Dear Mr. Kirscht,
This letter is a confirmation to the City of Eagan between three parties
to restore the boulevard between the south manhole aread of 4750 Nicols Road
(Kenneth Potts-owner) and 4770 Nicols Road (David Johnson-owner).
David Jahnson and Wenzel Mechanical have entered into agreement and con-
tract to excavate the bouelvard adjacent to Nicols Road for the purpose of
extending and hooking up the David Johnson property with sewer and water.
Wenzel Mechanical will include the dewatering compaction of their trenches
in the boulevard after they complete the installation both on the Ken Potts
property and the David Johnson property. Kenneth Potts already has an agree-
ment with the City of Eagan to restore his 6oulevard area by the spreading of
black dirt, seeding the 61ack dirt witfi grass seed, and watering tfie same.
David Johnson will (after the completion of work tiy Wenzel Mechanical) re-
store the boulevard area from the south manliole area of the Potts property
approximately 85-90 feet by the spreading of 61ack dirt, seeding the black
dirt with grass seed, and watering the same.
Your consideration in this matter in lieu of the escrow will be greatly
appreciated.

In my letter of January 5, 1982, I had indicated what the anticipated assessment will
be against the above-referenced parcel based on the proposed future special assess-
r.ent pmcess that the City anticipates to initiate in the very near future. The addi-
tional inforniation is provided to help clarify the assessaent situation as it pertain.s
to your existing implatted paroel as cmpared with the proposed final plat £or John-
son lst Addition.
On December 6, 1978, an applicatian £or a£inal plat was sutsnitted by David A. Johnson
and Robert T. Johnson £or the proposed Johnsan lst Addition cahich incorporatecl Parcels
040-06 and 030-06 respectively. On March 27, 1979, the Ac3visozy Planning Conmission
approved the preliminary plat. (hi April 3, 1979, the City Coimcil foxmally appmved
the preliminaxy plat subject to the oonditions placecl by the Planning Ccumission. On
September 4, 1979; the Cit,y Council fornally approved the final plat for Johnson lst
Adclition.
Based on the schedule as presented above, the City had assLUned that the Johnson lst
Addition was appropriately filed with Dakota County. Subsequently, in calculating
the assessments associated with Project 259, we took into oonsideration the Johnson
lst Addition plat rather than the inclividual implatted parcels. Subsequently, the
final assessaient as levied tmder Project 259 in Septennber of 1980 atrounted to $6,651.50.
Because the final piat for the Johnson lst Addition is not reoorded, this assessmmt
was levied against Parcel 040-06 under the aanership of_ Mr. Robert Johnson.Tb proceed
with the foxmal filing of this plat with Dakota Coimty long after the formal approval
has bzen granted by City Cotmcil acticn, it would *-eqare a concurrence by both af-
fected property owners (David A. Johnson and Robert T. Johnson) whereby both part;es
would execute an agreelnent waiving their rights to a hearing and authorize the spread
` of the existing assessment in the amoLmt of $6;651.50 over Lot 1 and Lot 2, Block 1
in a ratio as deterntined by both parties.
In order to detezmine a fai.r and equitable suggestion for splitting this existing
assesscient a[rong the newly created lots, the mthocl of front footage was used. The
total frontage of both Lot 1 and Lot 2 adjacent to either King's Road or Nicols Faoad
atroLmts to 579.27 feet. The pmposed Lot 2 of the Johnson lst Addition inwzporates
196.92 feet of this total fr_ontage. This results in 34% of the frontage being asso-
ciated with Lot 2(030-06). Subsequently, if the existing assessments were split
using this percentage ratio, Lot 2 would incur $2,261.15 and Lot 1 would be responsi-
ble for $4,390.35 for the relatecl benefit of street imQrovements associa`Le.-' with Pro-
ject 259 and/or D7nDOT Project SP-1925-13. This inforniation is in confozmance with

The initiation of Project 259 orovided for the installation of interior streets with-
in the Vienna Woods Addition and also the upgrading of King's Road on the east end
to the relocated Nicols Rnad (Old Cedar Avenue). This relocated portion of Old Cedar
Avenue is referred to as Frontage B under MnDCYP construction plans for Project SP 1925-
13 (T.H. 77 = 279). Consequently, street improvements initi.ateci at the north propFS-
ty line of Parcel 030-06, which is proposed to be platted into Lot 2, Block 1 of John-
son lst Addition and then oontinued south across the entire frontage of this parcel
and subsec{uently easterly onto King's Rnad. 'i"his oonstruction work was being per-
forr.ed under a cost participation agreement between the City of Eagan and the Minne-
sota Departrneiit of Transportation. Because this oonstruction was perfoxined by MnDCYC
forces imder a cost participation agreement with the City of Eagan, you were inadver-
tently omittecl from the public hearing and the final assessnent hearing for Project
259. Haaever, your property has benefited by the irrprovgrent of an upgraded residen-
tial street with bitisni.nous sur£acirig and mncrete curb and gutter. Because you tech-
nically weren't included under Pro ject 259 which provided £or the upgrading of King's
Road which was performed under a City contract, you wexe not included in that public
hearing i.nprovanent process.
Naw chat the State's contract is nearing aorTpletion, the City's financial responsibil-
ity pertaining tn the overall irpmvemnt of this State oontract recgzires that we now
assess the properties benePited under this agreement. Therefore, we will be initiating
a public hearing pmcess with subsequent final assessnent hearing which would provide
for approximately 135' of frontage of Parcel 030-06, which is currently under your
awmership, at a rate of $ 25.10 per foot which has been deterr.tiined to- be the resiclFn-
