aznount of $7,500.00 for the account of Karkela Construction as security for
landscaping for the Taple & Thomas project (Ll, B2, Lexington Second
Addition) in Eagan.
The City typically holds the financial security for two calendar yeazs following
installation of the landscaping. Upon inspection in 2007, we sent a letter to
Kazkela Construction noting several dead trees that required replacement. Those
trees were replaced in 2007. We reinspected the site last week, and found that all
of the replacement trees aze faring welt this year. Consequently, we are releasing
LeYter of Credit #21-003.

Dear Dr. Thomas:
City staff recently conducted landscape site inspections of the above property in
2007 and again last week. In 2007, the City sent a letter to Karkela Construction
noting several dead trees that required replacement. The trees were replaced in
2007, and upon reinspection last week, those trees were all found to be faring well
this year. For this reason, we are releasing the landscape security.
However, during last week's inspection, I did notice one new tree that appeazs to
be struggling, and it is located in the island east of the driveway entrance. Please
note that while we are releasing the security deposit, the property owner continues
to be responsible for maintenance of the landscaping, including replacement of
any plants that die or are removed due Yo disease, removal of litter and dead plant
materials,and necessary pruning.

I sent your proposol to substitute red maples in place of white oaks ta the City Forester. He indicated
the red maples would be an acceptable replacement tree. He also suggested Bi-color oak might be
easier to get esta6lished thnn white oak, it you are interest¢d in continuing to use an onk variety.
With regard to the perennials, the landscupe plan is not fully satisfied without those perennials,
however, the remnining landscaping continues to ochieve the purpose of the City's landscape ordinance
in terms of screening, aesthetics and investment relative to the building.

I don't blame them for wanting to change, white oaks are tough to get established. We've had better luck
with Bi-color oak. The red maple is a good substitution, however it will be a smaller tree. ThaYs probably ok
for their site; I assume the trees area going in the front of the building. The maples will look more in scale
with the building than the oaks.

at 1227 Northwood Parkway. They have twice installed white oaks that have died, so they are now
proposing to replace the dead White Oaks with Red Maples. They are requesting City approval for

Dear Mr. Swagger:
City staff recently conducted a landscape site inspection of the above property. The City
continues to hold a landscape deposit in the form of a letter of credit (LOC No. 21-003
issued by BNC National Bank) submitted with the building petmi£ in 2005- The landscape
guarantee cannot be released until the site landscaping has been satisfactorily completed.
The site appears to have been initially landscaped according to the approved plan. However,
the following is a list of items that need correction. These itexns are noted on the enclosed
landscape plan, and I have included photos of the site taken during the inspection.
• Some of the perennials have died, leaving landscape beds sparse. These areas
should be replanted to fill out the landscape beds.
• There are several dead or unhealthy trees on the proper[y. These trees need to be
replaced. The owner has indicated that many of these trees have already been
replaced once. If that is the case, we would be willing to coasider a differenY species
of tree that may have better survival rates in the growing conditions of this site.
Please consult with the landscaper for suggestions and if you propose to make any
substitutions, please let us lmow.
Please coaect these items by October 15. 2007. The Ciry will continue to hold the landscape
guarantee for one additional year following replacement of the dead plant materials. Upon
satisfactory reinspecfion, the financial guarantee may be released.

This credit is being issued for the Taple and Thomas Project in Eagan. The purpose of
this Letter of Credit is to act as a guaranty for a landscaping retainage required on a
proj ect for Taple & Thomas. In the event of the failure of the developer to satisfactorily
complete or maintain the landscaping retainage, the City of Eagan may draw against this
Letter of Credit to accomplish performance.
We agree that the Letter of Credit shall expire no sooner than October 1, 2007, unless
sooner released by the City of Eagan, but in the event that the terms of the above
referenced landscaping retainage aze not fulfilled, this Letter of Credit shall be
automatically extended at its expiration date and on an annual basis unless at least 60
days prior to the expiration date we haue notified the City Clerk by certified mail that we
elect not to extend this Letter of Credit. Upon receipt of the Notice, the City of Eagan
shall be entitled to draw at sight, by presenhnent of a draft or drafts prior to the date of
expiration hereof, up to the full aggregate amount as set forth herein, less any reductions.
