The attached document is a letter written to Mike Ridley that addresses your questions to Mike Kuehn yesterday regarding project
schedule and reason for the request. We understand that we have to go through the formal process of approval for the shared
access drive variance however, delaying the entire project start date for a month while that variance request is in the approval
process will push exterior building finishes (masonry & EIFS) and the paving into late fall. Doing this work during that time frame is
not conducive to efficient productivity or quality workmanship, so we request that a grading and foundation permit be issued this
week to allow work to begin.
There are two reasons for the shared access variance.
• First, it allows the property owner to maximize the total available building area on both properties.
o This maximizes the rentable area and rental income for the property Owner.
o This will also maximize the potential tax base
• Second, it reduces the required ingress/egress traffic points on the street.

I just got off the phone with Steve Stecker and Mike Kuehn regarding the Building Permit (and Variance) for this new Greg Preusse
building on Old Sibley Memorial. I agreed to allow them to move forward (with proper permits) with grading, utility and footing &
foundation work for this project before the Variance is heard by the CC.
They have agreed to submit a letter to me acknowledging that they are proceeding at their own risk and, further, they stated they are
prepared to realign the entrance should the Variance request be unsuccessful.
Please continue your reviews and work on this and we will work on the Variance in parallel.

The acquisition of the foregoing permanent easement for drainage and utility purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at ail
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains; and
the fiuther right to remove trees, brush, undergrowth and other obstructions.
The acquisition of the foregoing temporary easement for construction purposes includes the
right of the City, its contractors, agents and servants to enter upon the premises at all reasonable times
to construct, reconstruct and inspect site grading and the further right to remove trees, brush,
undergrowth and other obstructions.
The right of the ingress and egress acquired by the City shall be limited to the route of the
easement over and across the above described land and adjacent lands of the Landowner for all
purposes incident to said easement.
Landowner reserves unto itself, its affiliates, parents, subsidiaries, successors and assigns the
right to use said easement and right of way in any manner as long as such use does not unreasonably
interfere with the rights of the City hereunder, including, but not lirnited to, the right to construct,
operate and maintain in, over, or across the aforedescribed easement and right of way, a pazking lot
consisting of a concrete, tar, or other slab of material, which such use(s) shali not constitute an
interference with said rights of the City.
The City agrees that following construction of, repaii, maintenance, replacement or removal
of said utility easement, it will restore the Landowner's property to at least the condition found prior
to such construction, repair, replacement or removal of the utilities, save only for the necessary
removal of trees, brush, undergrowth and other obstructions.
The easement taken by the City no further encumbers or otherwise 1'units the Landowner's use
of the land other than what the Landowner already is prohibited from doing under the eatisring
easements and by law.
And notice is hereby given that the above-captioned condemnation proceeding has been
compieted; that payment for ihe taking of lands above described has been made and that the Final
Certificate was executed and approved on the dates shown and endarsed herein.

As you recall, when Meritor Development Corporation platted our
Lexington Square 3rd Addition, we were requested by the City to
designate Outlot A at the deadend of Danbury Trail.
With the advent of Brad Swenson platting the Danbury Place
Subdivision which is within our Lexington Square project, it is
my understanding that Brad will be adding this Outlot A into his
plat. This outlot A has been graded and has electric and
utility service to it at this time.
At present the bui2ding inspection department will not issue a
building permit on an Outlot or a particular lot which has not
been final platted. One of our builders has a buyer for this
lot and consequently, would like to start construction on this
Outlot A before Danbury Place might get approved. I am,
therefore, wondering if it would be possible for the City to
issue a building permit for our builder on this Outlot A so that
he can start construction on this house and withhold any
occupancy permit until the final plat for Danbury Place has been
approved.
I would appreciate it if you would look into this and determine
if this request will be granted.

Dear Mr. Hedges:
In accordance with the Joint Powers Agreement which created the
Gun Club Lake WMO, each community is to designate their
appropriate number of representatives which formulate the Board
of Managers for the WMO. The City of Eagan is allocated three
representatives with one alternate to this Board of Managers.
The original appointees of the City of Eagan were Tom Colbert,
Scott Merkley and Wes Lane, with Dianne Warner Hood appointed as
the alternate by Council action on September 2, 1986. On October •
6, 1986, Eagan representative Wes Lane resigned from his_
position. It is the assumption of the WMO that'Dianne Warner
Hood then became the permanent replacement for the created
a vacancy of Eagan's full representation.
The WMO presently meets at 4:30 p.m. on the first Monday of each
month and is currently involved in preparation of the required
Watershed Management Plan. At the May 5, 1986, WMO meeting, a
policy was adopted by the WMO Board to inform any member
community whenever one of their desiqnated representatives missed
three.consecutive WMO meetings. This was to help protect each
community's interest in their respective representation on this
Board.
Ms. Dianne Warner Hood has not been able to attend the last three
WMO meetings (January 5, February 2 and March 2). Since her
appointment as an alternate and subsequent designation as a full
representative in October of 1986, she has only been able to
attend two of the last six meetings. Without a new alternate
being designated (subsequent to Mr. Lane's resignation), the City
of Eagan has not been fully represented during the management
plan preparation process of the WMO meetings.
