WHEREAS, Appellants and Respondent have resolved the disputes over the assessments
levied against the Subject Properties.
NOW, THEREFORE, in consideration of the mutual covenants and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the
parties, the parties do hereby agree as follows:
1. STIPULATION OF SETTLEMENT/DISMISSAL. AppC113ntS and Respondent
stipulate that the above-entitled matter has been fully comproniised and
settled and therefore it is agreed that the above-entitled matter be
dismissed with prejudice and without costs to either party, and the Court
Administrator is hereby authorized and directed to dismiss this action with
prejudice and without costs of record.
2. R$nSSESSMENT. The assessments for the subject property aze hereby
reassessed as follows:

Dear Mr. Preusse:
Earlier this year, the City's Protective Inspections Division was notified that some major
remodeling work had been done at 4141 Old Sibley Memorial Highway. As a result, I met with
you at the site and discussed the need for permits and inspections. You assured me you would
submit plans and comply with the City's request.
As of March 31, 2000, no action was taken on your part to resolve this issue so the City sent you
a letter (copy enclosed) requesting that you submit two sets of detarled plans and apply for the
necessary permits. In this letter, you were advised that you would need to o6tain an electrical
permit as we1L If you have not already applied for this permit, you may want to contact Mazk
Anderson, State Electrical Inspector, at 952-445-2840, to discuss this matter.
You then brought in an undated building permit application and two sets of plans for review. On
June 16, 2000, I called and informed you that you must submit a SAC determination letter from
Metropolitan Council Environmental Services. I have spoken with your secretary and left voice
mail messages for you numerous times since then in an attempt to resolve this issue with you.
To date, you have not complied.
As you appear unwilling to abide by the requirements of the Uniform $uilding Code, the
City of Eagan is giving you 10 days from the date of this letter to obtain the necessary
permits from the City. Your fee for these permits will he doubled due to your failure to
cooperate with the City. If you do not comply with this request, your file will be forwarded
to the City's Attorney for action.

building, changing it from a single family dwelling to a business without the necessary pernuts.
I discussed this with you, both on the telephone and in person, and you assured me that you
would submit plans for the work done and obtain permits. To date, this has not happened.
We are asking that you submit two sets of detailed plans for this remodeling work and apply for
the following permits: 1) building 2) plumbing 3) heating, and 4) electrical. Failure to do so
? may result in a hold being placed on all future work in Preusse 2nd Addition and/or the City

104.2.8 Altervate materials, alternate daign and methods o(
construction. The provisions of this code are not intended to pro-
vent thz use of any material, altemate design or method of
construction not specifically prescribed 6y this code, provided
any alternaee has been approved and its use authorized by the
building official.
The building nfflcial mav approve any such alrernam, provided
the building official tinds that the proposed design is satisfactory
and complies with the provisiuns of lhis codz and that the material,
method or work offered is, for the purpose intended, at least the
equivalent of that prcscribzd in this cade in suitability, strength,
effectiveness, fire resistance, durability, safety and sanitation.

104.3.10 Cooperotion of other ofticials and officers. The
building ufficial may request, and shall receive, the assistance and
coopcmtian of othrr officiafs of this jurisdiction so far as is re-
quired in the discharge of tht duties required by Ihis code or other
peninent law or ordinance.
SECTION 105 - BOAHD OF APPEALS
105.1 GeneraL In orda ro hear and decide appeals of orders, de-
cisions or determinations made by thz building official relative to
the application and inrerpmcation of this code, there shall be and is
hereby aeated a board of appeals consisting of inembers w6o aze
qualified by experience and training ro pass on matters pertainiag
to building construction and who are not employees of the juris-
diction. The building official shall be an ex officio member of and
shall aM as secretary to said boazd buc shall have no vote ou any
matter bafore the board. The board of appeals shall be appointed
by the governing body and shall hold office at ia pteasure. The
board shall adopt rules of procedure for conducting its business,
and shall render all decisions and findings in writing to the appel-
lant with a duplicate copy to Ihe building official.
105? Limitations of Authority. The board of appeals shall
have no authority relative to intecpretation of the administrative
provisions of this code nor shall the board be empowered to waive
requirements of this code.
SECTION 106 - PERMITS
106.1 Permits Required. Except as specified in Section 106.2,
no building or structure regulated by this code shall be erected,
constructed, entarged, altered, repaired, moved, improved, ra-
moved, converted or demolished unless a separate permit for each
building or structure has Frst been obtained from the building offi-
cial.

106.2 Work Exempt trom Permit A building permit shall not
be required for the following:
1. One-story detached accessory buildings used as tool and
storage shzds, playhouses, and similar uses, provided the floor ?l
area does not exaed 120 squarc fat (11. IS m'-). `
2 Fences not over 6 feet (1829 mm) high.
3. Oil derricks.
. J. Movable cases, counters and partitions not over 5 feet
9 inches (1753 mm) high.
5. Retaining walls that are not over 4 feet (1219 mm) in height
measured from the bottom of the footing ro the top of the wall, un-
less suppurting a surcharge or impounding Class 1.1I or Ifl-A liq-

6. Water tanks supponed dircctly upon grade if ihe capacity

building ufficial shall issue a permit Iherefor to the applicant.
When the building official issues the permit where plans are re-
yuircd, the building official shall endorse in writing ur stamp the
plans and specifications APPROVED. Such approved plans and
specifications shail not be changed, modified or altered without
authorizations from the building official, and atl work regula[ed
by this code shall be done in accordance with the approved plans.
'Che building official may issue a permit for the construction of
part oF a building or structure before the entire plans and specifica-
tions for the whole building or sttucture have been submitted or
approved, provided adequate information and detailed stacements
have been filed complying with all pertinent requirements of this
code. The holder of a partial permit shall proceed without assur-
ance that the pertnit for the entire building or structure will be
granted.
106.4.2 Retention of plans. One set of approved plans, specifi-
cations and computations shall be retained by the btilding official
for a period of not less than 90 days from date of completion of the
work covered therein; and one set of approved plans and specifica-
[ions shall be retumed to the applicant, and said set shall be kept on
the site of the building or work at all times during which the work
authorized thereby is in progress.
106.4.3 Validity of permit The issuance or granling of a permit
or approval of plans, speci£cations and computations shall not be
construed to be a permit for, or an approval of, any violation of any
of the provisions of this code or of any other ordinance of the juris-
dictioa Permits pasuming to give authority to violare or cancel
the provisions of this code or other ordinances of the jurisdiction
shall not 6e valid.
The issuance of a permit based on plans, specifications and oth-
er data shall not prevent the building official from thereafter re-
quiring the cortection of eerors in said plans, speci5ca[ions and
other data, or from preventing bvilding operations being carsied
on thereunder when in violation of this code or of any olher ordi-
nances of this jurisdiction.
106.4.4 Expiration. Every pertnit issued by the building official
under the provisions of this code shall expire by limitation and be-
wme null and void if the building or work authorized by such per-
mit is not commenced within 180 days from the date of such
permit, or if the building or work authorized by such perroit is sus-
pended or abandoned at any time after the work is commenced for
a period of 180 days. Before such work can be recommenced, a
new permit shall be first obtained to do so, and the fee therofor
shall be one half the amount required for a new pamit for such
work, provided no changes have been made or will be made in the
original plans and speci6cations for such work, and provided fur-
ther that such suspension or abandonment has not exceeded one
year. In order to renew action on a permit after expiration, the per-
mitree shall pay a new full pertnit fee.
Any permittee holding an unexpired pertnit may apply for an
extension of the time within which work may cammence under
that permi[ when the pertnittee is unable ro commence work with-
in the time required by this section for good and satisfactory rea-
sons. The building official may extend the time for action by the
permittee for a period not exceeding 180 days on written request
by the permittee showing that circumstances beyond the control of
the permittee have prevented action from being taken. No peanit

106.4.5 Suspension or revocation. The building official may,
in writing, suspend or revoke a pertnit issued under the provisions
of this code whenever the permit is issued in error or on the basis of

regulation or any of the provisions of [his code. SECTION 107 - FEES
(07.1 General. Fees shall be assessed in accordance with the
provisions of this section or shall6e as set forth in the fee schedule
udopted by the jurisdiction.
107.2 Permit Fees. The fee for each permit shall be as set forth
in Table 1-A.
The determination of value or valuation under any of the provi-
sions of this code shall be made by the building official. The value
to be used in computing the building permit and building plan re-
view fees shall be the rotal value of all constmction work for which
the permit is issued, as well as all finish work, pain[ing, roofing,
elec[rical, plumbing, heating, air conditioning, elevators, fire-
extinguishing systems and any other pertnanent equipment.
1073 Plan Review Fees. When submittal documenu are re-
quired by Section 106.3.2, a plan review fee shall be paid at the
time of submitting the submittal documents for plan review. Said
plan review fee shall be 65 percen[ of the building permit fee as
shown in Table 1-A.
The plaa review fees specified in this section are sepazate fees
from the pertnit fees specified in Section 107.2 and are in addition
to the pecmit fees.
When submittal documents aze incomplete or changed so as to
require additional plan review or when the project involves de-
ferzed submittal items as de£ned in Section 106.3.4.2, an addi-
tional plan review fee shall be charged at the rate shown in Table
1-A.
107A Expiration of Plan Review. Applications for which no
permit is issued within 180 days following the date of application
shall expire by limitation, and plans and other data submitted for
review may thereaftet be retumed to the applicant or destroyed by
the building official. The building official may extend the time for
action by the applicant for a period not exceeding 180 days on te-
quest by the applicant showing that circumstances beyond the
control of the applicant have preven[ed action from being taken.
No application shall be extended more than once. In order to re-
new action on an application after expiration, the applicant shall
resubmit plans and pay a new plan review fee.
1075 Investigation Fees: Work withoat a Permit.
107.51 Iovestigation. Whenever any work for which a pennit
is required by Ihis code has been commenced without first obtain-
ing said permit, a special investiga[ion shall be made before a per-
mit may be issued for such work. .
107.5.2 Fee. An investigation fee, in addition ro the permit fee,
shall be collected whether or not a permit is then or subsequently
issued. The investigation fee shall be equal to the amoun[ of the
permit fee required by [his code. The minimum investigation fee
shall be the same as the minimum fee set forth in Table 1-A.'ILe
payment of such investigation fee shall not exempt any person
from compliance with all other provisions of this code nor ftom
any penalty prescribed by law.
107.6 Fee Refunds. The building official may aulhorize refund-
ing of any fee paid hereunder which was enoneously paid or
collected.
The building official may authorize refunding of not more than
80 percent of the permit fee paid when no work has been done un-
der a permi[ issued in accordance with this code.

4141 E. Highway 13. An investigation of this property revealed that
a large portion of this structure is not located on your property
according to the attached Certificate of Survey completed by Probe
Engineering Company on September 21, 1993.
City records indicate this building was placed on the property
without a building permit and was constructed in violation of the
Eagan City Code. Therefore, this building must be removed. The
owner of the property on which the building is located has indicated
that he would be willing to remove the building at no cost to you.

Enclosed please find a copy of MnDot's response to our request for
them to prepare the appropriate Quit Claim documents necessary to
officially transfer this old Trunk Highway Right-of-Way to the
local City's jurisdiction. I find it humorous that after nine
years they are still having trouble finding the time to process the
paperwork.
Once this reconveyance has been completed to the City of Eagan, the
City can then dispose of any excess right-of-way. However, we must
go through a formal public hearing process to vacate this excess
right-of-way thereby allowing its conveyance to the adjacent
property. Enclosed please find a Petition form that the City
Council requires to be submitted before they will schedule a formal
public hearing to complete this vacation process. Once the
Petition has been submitted to the City Council, a public hearing
is scheduled for four weeks later. This allows adequate
notification to all potentially affected utility companies and the
general public. The City Council meets on the ist and 3rd Tuesdays
of every month and application forms must be completed and
submitted 10 days prior to any given Council meeting to be included
on their agenda for formal action.
In preparing the legal description required under Item 2, it should
take into consideration that the City of Eagan will want to retain
a 40 foot half right-of-way measured from the existing centerline
of T.H. 13. Additional drainage and utility easements may be
requested to be retained beyond that point to accommodate the
existing rural ditch section and/or any other utilities that may
presently exist. Your legal description and/or survey of the
property to be vacated (Item 3) should accurately reflect the
location of these utilities and/or drainage ditch (top of back
slope).

lots and parcels in order to prevent the creation of landlocked
properties; and,
WHEREAS, the petitioner(s) has/have a legal interest in the land
