your letter to me of February 5, 1985.
After tom Schueter, the City Fores[er, and I met with you on September 10 to
inapect the demage, Tom ran a computation of damages (ueing the Minneaota
Shade Tree Evaluation Guide) to aee vhat the general range of coste would be.
Ae I recall, Tom'e initial estimate wae lees than the $6,220.00 you heve
claimed. For that reaeon, I em requeeting Tom to review your claim analyeis.
After I hear back from him, I will call you to diecusa any differences we may
have with your aeaesament.
Posaibly the difference between your claim and our initial aseesament of dam-
ages is the reault of diFferent tree counte. I am sending you a copy of my
memo of 9/10/84 vherein I documented my underatanding of the tree species and
size that died due to high water. The difference between wha[ your claim and
my memo appears to be an additional 10" Red Oak and an additional 8" cherry
tree. We ahould diecuea thie and come to an agreement on the exact number and
aize of [reee that were los[.
After Tom and I have a chance to diacuae your claim, I will call you ao that
we can diacuss any differences we may have and to decide how to pzoceed with
proceasing your claim.
There is an ieaue I wieh to clarify at thia time. My underetanding of your
le[ter is that you are making claim egains[ Bonestroo, Roaene, Anderlik 6 As-
sociates, Inc. for reimbursement for the treee you loet. Although I think it
is correct that you have addresaed your claim to my attention for proceseing,
I believe your claim ahould be againat the City. This is becauae the tree
loes wae the reeult of a City Public Worka improvement project. As such, your
claim is beat directed to the City and your claim would then be reaolved at
that level. If the City believea that othere are responaible for the coet of

Your let[er etates that the firm of Boneatroo, Roaene, Anderlik b Aeaociatea,
Inc. raiaed the water level of LP-33 as a reault of a deeign error on its
part. For your general understanding of the situation, there were four organ-
izatione involved in the planning and deeign of this project. They were the
Fawn Ridge Developer, his engineer, City etaff and BRA. The final conatruc-
tion plan details were prepared 6y BRA, However, the specific information
that led to the flooding of LP-33 waa provided by the Fawn Ridge Developer
through hie engineer, was reviewed and approved by City ataff and preaented to
BR.S for incorporation into tlie final yiana and epecificatiana. As such, we do
not believe that BRA ia primarily responsible for this problem.
We will very likely meet with City staff and posaibly Council to diacusa this
in greater detail. The Council hae requeated and hae been provided with in-
formation concerning reaponeibility for this problem. We intend to work with
the City to resolve this. If it ie found that we ahould bear a portion of the
reaponaibility for this problem, we will accept our fair ahare. My point ie
that responeibility has not been determined and we do not think we are to
blame, a[ lesat no[ aolely, for the problem. I do not want you to preaume BRA
ie at fault.
I think the facta and circumstancea relative to your eitua[ion are well docu-
mented and underatood and I therefore think that the next atepa will be to
recommend to the City thae they compeneate you for the damages you incurred as
soon as we can mutually agree upon the value. I think ve could probably have
a letter recommending this to the City early in March.
