Regarding my letter of June 19, 1980 and our conversation last week concerning
the cleaning of the silt from the sump-pump, I discussed the matter with
Mr. Fasula and he did indicate your plumber was out to the premises, hauled
quite a bit of materi.al from the catch basin, dumping the silt on his lawn,
and activating the pump. However, Mr. Fasula advised me that this is at best
a temporary measure, and does not remedy the storm drainage problem.
The plumber who installed the drainage system admitted to Mr. Fasula that it
will not function during the Spring freezing and thawing, and further mentioned
the because the electrical system is underground, condensation will cause it to
malfunction.
It is also Mr. Fasula's observation that in a substantial 5pring runoff, or a
heavy rain, the capacity of the catch basin and holding tanks immediately
becomes over-taxed and the water then floods his yard.
Therefore, we are pretty much back to where we started in resolvi.ng the drainage
problem.
The only remedy that in our opinion wi.ll be permanent i.s to use the City's s.torm
drainage system onto Oakleafi Circle, or to request the Ci.ty to condemn adequate
right-of-way at the rear of the home adjacent to Mr. Fasula so that a storm
drainage system can 6e installed drai.ni.ng the water to the natural ponding area.

In discussing the matter witfi City officials, it appears that the storm
drainage system is at capacity, and the only available remedy is to drain
the water at the rear of the lot to the ponding area. '.
I, therefore, have asked Mr. Fasula to meet with the City of Eagan officials
and preparing the necessary petition to request the City to condemn sufficient
land for storm sewer easement and have a storm sewer installed.

To the extent that Mr. Fasula is assessed by the City, we would expect to be
reimbursed by your company.
If there is anything you can do to help to expedite the installation of this
permanent drainage system, it would be most appreciated.

This parcel has an alternate form of storm drainage which is a sump pump
and piping system which seems to be working per my observation, July 2$,
1980. No water was standing in the depression and we did have rain on
the previous Friday. The builder elected to try and save the oak trees
as per Qrdinance ¢6.02 A& B. This could not have been achieved if the
lot had been filled to provide gravity-flow drainage from the rear of
this lot. If you need additional information, please contact me.

Since my last letter to you concerning the water problem of the Fasulas,
August 14, 1979, my clients advised that you did install a catch basin,
holding tanks and sump pumps in their yard to al]eviate the storm drainage
problem.
That system has not worked and because of recent construction in the area,
if anything, their problem is more serious today than it was a year ago.
On June 10, 1980, I met the Fasulas at their home and a view of the premises
by a non-engineer 7ike myself indicated that the Fasula home is the "catch
basin" for all of the storm drainage in the area.
Their home is 6elow the level of Oakleaf Circle, it is below the level of
the homes on 2ither side of them, and is behind a sheer drop of approximately
25 feet of naked soil causing uninterrupted water to f}ow down the slope
along with the silt and dirt picked up from the uncovered area.
I don't understand how a reputable builder would build a home on this site
without adquate storm drainage.

It would seem to me that the home should have been placed at least four feet
higher than it is to give the water a chance to drain off the 7and into Oak]eaf
-z-
Circle, and eventua7ly out the storm drainage system of the City of Eagan, or
to reach the natural storm drainage ponding areas that were there prior to
development.
Not 6eing an expert, I advised my client to contact an engineeri.ng firm to
view the site and give us their professional opinion.
Mr. Fasula contacted Probe Engineering Company, and Ralph Wagner of that company
visited the site.
He is in the process of preparing a written opinion and suggestions for me, but
at an informal meeting with him Glednesday, June 19, 1980, he confirmed the
a6ove problems; he considers the sotution the responsibility of the builder,
and the only permanent solution available to Mr. Fasula is to build a storm
drainage system so that the storm water will drain from the Fasula lot through
an underground conduit di.rectly to the storm drainage system of the City of
Eagan. PRr. Wagner estimates this is approximately a 400 foot distance to be
covered underground.
The above is the only method acceptable to Mr. Fasula to permanently alleviate
a substantial part of the storm drainage problem.
The situation is also being aggravated by the unsodded slope referred to herein
directly behind Mr. Fasula's lot, the fact that Mr. Fasula's neighbor to the
west is digging a channel thru his backyard to drain his storm drainage water
into the yard of Mr. Fasula, the fiact that the neighbor to tfie east has elevated
his lot preventing the natural runoff of storm water to the ponding area to the
east and south of the Fasula home, and the collection af silt and sand at the
rear of h1r. Fasula's lot ruining thesod and making the backyard unusable.
P4r. Fasula has advised me that he has patiently awaited some solution to this
problem since the Spring of 1979, and he wants me to pursue this matter
persistently and actively until it is resolved.
I, therefore, am willing to meet with you and the officials of the City of Eagan
in an effort to resolve the situation; I also su9gest a meeting of the homeowners
in the area to accomplish the necessary draining and sodding, and exchange of
mutual easements to resolve the rear yard problems.
Copies of this letter are being directed to the neighbors involved and to the
City Officials.
In the meantime, we are going to pursue with the City the necessary petitions
required for the installation of the storm sevrer system.
