FYI. See my email response to Mr. Beyer below. I also talked with him on the phone Monday (4/2) a.m. While he is not entirely
pleased with my response, I think that his issue is with the drain tile system. He mentioned on the phone that his sump pump only
runs periodically, while his neighbors' pumps run consistenUy with similar circumstances. This reinforces the notion that his system
may not be working properly. He will contact a service to N his drain tile, and let me know the results.

I am very sorry to hear that this drainage problem has again occurred, and all the turmoil and inconvenience it has caused for you
and your family.
I visited the pond this morning (4l2) with the City's Utilities Supervisor. We found that the outlet was slightly plugged, holding back
about 4" to 6" of water. He cleared the outlet pipe and verified that it is running free. Judging from your photos and the water line
observed this morning, the pond did not go beyond its easement boundaries.
I agree with your assessment of the impact of the water level of the pond on the groundwater. Ponds are where the majority of
surface water and ground water interact. I am puzzled that sustained higher pond water levels could generate more ground water
than could be handled by your house drain tile and sump system. A properly functioning system should handle the ground water in
this situation. While these systems are inspected by City Building Inspection personnel at time of house construction, there is a
chance that the system has broken or clogged, inhibiting its effectiveness. The pipe can be inspected via camera, by a"Roto-Rooter"
type service, from the sump basket inside your house, if you so wish.
Again, we are very sorry about the water damage to your home. Please contact me to further discuss the situation, and altematives
to find the source of the problems.

My son took some photos of the pond edges last eve about 6:15 pm and again today approx. 1030 am.
My son and I have flagged the perimeter of the high water mark today and we will photograph this as well.
My son and I were unable to join my wife and other chiidren on vacation for Spring Break because of the drainage problem in our
yard. We had steady seepage of water ail night (starting at 5:30 pm and until approx. 1 hour ago. Our sump pump continues to
operate. We had rented a second vacation property so my son could bring a friend. This unit will now go unused.
The pond has never been this high on a sustained basis even after the 6 inch mega-rainfall in October 2005, Even in May 2004 when
Eagan has approx. 10 inches of rain, there was never visibie water beyond the outer edges of pond growth. When we first moved
into the home, the pond rarely held visible water.
The level of standing water has been steadily increasing since we moved into the home and especially since the home in the cul de
sac behind our home has been completed, The pond is now more of a detention basin than a retention pond. The net effect is that
when a moderate rainfall event occurs (well below the design threshold you and Mr. Colbert have advised the system in our
neighborhood has), the pond fills and stays full thereby surcharging the groundwater feld and impacting the drainage of our yard and
home.
We believe the seepage is related to overfilling of the pond resuiting from inadequate design of the pond (too large a drainage field at
too shallow a depth or at the improper slope or inadequate designed drainage systems) or inadequate maintenance of the drainage
systems that have been described to us in the past by you & MR. Colbert.
With more rain expected on Tuesday 4/3, is it possible for the City of Eagan Public Works department to send a crew with a pump to
drain the retention pond near our home and discharge the excess water into the culvert drain at the edge of our property we share
with the Brown family7
Also, has the drain pipe that runs to the pond off of Kettle Creek and Stanwix been video inspected or flow tested to ensure that it is
in proper working condition?
May I please request your assistance in alieviating this growing problem? Thank you, Jon.
