Lokk2smoe: In your letter of June 11, 1981, regarding the level o£ the pond adjacent to my property, you indicated that I agreed to remove all fill below the Ordinary High Water level and that you had established the OHW level at elevation 886,6 for this pond, As I indicated on several occassions, I will certainly remove any fill below the OHW level. However, I totally disagree with your opinion on the level established for the Ordinary High Water mark. The stakes that have been placed at the 886.6' level are well above the tree line. You also indicated a 100year flood ele- vation would be 5 feet higher or 891.6 and an 8 foot bounce was planned. It is difficult for me to believe that the natural high water would be above the tree line, particularly being oak trees. I believe it was in 1975, when the amount of rainfall was extremely high. The level o£ the pond rose approximately 9 feet due to storm water run o£f. This was prior to the time the existing pump was installed and this pond being the last in a series; the water level was well up into the tree line. I did lose a signifi- cant quantity of trees, including oak, aspen, birch and cherry. Several of these trees were over 30 years old, so that indicates to me that the water level hadn't been that high for at least that length of time. As you recall, before the pump was installed and operating as a control for the storm water,.which is diverted into this pond, you and I met Mr. Robert Rosene, the Eagan engineering consultant, at the site to review the situation. At that time you were made aware of the fact that the west pond has historically been lower than the east pond, yet the OHW level you established would ap- pear to be indentical, because the 886.6' level appears to be above the crossover point in the culvert between the ponds. Therefore, I would appreciate it if you would review the levels you indicated for the Ordinary High Water level. I believe water con- servation should be practiced, but not at the expense of losing trees, which help_reduce energy use in the summer with the shade it provides and wind protection in the winter months. This is appmximately 2.8' belaw tle designa- ted NOHW and 1.3' belaa the elevation autharized by the DNR nPndt to maintain this pond elevatim. As best as can be detexmined, apparently this lawer elevation was set to allaa clean-up and restoration around the construction of the lift stati:on prior to allvaing the watex elevation to rise to its al].owed controlled elevation. Since we have discovered this error, it wauld be appropriate to readjust the shut-off cnntrol valves i.n this lift station to maintain the 885.1 elevation. Hawever, we will not make this adjustment until after July 30, 1981 so as not to create an un- due hardship on Mr. Martin in remwing his garden fran within the IX1R's NOHW. This will help in efficiently raroving the material that has been encroached within the drainage easement. After which time, we wi.ll re- establish our controlled elevations on this lift station to the proper elevation of 885.1. If you feel that this oontrol should be established itmiediately, without regard for tlie i.nipact on the *-eq+,;red removal of Roger Martin's garden, please inform me and we will iranediately re-set the wntrol to the prcper elevation.
