Lot 1, Block 2, Oak Chase 3rd Addition is a property in the City of
Eagan. The property is divided into two parcels, the north 255 feet
is owned by the City of Eagan. That property primarily is comprised
of the Northern States Power Company Easement (highline) over that
property. The remainder of the property is privately owned. When
Eagan received Title to the property the Deed conveyed the property
to the City subject to various easements. The property deeded to the
southern owners also listed the highway and utility easement to the
City, and an instrument creating a valid non-exclusive easement for
driveway over and across some adjacent property.
The owners of the southern piece of property are asking that the City
consent to showing the easements in the official legal description of
their property on the Torrens Certificate.
We reviewed the matter. The City's rights and obliqations are
unaffected by any action of this matter. The consent being requested
from the City simply makes the Title marketable and is appropriate in
our opinion.
For reference I am enclosing a Consent prepared by the property
owners. We recommend that the mayor and clerk sign and return to our
office for forwarding.
If you have any questions I will be glad to discuss this matter in
detail. I assume you will place this matter on the consent agenda.

At your request, I have examined the title to the property above described,
using for the purpose of such examination a Registered.Property Abstract last
certified by the Dakota County Abstract Company as of July 5, 1977, at 8:00
o'clock a.m.
Based on such examination, I am of the opinion that as of that date record
title to the property was vested in TIMBERLAND ?EVELOPMENT CORPORATZON, a
Minnesota corporation, free and clear of all liens, charges and encumbrances
thereon, except as follows:
i. Real estate taxes for 1977 in the sum of $932.18 have been paid in
full.
2. Reatrictive covenants againat the property appear according to Doc.
No. 70284. They prwide that the land can be used for residential purposes
only and only residential building permits can be constructed on the property.
Other provisiona also appear to restrict the property for park purposes.
3. Easements affecting the property appear according to Book 62 M.R.
page 431 and Book 81 of M.R. page 587. They each run to Northern States
Power Company for transmission line purposes and generally cover the North-
erly 200 feet of the lot.
4. The Owner's Duplicate Certificate of Title No. 47344 should be de-
livered at the closing.
5. A Highway Easement dated September 18, 1975 and filed October ll,
1975 in favor of the City of Eagan as Doc. No. 79833 covers Wilderness Run
Road along the Northerly boundary of the lot.
6. A copy of a Warranty Deed filed April 26, 1977 as Doc. No. 88374
is attached to the abstract ind3cating an easement over the North 30 feet
of Lot 2, Block 1, in Oak Chase First Addition for ingress and egress to
Lot 1, Block 2, 3rd Addition, Oak Chase. A determination should be made as
to the effect and intent of the easement upon the subject property.
