On October 2, you requested information pertaining to the future
assessment liabilities associated with splitting the northerly
portion of the above-referenced lot. Research of our files
indicate that all assessments associated with the public improve-
ments that have previously been installed have been assessed and
are of record. However, the trunk area sanitary sewer and trunk
area water were previously assessed on a"per lot" basis. As
such, any newly created lots would be responsible for their
related assessments. Therefore, as a condition of approving the
lot split and issuing a building permit, $535 would be required
for the trunk area water and $535 for the trunk area sanitary
sewer. Please be informed that these are the current rates for
1984 and are subject to change. In addition, the newly created
lot would be financially responsible for all costs and coordination
associated with the installation of sewer and water services for
the newly created lot as none were previously installed. With
these exceptions, there are no future anticipated special assess-
ments as all required public improvements necessary to service
this residential property have been installed.
For your information, the zoning of this property is classified as
"Estate" zoning. Subsequently, please be sure that the portion of

desires to divide his lot and sell the northern-most portion of
the same. My wife and I are interested in purchasing this lot
and, accordingly, are inquiring into its background. I stopped
by the City offices earlier this morning and was given your name
for further information regarding the assessments of the lot
mentioned above. I am wondering if the assessments for this
particular lot are on a unit basis or front foot basis and what
assessments would be due and owing, if any, to the portion of Lot
1, Block 2 that the current owner wishes to divide.
For your information, the footage running alonq Oak Chase Road is
approximately 200 feet; the footage running along Oak Chase Way
is approximately 180 feet. As previously stated, the portion of
Lot 1, Block 2 that we are interested in sits on the north corner
of Oak Chase Road and Oak Chase Way.

Dear Mr. Koestering:
Recently, you had expressed serious concerns regarding the
methods employed by the City of Eagan to clean up the
sedimentation deposited on the City street that resulted from the
construction of the single family residence on the above
referenced property. Although you acknowledge that the material
resulted from your construction operations, you felt that it did
not warrant the methods employed by the City of Eagan in cleaninq
up this material and withholding the performance of critical
final inspection subject to the repayment of the costs incurred
by the City.
I appreciated the opportunity to review the situation with you in
detail and provide some of the background that hopefully helps to
explain the actions that were taken by the City.
However, the purpose of this letter is to formally apologize to
you for the method that was employed by the City which did not
allow you an opportunity to correct the problem yourself prior to
the City contracturally performing this work and incurring costs
that became your responsibility. I agree that you should have
been given the opportunity to correct the problem once it had
been identified. In addition, I apologize for the confusion and
delays in receiving your final inspections required for occupancy
subject to the satisfaction of this outstanding bill. Again, you
were not provided the normal response period to settle this
financial obligation with the City prior to putting a hold on the
building permit process.
