The upper level, deck, and porch may not be occupied until these issues aze resolved. This decision has been made for the following reasons: 1. Your building contains violations o£ a. Minnesota Statute 1613.62 b. Minnesota State Building Code 1300.2100 a Uniform Fire Code, Sections 12073 and 2501.8.2 d. Uniform Building Code Sections 106.1; 507; 1003.3.3.6; 1004.2.3.2; 1004.2.4; 1007.23; and 1007.2.5. Further violations or problems may become appazent as a result of the plan review and field inspection process. 2. A pertnit was not applied for, or issued, for the major remodeling work. This is a violation of Eagan City Code, Section 4.03. It has been over seven weeks since notification of these problems. There is an increasing risk of injury to your employees and customers by your inaction. • The City of Eagan's Fire Mazshall and Fire Inspector have been asked to periodically stop by your business and verify that the azeas in question aze not occupied. • Police Operations Captain, Jim McDonald, has also been contacted regarding the liquor license and numerous violations. • The Eagan City Council has not approved the established volleyball court and covering of the pazking spaces. Contact the Planning Division for direction on this issue. On Friday, September 25th, you indicated that we would receive the documents required by September 27th. The City has attempted to work with you on this issue, but we have not received all of the requested information to comply with requirements of the Minnesota Building Code. Railings required to separate 450 squaze feet sections of the loft area were not installed correctly. 2. Tables were present with no chairs set next to them; however, chairs were stacked on the other side of the railing and could easily be reached. 3. A sign "29 OR LESS OCCUPANTS ON LOFT AT ONE TIME" has not been posted. Following is a record of contacts I have had with the owners regarding these issues: • telephone call on January 23, 2001 • letter dated January 24, 2001 • letter dated February 16, 2001 • office visit on February 20, 2001 by Owner Rick Casper, wherein I reviewed the building plan with him and explained the above requirements. . His contractor called and I explained the 450 sq. ft. maximum requirement for railings to him. That no bar or liquor lounge shall be incorporated into this Mr. Steak restaurant and only a service bar shall be permitted and regulated by a bartender. 3. That the hours of operation of the restaurant shall be limited to 11 a.m. to 10 p.m. weekdays and 11 a.m. to 11 p.m. on weekends. No exceptions will be permitted. 4. That liquor will be served only within the dining area and in the event the restaurant is sold or converted into another use, the conditional use permit shall be termi- nated and another application would be necessarily required to be submitted for appraval. 5. No live entertainment wi12 be allowed in the restaurant. 6. That the permit will be reviewed by the City within one year from the completion of the construction of the l restaurant to determine whether the applicant abides by the ? conditions imposed. 7. Further, subject to all applicable ordinances and regulations. Member Blomquist suggested that a policy be established for locations of liquor establishments throughout the City within the comprehensive planning process. Hall seconded the motion. Tom Westbrook, manager, was present and explained that the country, club had a liquor license through December 31, 1978, but that the cost did not warrant the continuance of a regular liguor license. Regarding your email to Mr. O'Malley, it was the wish of the owners to get the inside restaurant reopened as quickly as possible, so the patio area was indicated for separate permitting in the Spring of 2012 following a final design process. The area shown was for contractors and city officials to fully understand inside chase areas to a future patio area yet to be fully designed. The outside area shown to the East was originally a main floor deck with a second level deck above. The upper level deck will not be replaced and the main level deck will be replaced with a concrete patio. The result is significantly less outdoor seating to the East. As this is a replacement of an area previously approved as an outdoor dining area, we have assumed that no CUP would be required for that space. As indicated on the plans, separate permitting will be sought following design completion for that area. The parking shown is only related to that portion of the site. The vast majority of parking for the facility is to the north of this area. As the second level deck is not being replaced, less parking will actually be required than before the fire. It appears that the issue with the city is that no CUP permit, building permit was obtained for the deck area to the south, and it infringed into the setback area. I was aware of a setback issue, thus our direction to resize this deck to the setback line, but was not aware of the permitting issues. It appears that if this south deck area were removed no CUP would be required for this project. If a deck or patio were desired by the owners in the future they could apply fora CUP and construction permit for that area at a later date. have copied the owners in this email as well as the contractor.
