Re: Construct an outlet to pond LP55 to maintain a level that will
eliminate the continual flooding of lots !}, 5 and 6, Block two,
Oak Chase Seccnd Addition.
Dear P;ayor Blomquist and Council Members:
We are requestinr the construction of an outlet from pond LF55 as pro-
posed on Eagan's Master Storm Sewer Plan. Since the construction and
development of Ches Mar 4th and 5th Additions in 1978 we have had con-
tinual flooding of our property.
Pond LP55 is approximately 200 feet west of the pond adjacent to our
property. This };ond was not recognized on Eagan's Master Ponding Plan
when Ches Nar was developed. We discussed with Nr. Rosene (at the June
1977 PlanninF Coirm:ission meeting on Ches Mar Develonment and several
times later) the rotential ;:roblems that could occur when storm run oYf
water is .ined into a shallow ,r.ond with no outlet. Irle were assured
there rould be no problems. Compounding the small holdinF capacity= of
the ponds was the lack of erosion control in the Ches Mar develonment -
as the hillside washed down, more fill was dumped in the washouts only
to washout again.
N,r. Colbert's October 1980 letter to Tollefson Builders and vabbert De-
veiopment Co. recognizes the flooding, the siltation and the altered per-
colation of the pond. Our letter to t'r;e Niayor and City Cour.cil dated
July 6, 1081 chronologizes our effort to get some relief from these
problems.
At our proddin the city has been monitoring tkie levels of both ponds
since April 1994. The ponds, as surveyed by the city, maintain approzi-
mately the same elevation. The cri-linal topographical map of the area
before develo;;m?-nt showed the elevation of LP55 at ,18.3.and the pond
adjacent to Oak Chase at 914.6 feet. Since the Ches Nar storm sewer run
off was piped into pond LP55, both ponds have risen, flooding wooded
areas. The pond floodinF our lots has baen pumped twice and both times
the pond continued to rise Aiter pumning stopped, even during a long dry
spell. Pond LP55 decrease;d durint- this time, hence, the conclusion water
from pond LP55 is seeping into the pond on/adjacent to our pronerty. The
cit y engineers agree the seepage between the txo ponds is preventing our
pond from receding.
The natural t^eeline on our property follows the elevation contour 918.
It is imperative that pond LP;S be iraintained at 918 or lower to protect
the trees on our property. The Master Storm Sewer Ylan sets the planned
outflow elevation of LP55 at 420, but didn't plan on the seepage between
ponds. Even at elevation 918 there will be times during heavy run off
that elevation 918 will be exceeded.
Since the floodin?: into the trees began, 60' trees from approximately 10
to 58 inches in circiunference have either tipped over or died or both on
lot 5 alone. Also, one tree that tipped over narrowlp missed a parked
car in front of the garage and another dead tree fe11 on the deck behind
the house. There are many more dead ones that will have to be taken down
to avoid falling on the houses on lots 5 and 6. 3'his is a serious ;r oblem
and must be corrected.
This past suxmner the water was up to the fill behind both houses on lots
5 and 6. Gn lots 5 and 6, 90 feet of the 180 foot deep lots were flooded.
Since the temporary ptunn was removed in September 1984 the pond has
flooded to within 20 feet of the fill again. This ]e aves us no backyard
and based on the last seven years, continual risincr, waters and more dead
trees. The pond will have to be Tiumped again this sprinF.
The storm sewer out£all on pond LP55 was as much as 20 inches under water
this summer be£:;re pumping. If that conditon remains into ti=inter the
storm se:aer wouid freeze shut causing some real ;roblams in the streets
it drains during s winter.rain or thaw and durin^ ihe s.^.ring thaw.
The problems mentioned above sY.ould never have occured with pS oper city
engineerin:° and supervision of the develoners. The initial storm sewer
engineering was inadequate in not recognizing the velumn of run off, the
seepage oetween ponds, and the holdin;_, capacities of the ponds. We have
been very patient the last seven years and feel it is time this ?:roblem
is co^rected. If the LP55 outlet is consiructed at elevation 918 or
lower this would help stabilize the ponds, allow us to use our backyards
again (a garden, plavhouse, etc.) and save the remaining trees. It is
very imvortant to us to stabilize the pond as soon as possible. We will
be waitin.- to hear of your plan to accomplish this.

In the period, between the preparation of the Feasibility Report
and Council's authorization of pumping the ponding area behind
Mr. Ney's house, which was causing him problems because of high
water, Council also authorized that Mr. Ney be reimbursed for
his electricity costs for pumping the pond down. Mr. Ney
submitted his electric bill during the period from May 14 to June
13 which incorporated the pumping of the pond. He also submitted
the previous month's and past month's electric bills for
comparison.
His three month average excluding the May-June bill was $52.00.
Subtracting that from his May-June bill leaves approximately
$60.00 as the cost for pumping the pond. Therefore, please
reimburse Mr. Ney his $60.00 for pumping of the pond behind his
house.
