BACKGROUND INFORMATION
Project 460A provided for the reconstruction and upgrading of
Nicols Road (Old Cedar Avenue) from a County rural ditch section
to an urban street with curb and gutter and trailways. The
public hearing approving this project was held on February 18,
1986, with construction being completed in 1987 and the final
assessment hearing held on September 15, 1987. At that time, Mr.
Schweim submitted the written objection enclosed on page 7;1-.
Also enclosed on pages -7;?_ through _79__ are location maps and
calculations pertaining to the amount of the proposed
assessments. Enclosed on pages _2Z) through QL are excerpts
from the appraisal report ordered by the City t'or evaluate the
amount of the assessments in relationship to any increase in
property value.
In the submitted written objection, it is indicated that the City
denied direct access onto Nicols Road. At the time of
development, Nicols Road was then called Cedar Avenue and under
the jurisdiction of Dakota County as County Road 23. It was the
County who restricted access onto their County road at that time.
Subsequently, this County road has been revoked and the
jurisdiction of this roadway turned back to the City of Eagan.
'Fhe City of Eagan does not have similar restrictions regarding
direct access to this roadway.
STAFF RECOMMENDATIONS
The assessments were properly calculated and allocated in
accordance with adopted policies and procedures for all similar
zoned type property. Based on the appraisal by the City
verifying an increase in market value at least equal to the
amount of the proposed assessments, it is the staff's
recommendation that the original assessment as proposed be
reaffirmed.

Regarding the notice of Special Assessment, Project #460A, against the
following property: 10-16820-010-02, I hereby submit a written objection
of the assessment amount for your consideration.
The property described does not have direct access on to Nichols Road,
in fact, the property has already been assessed for access on to Cedar Ridge
Court. To stress the matter, direct access on to Nichols Road was requested
by the owners at the time of planning and denied. Had the City of Eagan
approved this request, the special assessment would be justifiable and the
prcarty owners would be anticipating such an assessment. Based on the
faccs presented, the assessment is invalid, and refusal to requite is
implied.

In accordance with your request, I have made an inspection
nnd a preliminary appraisal of the property located at 4381
Nicols Road, &agan, Minnesota.
The purpose o£ this preliminary appraisal is to estimlte
the market value of the fee simple interest in the property and
to dc:termine tlje benefits, if any, accruing Co the property by
virtue of the upgrading of Nicols Road to a 9-ton collector
street under City of fiagan Projecl #460A.
I have analyzed the value of the property before the
upgrading of Nicols Road and the value of the property after the
upgc•ading of Nicols Road and feel that the proposed special
assessments of $21,573.75 can be substantiated as of September
15, 1987.
In the before situation the property was served by a rural
roadway which has severe cracking with tkie pavement lif'e having
been exceeded. This was a 24' wide bitmninous roadway with graveI
sltoulders and a drainage ditch. According to a feasibility studq
the road was originally graded in 1935 and surfaced in 1942. The
road was overlaid in approximately 1962.
In the after situation the subject property is now served
by a 3-ton collector road with concrete curb and gutters. This
is a 52' wide 6ituminous road with storm sewer laterals.
In the both the before and after situations the site is
sc:rved Uy a 16" water line, sanitary sewer, and trunk storm
sewet-.
Tlie site is a slightly irregular shapeci corner site
containiug 3.77 acres more or less and subjecl: to survey. The
siCe is improved with Jerry's Nursery. Lnprovements consisi of a
one story nurser3t'building constructed in 1977. The building
contains a total of 7,900 S.F. The back portion or the ware6ouse
portion has a 14' ceiling height and a total area of 3,000 S.F.
while the front portion has a 9' ceiling height and a totsil area
of 4,900 S.F. There is no basement. The building is conslc•ucted
on a concrete slab and is in average condition. There is a
canopy on the east and south side he building. Much of the
site is fenced. ? EO

Construction costs for the upgrading of Nicols Road have
? been esti.mated at $1,178,816. Assessments will generate $746,927.
or 63% of the Lotal project cost. The remaining 37% or $431,889.
will come from Municipal State Aid funds. Commerical properties,
such as the subject property, fronting on Nicols Road will. be
? assessed at the rate of $78.45/front foot. This rate includes
all street construction costs to build a 52' wide bituminous
c•oadway of 9-tun desiqn, 50% of the grading, but not the 8'
? Crailway. ReCaining wall construction has been assigned tn part
of the grading costs.
? The rate of $78.45/front foot is in line wiCh rates
charged by many other municipalities and, as previously
mentioned, is felt that benefits of at least $21,573.75 can be
substantiated.
It should be clearly understood that this letter
constitutes only a statement of the final value estimate, and
that said value has been based upon a complete written appraitial.

and is to be billed at the non-continuous streetlighting rate of
$3.45 per acre per quarter =$12.87 per quarter.
The City is currently being billed by Dakota Electric for the

separate from the issue of the future develogoent.
Mr. DesLauriers reiterated his concerns. There was much
discussion regarding the ponding and the assessments.
Egan moved, Gustafson seconded, the motion to close the public
hearing and approve the final assesstnent roll for Project 444R
(Holland Lake Storm Sewer) as it pertains to Parcel 10-02600-011-52,
as recommended by the Special Assessment Committee, and authorized
its certification to the County. Wachter, Gustafson, Ellison and Egan
voteci in favor; McCrea voteo against.

Public Works Director Tom Colbert informed the Council the
affected property was properly assessed in accordance with its zoning
classification, and opportunities to reduce the assessment in
accordance with its present use were extended to the property owner.
Therefore, it was the staff's recommendation that the original
assessment be reaffirmed based on its zoning classification or that
the reduced assessment be certified subject to the timely execution
of the required agreements.
Mr. Adelman stated that he aqreed to the $4,500.00 amount but
would not sign the agreement. He stated he would like the matter
settled. Ee informed the Council that he had lived on the property
for 29 years. Councilmember Egan informed Mr. Adelman that unless he
took the step to re-zone, nothing would happen and that he had
complete control of the matter. Mr. Egan explained the effect of the
agreement. He stated it was a non-issue. Mayor Ellison stated he felt
it was fair to tax commercial higher than residential. Mr. Colbert
stated the agreement allows a way to find the exact amount if the use
was changed.
l7cCrea moved, Egan seconded, the motion to close the public
hearing and reaffirm the final assessment roll for Project 460A
(Nichols Road) as it pertains to Parcel 10-03000-010-29 and authorize
its certification to the County. All voted in favor.

Dick Schweim stated he had no direct access to Nichols Road and
that the City built more road than was needed. Mayor Ellison
questioned if there was a standard to assess front footage with no
access. Mr. Colbert stated for coanmercial, there was. He stated
access is allowed.
Councilmember Wachter stated the ownership of the road had
changed. Mr. Colbert stated access was available. The petitioner
again argued there was no benefit to his property. Councilmember
Gustafson questioned if the City was charging double if he already
had access. Mr. Colbert stated no, he would have been obligated
regardless of the access.
Councilmember Wachter questioned if that when the plat was
adopted, the road was planned. Mr. Colbert stated the road was
planned at the adoption of the plat. Councilmember McCrea questioned
if it was Schweim's cesponsibility. Mr. Colbert questioned who else
would pay for the assessment. Mayor Ellison questioned if the City
picked up oversizing. Mr. Colbect stated not on a commercial
property. Councilmember Egan stated they should not change the zoning
for assessment purposes.
llayor Ellison stated Nichols Road should have been upgraded and
that the Covncil should abide by the assessment policy. Mr. Schweim
stated he would be willing to pay one-half of the assessments.
Egan moved, Wachter seconded, the motion to close the public

(Nichols Road) as it pertains to Lot 1, Block 2, Cedar Ridge lst
Addition, as recommended by the Special Assessments Committee, and

Public Works Director Tom Colbert informed the Council the

of like zoning. He stated the corner lot parcel was similarly
assessed to other corner lot properties located st other intersecting
roads along the improvement. Based on the City's apprafsal verifying
that the increase in market value was at least equal to the amount of
proposed assessment, the staff recommended that the original proposed
assessments be reaffirmed.
Harold Mason stated his property received no benefit from the
road. Mayor Ellison questioned the zoning on the property. Mr.
Colbert stated it was Limited Business.
John Dean, FHA appraiser, questioned if the properties located
at the end of the circle were being assessed. Mr. Colbert stated they
were receiving no assessment as they had no access.

Itoad and that at the time of develapment of Cedar Ri.dge lst Addition, the
Cotmty controlled Nicols Road and restrictect the access. Subsequently Che
CoimCy Road has been revoked and the jurisdictian o£ this roadway has been
tutned back to Che City of Eagan.
Richard Schweim appeared before the conmi.ttee and indicated that he had
put in Cedar Ridge Ci.rcle to gain access Co their property since they were
denied access di-ectiy onCo Nicols Tioad. He staCed that they bore Che cost
o£ Cedar Ridge Circle and now were bei.ng asked to pay for Nicols Road when
he claims that they do not derive arYy bene£it. Mr. Schweim indicated that
he is not served directly off of Nicols Road and thaC due to the diminished
volume in Craffic that Nicols Road carries, he perceives no cammrcial
benefit to being ].ocatecl next to Nico2s Road. Mr. 5chweim indicated hi.s
wiLlingness to pay his £air share ot the assessment which he suggested might
be in the neighborhood of $12,000.00, but he objected Co the proposed

Special Assessment Objection
Dear Mr. Schweim:
At the formal public hearing before the City Council, you
submitted a written objection to the proposed final assessments
against your property for the improvements associated with that
project. Subsequently, the Council deleted your property from
the final assessment roll that was formally adopted and certified
to the County for certification onto the tax rolls. Your
objection was then referred to the Special Assessment Committee
for an in-depth review of the improvements, the related benefit
to your property and the proposed assessments.
This Special Assessment Committee is comprised of two Council
members, two Planning Commission members and three residents of
the community. After their review, they will forward a
recommendation to the City Council for formal consideration of
final adoption of the proposed assessments. The Council's
consideration of the Special Assessment Committee's
recommendations will be held at a future formal public hearing
and mailed notification similar to the public hearing process you
recently completed.
While there is no definitive schedule for the Special Assessment
Committee meetings, it is not anticipated that this item will
come before that Committee any sooner than April of next year.
Zn the interim, the City will be performing a formal appraisal of
your property to verify that the benefit to your property through
increased value was at least equal to the amount of the proposed
assessments. This appraisal process will be coordinated through
our City Attorney's office during the ensuing months.
When the Special Assessment Committee meetinq has been scheduled,
you will be so notified in writing with a request to provide any

additional information or appraisals you may have compiled in the
interim. Once all this information has been gathered , a staff
report will be prepared for the Committee meetinq with a copy
forwarded to your attention prior to that meeting.
In the interim, this special assessment will continue to be
listed as a"pending" assessment but there will be no interest
accrued beyond the amounts proposed at the time of the recent
final assessment hearing.

In accordance with your request, T. have made an inspection
' and a preliminary appraisal of the property located at 4381
Nicols Road, Bagan, Minnesota.
The purpose of Ehis pre,liminxry appraisal is to estimate
' the market value of the fee simple interest in the property and
to de.termine the benefits, if any, accruing to the property by
virtue of the upgrading of Nicols Road to a 9-ton collector
t street under City of Eagan Project #460A.
I have analyzed the value of the property before the
' upgrading of Nicols Road and the value of the, property after the
upgrading of Nicols Road and feel that the proposed special.
a::sessments of $21,573.75 can be substantiated as af September
15, 1987.
' in the beFore situation the property was served by a rural
roadway which has severe cracking with the pavement liFe liaving
' been exceeded. This was a 24' wide bituminous roedwa,y with gravel
shoulder•s and a drainage ditch. According to a feasibility study
the road was originally graded in 1935 and surfaced in 1942. The
read was averlaid in approximately 1962.
' In the after situation the subject property i.s now served
bS, a 9-ton collector :-oad with concrete curb and gutters. This
' is a 52' wide bituminous road with sLorm sewer laterals.
T.n the both the before and after situations the site ss
' served Uy a 16" water line, sanitary sewer, and trunk storm
sewar.
The site is a slight.ly iri-egular shaped corner site
' containing 3.77 acres more or less and subject to survey. The
site is improved with Jerry's Nursery. Improvements consist of a
one stnry nursery bui.lding construr,ted i.n 1977. The buil.di.ng
' contains a total of i,900 S.F. The uack portion or the warehouse
pori;ion has a 14' cei.ling height and a total area of 3,000 S.F.
whilc: the front porti.on has a9' ceili.ng height and a total area
, oF 4,900 S.F. There is no basement. The building is constructed
on a concrete sl.ab and is i.n average condztzon. There is a
canopy on the east a.nd south sides of the building. Much of the
site is fenced.

Construction costs for the upgrading of Nicols Road have
' been esti.mated at $1,178,816. Assessments will generate $746,927.
or 63% of the total project cost. The remaining 37% or $431,889.
w'til come from Municipal State Aid funds. Commerical properties,
such as the su6ject property, fronting on Nicols Road will be
, assessed at the rate of $78.45/front foot. This rate includes
all street construction costs to build a 52' wide bituminous
roadway of 9-ton design, 50% of the grading, but not the 8'
t Lrailway. Retaining wall construction has been assigned to part
of the grading costs.
' The rate of $78.45/£ront foot is in line wilh rates
charged by many other municipalities and, as previously
mentioned, is felt that benefits of at least $21,573.75 can be
substantiated.
It should be clearly understood that this letter
constitutes onl,y a staLement of the final value estimate, and
that said value has been based upon a complete written appraiFal.
The written appraisal, although in rough form, has been prepared
and retained in my files. Shovld you require a more formal
report, the same is available to you upon request.
I hereby certify that I have no present or contemplated
future interest in the real estate that is the aubject of this
report and that I have no personal interest or bias with respect
to the subject matter of this report or the parties involved and
that the amount of the fee is not contingent upon reporting a
predetermined value or upon the amount of the value estimate. I

1. Remove all sheet metal at perimeter and mark for re-use.
2. Remove existing EPDM roofing system down to the existing insulation and dispose of in a state approved landfill. Rock
to be removed by owner and reused on new roof. Remove the loose gravel from the existing BUR roof and dispose of
it in a state approved landfill. (Roofing dust and debris can enter the building because of the tear-off process. Dust
from the bar joist can also fall. It is the owners/tenants responsibilty to cover and protect the contents in the
interior of the building.)
3. Provide and install new wood blocking to accommodate the height of the new insulation.
4. At sections "A" only install one layer of Y2" wood fiberboard insulation over the entire roof area per manufacturer's
specifications.
5. At roof areas A and B _.045 mil EPDM is to be loose laid and 1 Y rock ballast to be installed over the membrane.
6. Flash in all roof penetrations as per manufacturer's specifications.
7. Re-install sheet metal using new fastners and caulking as required.

I did read your letter and the recent e-mail sent to the Council. The Mayor and councilmember's were forwarded both
pieces of correspondence, however there was no direction given for a response. It is my suggestion that a conversation
with the Council might be a good venue for presenting your thoughts and concerns. The Listening Session that precedes
each Council meeting at 6 :00 PM in the Eagan Room at City Hall offers a good opportunity to have some dialogue about
the concerns you have expressed in recent correspondence. Our next meeting is this coming Monday, August 3.

Rick from Jerry's hopefully I'm the talk at city hall.
In case Jerry's is not. Here is what I am concerned about all the non city revenue retail outlets that
Eagan allows in parking lots. It has started to cost me my business to the point where I am now down
this season to the tune of 40% how would you or any one take 40% away It could cause me to {GO
OUT OF BUSINESS} yet I'm expected to pay $4000.00 in one year tax hike.
I'VE had my Taxes raised by $10,000. on A lousy piece of PROPERTY
city wants to change to residential yet I pay on commercial property. This is a joke that is not funny I
am worried to death. only have squatters take away my and the cities income. The city is out of line
and needs to address these issues. I have to pickup with my taxes. I can't do it. Tom something has
to be done If Bachmans or Linders want
to have business then they need to set up a business not cripple the city and business's like my self.
I have been in Eagan 44 YEARS. This not the way a city should treat a good business in a city of
44years Everyone thinks its harmless its not.
THEY HAVE TO GO. Please respond because no one else seems to have enough to do it.

I am appalled by the lack of response that I have not received from all in the council on my letter to
each of you.
YOU TAKE NO NOTICE OF THE FACT THAT I HAVE AN ISSUE OF HOW YOU TREAT BUSINESS
IN THIS COMMUNITY.
As I already have stated in my letter something has to be done with the Linders and other squatters
that set up shop and make us suffer from lack of revenue that is coming out of my and other
business's have to make up for. I will start a Campaign to end this with the other business's as well as
the newspaper if this is not addressed. By the council. There can be no more and what is here must
GO. Please give me some feed back a very upset business owner of over 44 years in the community.
Need I say more because I will starting with my customers and move forward till the end of this being
with Squatters gone as well as a new council if you are not interested in helping this city and
business's. Now I am requesting an answer as to what can be done.

Jerry's Garden Center is going on 53+ years of operation - 41 years have been in Eagan. Perhaps Jerry's is older than
some of you, which makes it one of the oldest businesses remaining in Eagan. During all those years, Jerry's has run
honestly; it has never been a problem to the community and has only tried to do what's right for employees and
customers.
Last year, Nicols Road, on which Jerry's is located, underwent "Improvements" during May (a garden center's busiest
month) that included repainting/remarking the road. With the new design, I feel sorry for my fellow businessmen at the
corner of Cliff & Nicols where there is increased congestion. The rest of the road markings don't make much sense to
me. In addition, Nicols Road had no significant potholes or cracks (as a number of other Eagan streets/roads do)
deeming road repair necessary. So, the "improvements" were unnecessary, they limited smooth traffic flow, and made
an incredible negative impact on my business - sales were DOWN during May 2008. As if this doesn't sting enough, the
City of Eagan wants me to pay a portion of the cost of the "improvements." I understand that Jerry's received a parking
lot apron and curb repair, but I didn't need either, nor did I request them. This is criminal!!!
In only 8 years, my property taxes have gone from $10,000 (2001) to $21,000. How much have you taxed Linden's and
other vendors who put up tents in parking lots for a brief period of time? It is my understanding that they often break
code violations. They put up trashy, banner ridden, greenhouses. They put customers in danger of being hit as they walk
through parking lots carrying plants and not paying attention to vehicles trying to find a parking space. Apple Valley does
not allow such businesses in their city - for good reasons they care about the way the city looks, safety and their
business community. I wish you would keep such businesses out of Eagan, hold my taxes at bay, and then I could use the
extra income to improve my property. It angers me to think about parking lot gypsies who take a lot of money out of
Eagan. Because I am struggling to make ends meet, I have no extra to enhance the appearance of my property.
Those of us who have put our whole lives and the lives of our employees into this community are getting nothing but a
slap in the face. It doesn't make sense that you are forcing me to shut down - a businesses that has supported Eagan for
41 years - and that you welcome "fly-by-nighters" such as Linden's. If you are so concerned about where your next dollar
is going to come from, look in your own backyard - respect the businesses that have upheld Eagan throughout the years.
As I write this letter, the rage I feel is indescribable I Why should I have to feel this way??? I have done nothing but be a
good businessman for over 40 years. I don't understand why a City Council won't protect my business rights and
community benefits.
