The 7ohnsons have constructed a deck and a portion thereof is located within a private pipeline easement owned by Williams Pipeline. You had previously provided to me a copy of staffs report, along with a copy of a written authorization from Williams Pipeline authorizing the location of the Johnsons' deck within the easement. You have asked for an opinion from this office as to the City's position regarding the continued location of the deck within the private pipeline easemenY. . This letter shall confirm our telephone discussion this morning during which I advised that so long as the Williams pipeline is NOT located within a public easement and it is within a private easement which runs through the Johnsons' property, the Ciry need not be concerned that the deck or a portion thereof is located within the easement. I advise you that it is a private matter dealing with a private easement. I further advise you that the City will not give an opinion as to the appropriateness of Williams Pipeline's written approval for purposes of the Johnsons' concerns. I apologize for the delay in getting a written response to you and I hope that this memo will answer any questions you may have had.
