Reliant Energy Minnegasco understands that Preusse 2nd Addition is unique with three high-pressure natural gas transmission lines and ownership of these lines by two companies. However, the existence of other transmission lines only compounds the need for a safe maintenance area for all crews who must work on these high pressure natural gas pipelines in the future. Responding to your request, Reliant Energy Minnegasco submits the following: 1. In compliance with Minnesota Statute Section 300.045 Reliant Energy Minnegasco first attempted to reduce the existing blanket easement over the now recently platted Preusse 2nd Addition when the strip easement was mailed to James G. Vander Linden, LeVander, Zotaley & Vander Linden on September 24', 1998 and again on January 5', 1999 for execution together with a copy of the release of easement for the existing blanket easement, The third attempt to reduce the existing 1932 blanket easement with a new transmission line easement was mailed to Kathy Kimmel on November 30, 1999. The fourth attempt to reduce the blanket easement was mailed to your office on February 21, 2000. It has been Reliant Energy Minnegasco policy since the purchase of a large portion of gas transmission lines from Northern Natural Gas Company 20 years ago to reduce blanket easements to the minimum width necessary for the safety of field crews and customers. With a transmission line of this size and pressure, 100 feet has been the minimum width established. Other developers along this pipeline have designed their plats understanding the need to keep enclosed structures as far as possible from the transmission line. This pipeline operates at a pressure of 400 pounds per square inch and is critical to supplying natural gas to the southern portion of inetropolitan Minneapolis. Gary G. Fuchs June 8, 2000 Page 2 However, your point is noted that the same transmission line has an easement width of 66.00 feet crossing the Reliant Energy Minnegasco property to the east. Therefore, in an attempt to resolve this issue, Reliant Energy Minnegasco will accept a 66.00 feet easement, the minimum necessary to provide a safe distance for customers and company personnel. Enclosed, please find two copies of the Transmission Line Easement over your clienYs property in Eagan. The easement descrihes a 66-foot easement centered on the high pressure natural gas transmission line. The legal description of the easement has been revised since last sent to you on February 21, 2000 and now describes the new plat of Lot 1 and Lot 2, Block 1, Preusse 2nd Addition. Please arrange for one copy of the easement to be executed by Mr. and Mrs. Preusse, and properly notarized. Upon receipt of the easement it will be executed by a Vice President of Reliant Energy Minnegasco, together with the Release of Easement (copy enciosed for reference) to release the easement that now exists over the property. I will then record both documents with the Dakota County Recorder with the new easement filed immediately subsequent to the release. Most importantly, this blanket easement issue must be resolved and redefined with the proposed easement enc%sed, prior to any building on the property. Any deve%pment efforts for this property must be approved by Reliant Energy Minnegasco and Northern Natural Gas Company to insure the safety of the public who wil/ be using the property in the future. 2. I enclose the original copy of the Quit Claim Deed I sent to you for execution by the Preusse's to convey the exchange of properties as agreed to last year. You made changes to the document which are ambiguous and do not explicitly define the area to be conveyed to Reliant Energy Minnegasco. Discussions with the Dakota County recorder confirm. Not wishing to delay your platting process of Preusse 2nd Addition, Reliant Energy Minnegasco agreed to give your clients the QCD necessary to record the plat. I recall you were quite pleased when I decided to dispense with the formality of providing a document to you without a correct document to Reliant Energy Minnegasco. It now seems appropriate to resolve this 2-year-old issue and provide Reliant Energy Minnegasco with the correct legal description of the QCD originally submitted for the property to be conveyed to Reliant Energy Minnegasco, as you agreed to in February, 2000. 3.
