County Drainage Problem
I am in receipt of your letter dated June 15th which was hand de-
livered on June 21st pertaining to your concern regarding the drain-
age of County right-of-way into Lots 11, 12 and 13, Block 1, Oak
Chase 4th Addition. I recall meeting with you on the site to re-
view the concerns that you stated in your letter. As I indicated
to you several times previously, this is a problem that must be re-
solved between you as a private property owner and the Dakota Coun-
ty Highway Department who performed the work that you have objected
to. The City has not performed any grading or storm sewer construc-
tion that has resulted in your concerns. As was indicated to you
previously and properly referenced in your letter, this work was
performed by the County without any participation by the City.
Therefore, if you expect any repair work to be done within 30 days
of June 15th, you will have to initiate that action with the Dakota
County Highway Department. The City of Eagan will not be initiating
any corrective work within that time frame.
We will be happy to work with the County Highway Department to re-
view their proposed options should we be requested to do so. How-
ever, I hope I have clearly stated that the City does not assume any
responsibility for performing any work that you have outlined in
your letter of June 15th.
I notice that you have copied Mr. Robert Sandeen, the Dakota County
Highway Engineer. Therefore, I will assume that you will pursue
this matter further with him directly.

Dear Property Owner:
On Aprii 12, 1993, it was brought to my attention that fill material was being piaced on Lot
13, Biock 1, Oak Chase 4th Addition. I stopped out to look at the situation and advised
the excavator that a permit had not been issued on the property and he, therefore, could
not continue.
Please be advised that in most cases an excavation permit is required when an
excavation or fill exceeds 10,000 square feet or 5 feet in depth. I have enclosed a copy
of Section 4.3 of the City Code and an Application for Fill Permit. Since the perrnit
process requires fairly extensive criteria to 6e met, it is typically preferable to have fill
brought in under a building permit at the time a home is constructed.

SUBJECT: Destruction of Lots 11, 12, 13 Oak Chase 4th Addition.
Concurrent with the development of Oak Chase 4th addition Timberland Development
Corp. granted a drainage and utility easement to the City of Eagan on Lot 13 of the 4th
addition. In the spring of 1981 the county, at someones direction but not mine, cut a
trench out of the easement across Lot 13, across Lot 12 and to the edge of a low spot on
Lot 11. (See attached drawing). I had conversation and meetings on site and otherwise
with representatives from the county and the city at the time this occurred and again in
the sping of 1982. I was advised by the county in the sping of 1981 that the properties
would be restored to their original condition. This did not occvr. Subsequent
conversations with the city ended with it being my responsibility to direct a letter stating
my desires. I am formally doing so with this letter. I do find it rather strange that I have
to take this action since I did not precepitate this situation and am the injured party. My
patience that either the city or the county would take action to correct their errors
without this letter has however, worn thin. It has also cost me the sale of these lots on
several occasions.
My basic desire, as stated when this occurred and in subsequent coversations with both the
city and the county, is that the described properties be restored to their original
condition. Specifically filling of the trench, replacement of black soil, sodding and the
cleanup of the areas adjacent to the trench where its contents were thrown.
Since i have had to go to this requested length to ostensibly get action, I expeci this to be
done within 30 days of the date of this letter.
I have a further concern which is related but which is a situation that needs addressing
and can be resolved separately. This situation goes back some years so please bear with
me and I'll attempt to give you the history. Before Cliff Road was upgraded to its present
condition and grade, water runoff from ihe road and surrounding areas ran down swales on
the north and south sides of the road.

At the time Cliff Road was upgraded to its present condition (1968 or 1969) the previous
owner of what is now Oak Chase generousiy gave the county a lot of material from his
property for the construction of Cliff Road. The county took advantage of that
generosity and also shunted swale water from the south side of Cliff Road into his
property on the north side. The owner did not agree to that nor were any papers signed or
easements granted. It also did not conform with any previous water meander or road
construction which could have been precidence for taking such action. The owner was
told that this was a temporary measure and that it was to prevent heavy erosion of the
bared ground on the south side of Cliff. If this were not done, ihe water would have to
travel from the crest of Cliff (at the Golf Course) all the way to the lake to the east. The
counties prediction on erosion was correct and it has just recently been eliminated with
the ground cover reaching growih to prevent erosion. The shunting was facilitated by a
sloping culvert under Cliff Road from its south side to the north side in the area which we
in 1978 dedicated to the city as a ponding easement. The easement is on Lot 13 Oak
Chase 4th addition. The culvert is now partially or possibly completely plugged with silt
from the south side of Cliff Road. It has plugged numerous times over the years. The
plugging begins at its outlet because of the amount of silt washing there and stopping.
The outlet is now all but completely covered as is the ponding easement we dedicated
with 4 to 6 feet of silt. The erosion on the south of Cliff has been heavy due to services
installations and housing development which has increased the water runoff in that area
but it is now under control and very little silt erodes. With the previous in mind, I contend
the following:
The county diverted ground water runoff in a manner which was not consistant with
topography or previous construction to achieve their desires with no concern for the
aftermath and possible damage to property. They also attained no legal right to run
ground water onto that property.
2. The counties need to shunt this water to the north as they said "temporarily" has been
satisfied and erosion no longer takes place south of Cliff Road in this area.
3. That it is only proper that the ponding easement we dedicated remain since it is the
logical place to accumulate ground water runoff from the north side of Cliff Road
and portions of Oak Chase 4th addition. We recognized this and in fact planned for it
when we built Oak Chase and constructed Oak Chase Road. We did not however,
dedicate it to collect runoff water from the sovth side of Cliff Road.
4. That the ponding ease ment dedicated to the city on Lot 13 will handle the runoff
from ihe north side of Cliff Road but it will not handle water shunted there from the
south. The easement is nearly filled with silt and water will soon begin to run out of
the easement onto the rest of the lot and possibly cross the lot and onto other lots.
There will also be no way to get the silT out of the easement without crossing private
property. This might be possible now with my permission but it would not be feasible
once a home is constructed on Lot 13.

5. That if the sloping culvert under Cliff Road is noT completely plugged that it be
plugged to prevent any more water from being diverted from the south side of Cliff
to the north side. It is also important that this be done soon. Lot I I is about to have
a home constructed on it, Lot 12 has been sold and Lot 13 is being negotiated on now.
I don't believe any of us want the jeopardy of a potential problem when the solution is
so relatively simple.
I am sorry to have to write this letter but it appears that this is the only avenue I have to
initiate some action. I believe I have stated all this before to both city and county
personnel. I hope that no further action on my part, excepting advise and consent, is
necessary to resolve these issues.
