B2, BRITTANSC ADD. Dear Mr. Rol: Per your request, an inspection was performed on yoUr home on September 16, 1988. Following is information concerning the conditions viewed on that date: 1. A crack extends from the top of the concrete block foundation wall through eight courses of block to grade level at the rear corner of the garage. The remaining 8-9 courses of block, bel'ow grade, were not visible. The crack went through mortar joints and concrete block and was large enough to insert a pencil. There were small cracks in the adjacent concrete block walls, apparently caused by the same stress as the larger crack. The concrete slab in the garage had been cut open 8-10' away from the wall to expose reinforcing rods apparently used for reinforcing the wall experiencing stress. At that point, the reinforcing rods were not adequately covered by the concrete slab. The cause of the stress cannot be determined without further exposure of the wall, £ooting, reinforcing and soil condition. Serviaes of a structural engineer should be obtained to determine the best corrective measures and if there is any imminent danger of collapse. 2. Another crack in the foundation wall was observed in an area at the opposite end of the house. Again, without futther exposure of the block, footing and soil, we cannot speculate on the cauae of the stress. This crack was considerably less severe than the large one in the garage foundation. 3. It was determined by the City Electrical Inspector that the electrical outlet shown on your plan, but not installed, is not a code violation. The fact that it was on your plan is an issue between you and your builder. THE LONE OAK TREE...THE SYMBOL OF STRENGTH AND GROWfH IN OUR COMMUNIN 4. The position of the beam supporting the roof trusses over the deck appeared to be incorrect. While we did not have the opportunity to view the beam from the attic area, the position of the post supporting the beam would indicate that the beam was 4-5' away from the designed bearing point of the truss. We are assuming the trusses were designed with a 4-5' overhang; the letter from the truss manufacturer would support that assumption. The position of the new post you have installed would indicate that the new beam is now in the correct location. 5. The installation of the heat duct through the bearing end of the beam supporting the first floor joists was not good construction practice. `1`he repair of this also seemed inadequate. Since the span of the beam was approximately 3'6" and was not supporting an area that would be subject to unusually heavy loads, there appears to be little danger of structural collapse. Additional repair or complete replacement should be made. 6. The diagonal bracing for the roof trusses over a portion of the garage should be installed or an inspection by the truss manufacturer should be made to determine if bracing is necessary. AUTHORITY FOR REVIEW Section 11.40, Subd. 3, C., states: 1. If the Council shall deternune that the special conditions applying to the structures or land in question are peculiar to such property or immediately adjoining property and do not apply generally to other land or struchxres in the district in which said land is located, and that the granting of the application is necessary for the applicant. 2. That the granting of the proposed variance will not be contrary to the intent of ttus Chapter and the Comprehensive Guide Plan. 3. The granting of such variance will not merely serve as a convenience to the applicani, but is necessary to alleviate demonstrable hazdship or difficulty. City Code Section 11.20, Subdivision 6., A. requires a ten foot side-yazd setback for a dwelling unit and a five foot side-yazd setback for any pernutted accessory structure in single family residential districts. An enclosed structure used as Iiving space is considered part of the dwelling unit and must meet the required ten foot side-yard setback. The Brittany Addition was granted final plat approval on August 10, 1979. According to the applicant, the home located on the subject lot was originally designed to have an octagon shaped, three season porch attached to the dwelling unit. This was deleted from the approved plan, yet structural accommodations were made to add the three season porch later. In addition, the applicant stated that the dwelling unit and attached gazage were maved so that the garage was located ten feet from the east property line to provide access for building equipment. On September 21, 1994 a building permit was approved for an octagon shaped deck at the northwest corner of the property. At that time, the applicant was told he would need a variance to the side- yazd setback if the deck was to be covered/enclosed. EXISTING CONDITIONS Several lots in Block 2 of the Brittany Addition have severe grade changes from front to back. The subject lot drops approximately forty feet from the northwest corner of the dwelling unit to the pond at the rear of the property. The 2,308 square foot dwelling unit and attached gazage were built in 1985 and located ten feet from both side lot-lines. The octagon shaped deck attached to the northwest corner of the home extends to a point no less than seven feet from the west side lot-line. The deck, roof line, and northwest corner of the dwelling unit appear to be unfinished as they currently exist. EVAL ATION OF F.O TF T The applicant is proposing to enclose the deck to conform to the original design of the home. The proposed enclosure would not extend any farther than three feet within the required ten foot side-yazd setback and the intrusion into the setback area would be limited to 24 square feet. The applicant believes the hazdship is that the severe grade and a neighbor's retaining wall on the west side of the subject lot made it necessary to use the east side of the home for equipment access. This access required the house to be located five feet further to the west than originally planned. According to the applicant, the roof line and footings necessary to accommodate the enclosed deck were approved with the building permit. SUMMARY/CONCLUSION The applicant is requesting a three foot variance to the ten foot side-yard setback for Lot 7, Block 2, Brittany Addition to enclose an existing deck at the northwest corner of the dwelling unit. The severe grade associated with this lot made it necessary to shift the dwelling unit and attached gazage five feet to the west. The variance would result in a total encroachment of 24 squaze feet into the ten foot setback area and would allow the home to be completed according to its original plan. It does not seem like an issue to me, however,the inspector want me to inform you of the situation to make sure you were OK with this discovery.The footing appears to be good condition and the piers went in well. The oddity is that the footing extends approximately 19" from the wall. Since we are merely adding additional reinforcement to the footing, I don't see an issue, do you? Installation Observations: Upon arriving at the site,we moved the equipment to the drilling location without significant difficulty. The drilling location areas were sloped and narrow. We installed temporary supports and removed the existing concrete pier footings under the porch. The piers drilled without any issues. The deck piers drilled with no issues. We had to remove about 2ft of frost to install the first two foundation piers for the garage. The Load Capacities listed below are 1 the ultimate load which provides a safety factor of 2.
