CoMMENTS: The applicant's home was built in 1976. On May 3, 1977 the City Council approved a rezoning of the west one-half of the SE 1/4 of Section 27 from R-1 (Single Family) to E(Estate itesidential). This rezoning included the property presently owned by the applicants. When the house was built in 1976, it met all setback requirements of the R-1 zoning in place at that time. However, when the zoning caas changed to Estate in 1977, the home berame a legally existing tion-conforming structure because the inc.reased setback Tequirements of the Estate zoning district are not met by the existing structure. The required side yard setback in the Estate district is 301. The existing setback meets tfie R-1 requirement of 101. The applicant is requesting a 4' Variance which would leave a 6' setback between the house and the we:at property line.
