the site is
' served by a 16" water line, sanitary sewer, ancl trunk starm
sewer.
' The site is a 206.67' X 210.77' parcel which :is improved
with a one story office building which was constructed in 1977.
The building contains a total of 2,304 S.F. and has a full
' basement. The building is of wood frame construction with a
hrick veneer. Heating is provided by two forced air furnaces..
There are two air conrli.ti.oni.ng units. The overall condition of
the huilding is mostly good.

Construction costs for the upgrading of Nicols Road have
, been estimated at $1,178,816. Assessments will generate $746,927.
or 63% of the total projc:ct cost. The remaining 37% or $431,889.
will come from Municipal State Aid funds. Commerical properties,
' such as the subject property, fronting on Nicols Road will be
assessed at the rate of $7$.45/front £aot. This rate includes
all street conetruction costs to build a 52' wi.de hituminous
roadwaY of 9-ton design, 50% of the grading, buC not the 8'
' trailway. ftetaininq wall const.ruction has 6een assigned to part
of the grading costs.
' The rate of $78.45/front foot is in line with rates
charged by many other nFUnicipalities and, as previously
mentioned, is felt that benefits of at least $10,329.51 can he
