Pat Monahan, Steve Hanson, Bill Bruestle, and Tom & Marianne Montgomery met to
view the condition of gypsum board on the ceiling where previous water damage had
occurred at the above address.
During the week prior to this meeting, attempts were made to arrange a meeting between
the Monahans, Montgomerys, and representatives from the City of Eagan. to view this
problem. As of Monday, July 23, 1990, I was informed that the Monahans and
Montgomerys could not agree on a time so I scheduled the meeting with Pat Monahan,
Bill Bruestle, and myself for 9:15 P.M. on July 25, 1990. At approximately 4:00 P.M. on
July 25, 1990, Marianne Moritgomery called Bill Bruestle and informed him they would
meet with us that evening. _
At approximately 9:15 P.M., Bill Bruestle and I arrived at the Monahans home at 698
Northbridge Court. The ceiling in question was visible from the foyer, and it was evident
from that vantage point that the ceiling was indeed damaged. The lights in the rooms
with the damaged ceilings were off, and the lights in the hallway leading to those rooms
were on, casting several large shadows across the damaged ceiling that showed the
imperfections in the ceiling. By using a flashlight, we shined light across the kitchen,
dinette, and family room ceilings and noted similar damage throughout these areas. The
damage was spread over an area of approximately 500-600 square feet. After viewing the
damage for about five minutes, Marianne and Tom Montgomery arrived. They viewed the
damage, but made no comment about it. At this point, Bill and I had made no comment
to Pat Monahan about our opinion of the ceiling.

Other problems that were viewed and discussed included:
1. The cracking of the grout in the ceramic tile floor in the dinette ,
2. The area of the basement where water still comes in during rainstorms
3. The crimped water service line
4. Settled areas in the driveway
5. Potential grading problems around the house
There was no discussion of possible so]utions to any of the problems. Marianne asked Pat
for a cunent list of problems.
As we left, Pat indicated he would be on vacation for a week. I asked if he would call,
me when he returned to inform me as to whether or not Montgomerys had agreed on a
course of action. At this point, Pat asked Bill and I if the quality of the ceiling was
typical. Bill and I both stated that it was not a good job. However from a Code
standpoint, we do not have any authority to require Montgomerys to repair the ceiling. _

The City of Eagan has met with Mr. and Mrs. Monahan and yourselves to review the
concerns the Monahans have with their new home. The items that are of the most
concern to the City of Eagan are as follows:
1. The dirt is less than 6 inches from the wood floor joists.
Section 2516(c)7. Wood and Earth Separation
"...wood used in construction of permanent structures and located nearer than six
inches to earth shall be treated wood or wood of natura] resistance to decay..:"
2. There is water seepage into the basement--the grading around the house and garage
is not correct.
Section 2905(f). Drainage
"Provisions shall be made for the control and drainage of surface water around
buildings:"
3. The steps on the front porch are constructed with a 9'/z-inch rise and 9-inch run.
Section 3306(c). Rise and Run
"Exceptions 1. Private staircvays...may be constructed with an 8-inch maximum rise
and 9-inch marimum run."

This meeting was held to review the homeowner's complaints
against Montgomery Design and Build. MaryAnne & Tom Montgomery,
Owners, indicated their concern about their Company name in
relation to the City's Building Inspections Department. At this
time, MaryAnne submitted paperwork to the City as follows: warranty
lists, one-year sign off sheet, initial walk-through signed by
Buyer, documentation throughout the process, Buyer's letter from
attorney, information on picketing, Valley Plumbing's response to
picketing, etc. It was agreed the best way to address the concerns
was to go through the homeowner's list of concerns item by item,
as follows:
One item of major concern to the homeowners was that
Montqomery Design & Build did not personally take care of any
concerns they had. MaryAnne Montgomery does not agree with this,
stating she has been very involved with this home and any repairs
that are necessary. There seems to be a personality conflict
between Tom Montgomery and the Buyer, but either she or Tom were
there to oversee what went on with this house.

1. Dav before closina - dry wall screw went thru metal nlate and
into vine, floodina basement. Montgomerys agree this did
happen--dry wall screw did cause leak when water was turned
on. Further information on flood problems will be addressed
in items 6& 7. Montgomerys state they had essentially four
leaks starting with the dry wall screw, Jacuzzi, toilet and
shower. They items were corrected by the plumbing contractor,
Valley Plumbing. Montgomerys were concerned as this was an
unusual number of leaks; however they were all independent and
random items. Regarding the leak from the dry wall screw, the
Chief Building Official responded that this can happen; the
problem with the Jacuzzi was traced back to a malfunction of
the tub from the manufacturer; plumber responded that the
joint on the shower behind wall was probably pulled on, or hit
by drywall contractor during construction, and did not leak
when water was turned on as it wasn't under pressure. Then
when shower was actually used, the pressure from the water
produced a leak. Montgomerys were concerned about quality
from plumbing contractor, however, after checking feel
confident Valley Plumbing is very capable and will continue
to use their services.
Regarding comment from Bob, Supervisor with Montgomery Home
& Design, stating to Bill Adams, Eagan Plumbing Inspector, "we
have done all we can do." Bob has advised Tom & MaryAnne he
told Bill Adams they had fixed all the problems to date and
would complete any valid warranty work that was necessary.
Montgomerys believe an adjustment of words can take on quite
a different meaning.
2. House not cleaned - Montgomerys agree it was not cleaned
properly and exchanged wallpapering services for this.
Homeowner wanted to do cleaning herself to get it done.
3. Ceramic floorina - Montgomerys agree grout did turn to powder
and flaked. They sought outside opinions as to the problem
and were advised there was a problem with the grout itself,
or the installation. They were advised to take out all the
grout. They asked the ceramic tile company to come back and
make the repairs, but did not get the response necessary so
at that point, had their Company employee, Jody, make the
necessary repairs. Montgomerys paid for the Buyers to stay at
the Residence Inn while this took place.
4. Air conditioner - Flare Heating tested the unit and could find
no problem mechanically. Aspen Electric then followed up and
spent 11 work hours trying to solve the problem for the Buyer.
The end result was that the condenser was replaced. To date,
Montgomery Design & Build has not heard any more if its not
working.
5. Doors - Montgomerys agree--it is possible weatherstripping
needs to be replaced as it sometimes does get beat up. Atrium
door - Montqomerys did replace this door, however felt it was
extreme and would not have normally done so. It was done in
this case as Montgomerys felt the Buyer had an unusual amount
of problems with their home and did it as a"good will"
gesture. Front door - Montgomerys state their supervisor says
it is well within industry standards. Door was adjusted and
will not get any better.
6. Jacuzzi - Previously discussed in item #1.
7. 2nd Floor Bath: Previously discussed in item #1.
8. Marble vanitv - Montgomerys have not heard of this problem
before. No comment - not on any walk through or warranty
list.
9. Kitchen faucet - It was replaced.
10. Lower level bath - Montgomerys agree that plumber did use a
mixture of brass and chrome fixtures as the brass fixtures
requested by the Buyer were on backorder. This was done so
the house could be closed and were exchanged once they came
in.
11. Window sill - Not uncommon to have a window sill that gets
damaged. Montgomerys do not recall what the damage was, but
state that it certainly is not uncommon for something to get
damaged during construction.
12. Garaae doors - Montgomerys agree there was a problem. They
do not believe the doors kept warping, but they had a problem
with the primer in that it didn't allow the paint to be
accepted. They order all their doors thru Automatic Garage
Door Company and have never had this problem before. The
problem was taken care of by Automatic Garage Door Company.
Many of the problems they experienced were caused as this home
was built in winter on a very tight time frame.
Drivewav - It did have a settlement in it, again perhaps due
to winter construction and frost heave. It was repaired.
Garaae door openers - It certainly is possible these were
programmed incorrectly, but the problem was taken care of.
13. Foundation - To the best of Montgomerys knowledge, there was
a foundation leak by the front door, near the closet. A
corner of the carpet in the closet got wet, was pulled back
and dried out. Gutters were furnished by Montgomery Homes,
as well as filling in under deck, etc. To the best of their
knowledge, there have been no future problems. Montqomerys
made a phone call to the Buyer after a rainstorm to see if
they had any further leaks. Their response was that they had
not, however called a while later and stated they had a
problem. After checking, it was found to be related to one
of the leaks previously discussed and not to the foundation
itself.
14. Nail noAS - Montgomerys state this is exaggerated. Their
drywall employee, Tim, advised them there were maybe 40 nail
pops which were repaired and the walls were repainted by Jody.
15. Plumbina - Insulating the pipes is not a standard practice
by Montgomery Home and Design. It certainly can be purchased,
but was not done so by the Buyer. Again at the expense of
Montgomery Home & Design, they did qo back in and attempt to
insulate the pipes to satisfy the Buyer. Jody's statement
regarding the noise was again heresay. It was certainly a
misunderstanding, or misleading statement.
16. Half bath - Buyer signed a purchase agreement for a home
similar to the model Montgomery Design & Build had for sale
at the time which contained a sink and vanity. The Buyer
changed the sink to a pedestal type, but did not indicate they
wanted the Iocation changed. It was installed in the same
area as the sink in the model. It is simply personal
preference; five people may choose to have their sink
centered, five people may choose to have it off to one side.
17. Family,room bar area - Again, the model did not have a bar.
This was a change requested by the Buyer. Montgomerys do not
know of any way to change the door with installation of a bar.
This is the first they have heard of this problem. Regarding
swivel for T.V. - Montgomerys did not do this as they could
not get the type the Buyer requested for the price allowed;
labor was once again exchanged for this item. Montgomerys
sealed their tile floor instead.
18. Vents - Flare Heating came out again this spring and re-
balanced the system. Sheet metal around duct could have
gotten bent if the vents are not carefully installed.
Sometimes they are walked on during construction, etc.
19. Outside wall outlets - Montgomery Design & Build states this
is normal and they did have someone spray around all the
outlets. These could be sealed tight at a cost of about
$2,000, but a heat/air exchanger would be required once the
home is sealed that tightly. This is available as an option.
20. WallpaAer - handled.
21. Counter tob - Montgomery repaired. Zf there is a continuing
problem, they don't know about it.
22. Supoort wall - Montgomery is not aware of ever using any
rotting lumber. Bob DaVanni, Supervisor for Montgomery Design
& Build, never heard of the problem, replaced a crowned studs
in the dining room. Crowning is a completely different issue
than rotting; they don't feel Shaw Lumber has ever sent them
rotted lumber.
23. Floor sweaks - Fixed.
24. Holes in concrete block - Montgomerys never did see, or smell,
any mice. This is theorized only. No holes were found in
block. t3ormally the way mice get in are when a homeowner
moves in, taking boxes from the garage, leaving the garage
doors open, and mice are carried in with boxes.
25. Brick - Again, home was built during wintertime and some of
the mortar did need to be replaced.
26. Ceilinas - in the kitchen ceiling, there were rusty sheetrock
screws caused by the water leak mentioned in Item #1.
Montqomerys spent approximately $800 to repair this problem.
All of the texture throughout the family room and hallway was
removed arid fixed this spring to give the Buyer the level of
satisfaction they desired. Generally, when sheetrock is wet
only for a short time, it does not stain. During
construction, subcontractors are advised not to do changes at
the Buyer's request; a Change Order must be agreed to by the
Builder and Buyer and signed by both parties. It is the
Builder's responsibility to schedule the painting of ceilinqs,
or any other construction-related item. Regarding the 9:00
P.M. inspection, MaryAnne states that the Buyer had requested
this time, which she agreed to, however cancelled as the Buyer
had started picketing and had hired an attorney. It was her
feeling that it was not appropriate to discuss this any
further at that time of night.
27. Water softener - hoses stuck into the drain, discharge.
28. Another flood - Montgomery Desiqn & Build provides the Buyer
with a handout at the time of closing, advising the Buyer how
to take care of their plumbing system. It is clearly
indicated on the handout that the hoses must be removed during
winter and faucets should be drained. This matter has been
turned over to their insurance company. Montgomerys do not
know the results of liability at this time.
MaryAnne states she was misquoted regarding the "lemon" issue.
The reason Tim could not face the Buyer was because the Buyer
verbally abused the construction people so badly that he
refused to go back. He informed MaryAnne that he would not
work there any more and she agreed with him that he did not
have to take that type of treatment from a Buyer.
Regarding fixing the flooding problems again stating that it
is a major job digging out dirt, fixing holes, and putting in
drain tile. Tom Montgomery states that this goes back to a
conversation that took place a year ago when water was coming
into the closet, that the fellow who was out making repairs
started talking about all the things that could happen and the
possible solutions that could exist. That's the only possible
source of that. Digging down would normally be a last resort,
if a number of other things don't work. Typically, there are
15-20 alternative solutions to dealing with water problems.
MaryAnne Montgomery states that she initiated a phone
, conversation with Pat Monahan to see if they had any leaks
after a rainstorm. He stated to her that he felt the drain
tile may have to be replaced. MaryAnne said she knew this was
a last resort, and also knew they were having little, if no,
water problems. Pat Monahan kept going back to the fact that
he felt they had a foundation problem. It was his statement
as to how he felt this should be taken care of. MaryAnne told
him she would take care of his problems, and would not walk
away from their responsibility.
Homeowner gave contractor several lists of items to be
corrected during the first six months and contractor has lost
all records. Montgomerys have the records and submitted some
copies to the City for review.
Regarding the inspection by Don Hedquist:
1. The house was rough graded only at the time of the building
final; the yard work was not complete at this time. When
Montgomerys filled in around the foundation to alleviate water
leaks, they may have filled the area a little high to allow
for settling. It is typical for a home to settle for five
years or more. That situation could exist now, but can be
adjusted. Most builders anticipate settling. This is
typical.
2. Again - rough grade only at final.
3. No front steps at final. Temporary steps were indicated on
the building permit inspection card at the final inspection.
The City of Eagan has asked Montgomerys to correct and they
have agreed.

The Chief Building Official stated the rest of the items are not
Code items. MaryAnne responded as follows: #4 has been done, this
is the ceiling in the kitchen which was redone and the Buyer does
not like it. They dropped a strinq line; there was no more than
1/4" of deflection from the bar wall in the family room to the
south wall of the kitchen. The rock was sound, texturing and
retaping was done. More details would be available from Bob
DaVanni if needed.
5. This is the first they heard of it and will fix if necessary.
6. This was the fault of Peoples Natural Gas Company. Electrical
disconnect was there first as Buyer was on propane when house
was finaled. This has been taken care of.

This meeting was held at the request of Pat & Julie Monahan
to review construction concerns at their home, 698 Northbridqe

One item of major concern to the homeowners was that
Montgomery Design & Build did not personally take care of any
concerns they had. They always sent a sub-contractor, or Company
employee, out to talk with them--no personal service. Homeowner
transferred in from Iowa; wife could not go out and look for work

The homeowners have comprised a list of 32-36 items that they

forwarded to this department for review. In order to limit the
time of this meeting, the homeowners gave an itemization of
concerns, as follows:
1. Day before closing - dry wall screw went thru metal plate arid
into pipe, flooding basement. A second and third flood
occurred the day they moved in. When basement flooded,
MaryAnn Montqomery informed owner they would send over fans
and heater right away, but never did. Two days went by,
carpet was still soaked. Carpet installer was in lower level
and pointed out that a leak was coming through their ceiling.
Toilet upstairs not sealed - leaked into basement and toilet
had to be replaced. Tom Montgomery asked homeowner to give
ceilings some time to dry out; homeowner agreed, but asked
Montgomerys if they would fix if necessary. They agreed. Two
or three days later, dripping stopped, ceiling did not ?

model on plan. Montgomery agreed to this, but pedestal sink
was not centered on wall; it was installed in the same place
as the wall unit, making it inconvenient to use.

closed in order to access this area. Swivel for TV and VCR
was to be built in, owner still has not received.

Painter stated to them that they had been advised not to paint
the Monahans ceilings. He said they paint all other ceilings,
but were told specifically not to paint theirs. He said they
would be back more often than they wanted because they could
not paint the ceiling.
27. Water softener - hose not put into drain so each time it
recycled, it shot water all over. Supervisor showed homeowner
how to use water softener and left the water running, not
realizing he had turned something and it flooded inft the
utility room.
28. 4/21/90 - another flood. Pipe leading to outside faucet burst
in wall. Montgomery claims it is owner's fault. Owner states
he has owned &-kr other homes and never had a problem. He
turned water faucet off in utility room in the fall of the

personal stuff, antiques, etc. Frost proof, freeze proof
system used so it should not have needed to be drained.
Sunday, 4/22/90 - MaTyAnn Montgomery called owner and stated,
"Pat, Tom and i feel very sorry about this, but I guess you

RE: COMPLAINT AGAINST GENERAL CONTRACTOR
MONTGOMERY DESIGN & BUILD
This meeting was held at the request of Pat & Julie Monahan
to review construction concerns at their home, 698 Northbridge
Court. Their home was completed in April of 1989; Montgomery
Design & Build was the general contractor.
One item of major concern to the homeowners was that
Montgomery Design & Build did not personally take care of any
concerns they had. They always sent a sub-contractor, or Company
employee, out to talk with them--no personal service. Homeowner
transferred in from Iowa; wife could not go out and look for work
for the first six months as it was necessary to be at home for
repairs, replacements, and completion of projects unfinished. Home
is approximately 3,200 sq. ft.
The homeowners have comprised a list of 32-36 items that they
had to replace and have given to their attorney. Doug Reid
requested that a copy be forwarded to this department for review.
In order to limit the time of this meeting, the homeowners gave an
itemization of concerns, as follows:
1. Day before closing - dry wall screw went thru metal plate and
into pipe, flooding basement. A second and third flood
occurred the day they moved in. When basement flooded,
Maryanne Montgomery informed owner they would send over fans
and heater right away, hut never did. Two days went by,
carpet was still soaked. Carpet installer was in lower level
and pointed out that a leak was coming through their ceiling.
Toilet upstairs not sealed - leaked into basement and toilet
had to be replaced. Tom Montgomery asked homeowner to give
ceilings some time to dry out; homeowner agreed, but asked
Montgomerys if they would fix if necessary. They agreed. Two
or three days later, dripping stopped, ceiling did not
discolor, but started warping. With light on in evening, it
casts 2' to 3' shadow. Bob, Supervisor with Montgomery,
stated to Bill Adams, Eagan Plumbing Inspector, "we have done
all we can do." Montgomery's have yet to see our problem
after repeated requests from us to see it for themselves.
2. House not cleaned - homeowner spent 6-7 hours cleaning before
being able to move in. Montgomery Design traded out Ann's
services to paper in return for the cleaning.
3. Ceramic floorina - grout turned to powder--could be scraped
out with fingernail; tiles broke. Montgomery Design & Build
attempted to repair by sending a construction worker, not a
tile installer, out to correct. Appeared that three different
colors of grout were used due to patching at different times.
Finally, came and scraped out 330' of grout, breaking several
tiles; could not use kitchen, as usual, for 3-4 days.
4. Air conditioner - whenever unit turns on, the lights flicker,
TV shuts off, and buzz can be heard in circuit box next to
family room, terrible smell in walls (like something burning),
and did not always cool. Neighbor witnessed this. A/C unit
was finally replaced approximately 11/89--has not been used
since so unsure if problem is solved. Supplier of air
conditioner stated to homeowners unit was not defective so
they don't feel problem is solved.
5. Doors - weatherstripping was replaced two times on lower
level. Atrium door glass scratched. Needed to be
replaced. Front door does not fit properly. There was a 1"
gap below door. Snow and rain coming in on floor. Montgomery
adjusted, now there is a gap on top of the door (steel door).
Came to fix again, and still is not flush.
6. Jacuzzi broke within one hour after moving in, causing
flooding.
Took 10-12 weeks to fix. Factory rep. (Swirlway) finally
called in to determine problem, then sent bill to owners to
pay. Result: Circuit breaker had to be replaced.
7. 2nd Floor Bath: Day of move in, when son took shower, water
came through ceiling; defective valve had to be replaced, or
pipes had to be resoldered.
8. Marble vanitv - warped.
9. Kitchen fauaet - gouged, had to be replaced. Kitchen sink had
a large warp in it and was replaced.
10. Lower level bath - Plumber used mixture of chrome and brass
fixtures, i.e. brass on shower, chrome on sink - had to be
changed.
11. Window sill had to be replaced.
12. Garaae doors - double doors replaced four times, single door
replaced three times; won't hold paint and keep warping.
(type: wood, stained, raised panel). Installer placed brace
on it the last time. Service door needs sealer (cement) - can
see light through. When repairing kitchen floor, contractor
damaged door knob leading from house to garage so that the
homeowner could not use door. Took one week to get contractor
back to fix. Portion of drivewav caved in as owner backed out
to tell Montgomery of these problems. Garaae door openers -
homeowner was to receive two transmitters for each door.
Waited three to four months for two of these. Guy,
Superintendent for Montgomery, brought transmitters,
programmed, gave them to the owner, incorrectly programmed all
four to open one door.
13. Foundation: Beginning June 1989, with each rainfall or when
homeowner waters lawn, lower level leaks. Carpet has to be
taken out and replaced each time (8). Finally needed new
carpet. Walk-in closet and utility room get wet. Homeowner
hired a private inspector, Don Hedquist, 5/15/90, referred to
them by their attorney. It is this inspector's opinion
grading is not properly done and walls could collapse at any
time. See attached Code violation sheet.
14. 100-200 nail nops. Tim, construction worker for Montgomery
Homes, hammered, refilled, never repainted or put paint only
on spot of nail pop, thus wall is different colored, looks
like checkerboard - sanded differently, left many dents.
15. Plumbina: pipes in bathroom not insulated. When flushing
toilet, pipes beat on wall; piping under tub area not
insulated--noisy. Montgomery Desiqn & Build cut holes in
guest bedroom closet and behind kitchen cabinets in an attempt
to fix. Jody could not believe noise they were making.
16. Half bath - homeowner requested pedestal sink instead of wall
model on plan. Montgomery agreed to this, but pedestal sink
was not centered on wall; it was installed in the same place
as the wall unit, making it inconvenient to use.
17. Familv room bar area unusable as builder did not properly
place door. Cannot open door fully as wet bar is in way, must
be closed in order to access this area. Swivel for TV and VCR
was to be built in, owner still has not received.
18. Vents - sheet metal is collapsing inside - 1/2 of rooms are
not receiving full heat or cool air.
19. Outside wall outlets - cold air blowing in. Montgomery
Design & Build corrected by spraying foam around outlets. Has
not resolved problem.
20. Wallbaper shrinking around countertops. Corrected by placing
quarter round edging around countertops.
21. Countertoo - snack bar, angle separated three times.
Montgomery Design & Build had countertop installer repair. It
is his belief counter itself needs bracing to prevent this
from recurring. Continues to separate (is bumpy).
22. Support wall - homeowner noticed two rotted 2x4's during
construction. When questioning Tom Montgomery, they were told
these were temporary only even though wiring was placed
through them. Homeowner has since discovered they were never
replaced.
23. Floor saueaks - master bedroom, fixed, but another squeak has
returned. Step squeaks, as well. Homeowner observed bridging
for floor was not connected when flooring was ripped up.
Contractor stated they were supposed to be connected and
proceeded to hammer the ones he could see, in.
24. Holes in concrete block - mice get in.
25. Brick - mortar needed replacing.
26. Ceilinas - did not receive coat of paint before texturing.
As a result, rusty sheetrock screws have popped thru all over.
Painter stated to them that they had been advised not to paint
the Monahans ceilinqs. He said they paint all other ceilings,
but were told specifically not to paint theirs. He said they
would be back more often than they wanted because they could
not paint the ceiling.
27. Water softener - hose not put into drain so each time it
recycled, it shot water all over. Supervisor showed homeowner
how to use water softener and left the water running, not
realizing he had turned something and it flooded in the
utility room.
28. 4/21/90 - another flood. Pipe leading to outside faucet burst
in wall. Montgomery claims it is owner's fault. Owner states
he has owned four other homes and never had a problem. He
turned water faucet off in utility room in the fall of the
year and opened the faucets to drain. Water was over foot
when walking in lower level that evening. At 10:30 p.m.
Montgomery's were not home, owner called worker (Jody Shaefer)
who called in Valley Plumbing. At 2:00 A.M. they knocked hole
in wall and found burst pipe. Damage -$5,200 + one of a kind
pool table and personal stuff, antiques, etc. Frost proof,
freeze proof, system used so it should not have needed to be
drained.
Sunday, 4/22/90 - Maryanne Montgomery called owner and stated,
"Pat, Tom and i feel very sorry about this, but I guess you
have a lemon".
Since inconvenienced for a possible 7-10 days, Monahans had
to leave their house to have major work done on replacement
of their bowed ceilings from prior floods. They moved to
Residence Inn for two nights, three days, (they were told to
move back in after 3 days) while a ceiling expert was brought
in. Tim, the ceiling expert, and Jody came over and Tim
stated, "Oh, this is going to take 7 days; I am definitely
going to have to take out all the sheetrock. I am going to
have to replace it; that's all there is to it, Jody". In the
end, all they did was scrape the texturing off, pound a few
screws into the sheetrock, and re-sprayed. When owner
questioned this, Tim stated, "I ran a line and this is plumb."
They left and returned the following Monday to fix nail
pops. Tim could not face owner, stated he did what he was
told. The Monahans have not landscaped their home due to the
fact that the Montgomerys still need to fix their flooding
problems. This is a major job in that they have to dig out
dirt down to the first blocks and tiles and drill holes and
maybe replace the drain tiles. Maryanne said this will be
taken care of, but when?
Homeowner gave contractor several lists of items to be
corrected during the first six months and contractor haj lost all
records.

Un RprSZ 21, 1930 I received a caZl at 11;00 pm, Jndy from
MorAtqomc>ry Design, he said the owners had a lot of wate: in
their basement. After arxiving rt the hom4, 7 started to check
various items over witki ,7ody and the hvmeowmer. We discovere8,
the rear lawn fatxceti was found to have frozen and spli't open.
This was a rtsult of the honteorvnex• not shutting o£f the stop
& taaste ealve in the ntQChBnical room ind draining botli the valve
and the lawn fducet. A note on this subject was baclt in December
when we replacecl the pqlished brass fa.ucets, our plur.eber 3'on
Gurnsev told the owners to disaonnect their gardan hosPs and

valbe. Whenever the valves are opened or closed, the packing nut

Dear Mr. and Mrs. Montgomery:
I have been retained by Pat and Julie Monahan to help resolve the
situation regazding their defective homestead.
I'm sure I do not need to itemize the problems they have had for
the past 12 months with the property, but I'll hit the hiqh
points anyway.
Flooding occurred in seven separate incidents, due to your
manufacturing defects, from the first day of closing to as
recently as one week ago. These were caused by improper sealing
of whirlpool and toilet, leaky pipes, and imptoper installation
of the water softener drain. In addition, the lower level closet
repeatedly flooded, every rainfall, due to improper installation
of dxain tile, ox possibly just insufficient grading of the
exterior wall.
Over 33 items were defective or impropezly located and had to be
replaced and/or relocated, including but not limited to: doors,
walls, windows, floors, carpeting, sinks, faucets, drains, tile,
mortar and grouting, electrical systems, the air conditioning
unit, and a portion of the driveway.
Mary Ann phrased it perfectly recently when she characterized the
house as a"lemon". It was a disaster from the beginning, and
the problems have not stopped appearing. It seems that my
clients keep giving your people lists, and the lists keep getting
lost before the work is completed. The current list of things
that still need repair is three handwritten pages long.
The Monahans have had to live with workmen coming through theiz
home continuously for the past year; or worse, promising to
appear and not showing up, even though the Monahan's had to make
arxangements to accommodate those promises. Mrs. Monahan has
been prevented from starting work and bringing in a separate
income, which she has always had heretofore, because of the
constant necessity to be at home for the workmen.

The Monahans have h3d tb bear an inordinate amount of
uncleanliness and have borne a large share of the cleanup
efforts, including the final cleanup prior to moving in, which
had not been done by your workers. They have had to deal with
recarpeting, reflooring, retiling, receilinging, restaining, and
numerous other messy refurbishings, all because the job was
inadequate to start with.
Numerous misrepresentations have been made to the Monahan's over
the past year including: statements involving the work that was
to be done on the house prior to completion, the work that was
actually completed, the repair work that was promised, and the
fact that you claimed to be "a H.O.W. builder" yet theze does not
appear to be any H.O.W. warranty covering the property.
Mr. and Mxs. Monahan have reached the end of their patience, and
want to resolve this situation immediately. They would prefer to
resolve this situation without litigation, but will not hesitate
to use the courts if other alternatives do not prove fruitful.
They have already contacted various media representatives about
covering their story. They think the Twin Cities residents would
be very interested in reading about "Money Pit II" as most of
their friends refer to the situation. They are planning to do
what they can to see that no other families are put through the
pain they have been subjected to. They have already told the
truth to one family that was ready to purchase one of your homes,
and it appears that family will now use another builder. They
will probably do what they can to spread the truth some more this
weekend at your two show houses in their neighborhood. I doubt
the "Spring New Home Preview" will prove very successful this
year, if people are informed about .the kinds of problems one of
your very fitst Montgomery Design and Build homes produced. My
clients do not intend to create any disturbance or to deviate
from the truth in any way. They simply wish to exercise their
lst Amendment right to free speech to prevent another family's
potential tragedy.
My clients' demands are simple and eminently fair. They want you
to take back the house, compensate them for the costs of
acquiring and moving to new property, and provide a modexate sum
for the lies, lost income, pain and suffezing that they have been
subjected to. They request payment of $215,000.00 for the value
of the home they thought they had purchased, $19,000.60 in
closing costs, $5,000.00 in moving costs, and $45,000.00 in
intangible losses. These sums total $275,000.00, and would be
due June 1, 1990. The Monahans will vacate the premises on oz
before June 1, 1999, should this proposition be accepted. The
mortgage currently against the pxoperty will be satisfied at

closing out of the proceeds of the aforementioned payment, so the
property would be yours , free and clear, to fix and resell or
level to the ground and start over on the lot, whichever you
thought best for your professional xeputation.
Please respond within the next week so that we may resolve these
matters amicably if at all possible. My clients are very anxious
to find a new home and will need as much time as you can give
them in order to be out by our suggested June 3, 1990, date.
Your advertising flyer contains the motto: "BUilding Dreams
Together." In the case of the Monahans, the dream built into a
nightmare. It is now time to make amends. ,
