Recently, you have expressed concerns regarding the controlled water elevation
established by the installation of the storm sewer outlet under the above-
reFerenced pro3ect for the pond located to the west of your property in Oak
Pond Hills 2nd Addition. You indicated that our storm sewer project lowered
the pond elevation by approximately 5'. In reviewing available information
regarding pond elevations, your contention is correct. However, this new
elevation is consistent with historical previous water elevations. The
following information is a historical record and documentation of all
available information pertaining to this pond's elevation:

6s you can see, historically this pond has been stable at approximately the
$79.0 elevation. In fact, this was the elevation when you and Mr. Forsberg
subdivided the property in 1978.
The artificial high elevation of 884-886 was a result of a historical wet
five-year cycle with no storm sewer outlet being provided to handle the
upstream runoff. The above-reFerenced pro3ect provided an outlet to return
the normal water elevation to its previous level'. Although the completed
construction controls the water at 878.15, it will be corrected in the next 2-
3 weeks to conform to the planned elevation of 879.0.
As I lndicated, we have done a research of our Comprehensive Storm Water
Management Plan to determine i£ this controlled water elevation could be
artificially raised up to its previous high water elevation of 886.1,. After
this analysis, if this controlled water elevation were raised by 4.0' to
883.0, it would result in an increase of 1.0' of the high water flood
elevation through this and two other subdrainage districts upstream. All of
this would have an impact on the ad3acent wetlands and woodlands.

As you are aware, this pond and the wetland to the north (LP-61) are loeated
within City park land. As such, any change in the controlled water elevation
and resultant high water flood elevation would require concurrence from the
Park Department.
Also, the City is in the process of preparing a Comprehensive Water Quality
Management Plan. As a part of the first phase of this Plan, we have
inventoried all 340 wetlands and lakes within the community and will now
proceed with the elassification of these wetlands into various categories.
Depending upon the elassification of Pond LP-34, any adjustment of the
controlled water elevation will have to be evaluated in regards to its impaet
on its proposed classifieation and intended use. For example, if it is
classified as a nutrient and sediment trap, it is hest to leave it at a lower
elevation to promote the growth of vegetation in lieu of artificially raising
the water elevation.
>>• Therefore, any adjustment to the existing controlled elevation (which complies
with the historical previous elevation) will have to wait until the completion
of the Water Qua2lty Management Plan and wi12 aZso require concurrenee from
the Park Department. Also, it would require coneurrence from all riparian
property owners adjacent to this wetland by way of written petition.
While recognizing your concern, I hope you can appreciate the reservations
that have to be exercised by the City before we artificially ad3ust the
controlled water elevation Por recreational purposes.

Dear Mr. Tumquist:
Your letter of March 12, 1999 to Ciry Administrator Hedges has been fonvarded to my attention for response.
In our telephone conversarion, I provided information to you that the Eagan City Code dces not include an
administrative or minor subdivision procedure for subdividing property, allowing creation of an additional
lot for residenrial development. Before contacting you by phone, I contacted the City Attomey's Office to
determine if there was any possible way to accomplish your request without requiring the preliminary/final
subdivision process. At this time, the City Code does not offer a shorter version for subdividing property.
Your only option would be to submit a request to the City Council to waive the required fees and escrow.
In order for the City to amend its City Code to provide for an administrative type subdivision, staff would
need direction from the City Council to amend the City Code. Then that particular code amendment would
need to be prioritized in relarion to other amendments already directed by the City Council, as well as other
planning-related work tasks currently being undertaken by Communiry Development staff.
I would like to again reiterate that neither City staff nor the Council can waive the requuements of the
subdivision procedure in the City Code; but you can certainly request a waiver or deviatron from the fee
schedule established by the City Council at the beginning of each calendar yeaz.

In response to your letter dated Apri18, 1999, I would like to clarify two points that you raised.
First of all, I believe that the 4-6 month timeframe that was mentioned in our meeting pertained to
the amount of time necessary to process a preliminary and final subdivision application rather than
the timeframe for changing the current policy and amending the City Code. The time involved to
amend the Code to provide for a minor subdivision procedure would likely take much longer.
As we discussed, the first step in the process to amend the Code would be to schedule the item for a
future Council work session. Assuming the majority of the Council was in support of providing
direction to staff to determine the feasibility of a minor subdivision procedure, it would be
necessary for the Council to prioritize this task, given the number of other projects requiring staff s
attention. At our meeting, we also discussed the nutnerous ordinance amendments that the Council
has already directed staff to prepaze to be brought forward through the public hearing process. In
addition, staff in the Community Developrnent Department still have to attend to the every day,
routine planning functions.
Secondly, regarding the potential for the City to waive a portion of the application and escrow costs
for a preliminary and final subdivision, you can make this request of the entire Council and, again,
the approval of such a request would require the majority of the Council.
I hope this clarifies the discussion that took place during our meeting on Apri16. According to City
Administrator Hedges, Senior Planner Ridley will be contacting you in the neaz future to see if you
are interested in proceeding with the application process.
