This letter is a follow up to my e-mail and phone conversations regazding your neighbor
who has recreational fires. I've spoken with Officer Tom Nelson and Sergeant Steve
Anselment concerning the most recent incident on February 27, 2004. Officer Nelson did
respond to your neighbor's residence at 4130 Diamond Drive and spoke to the owner,
Brian Johnson, who was in the garage. Mr. Johnson told Officer Nelson he was not
burning any gazbage but was buming old 2' x 4's. Officer Nelson saw a container in the
garage next to Mr. Johnson containing odd scraps of 2' x 4's. Officer Nelson could see
the fire from the garage and did not notice any excessive smoke emitting from it. He
could also smell the smoke from the fire and it was consistent with wood being bumed.
Officer Nelson felt Mr. Johnson was in compliance with the recreational fire
requirements.
When you called and spoke with Sergeant Anselment concerning how Officer Nelson
handled the incident, you referred to a possible violation of City Code, 3ection 10.01
Storage, Deposit and Disposal of Refuse. Scrgeant Anselment said that particular City
Code may not be applicable to recreational fires. I spoke with Fire Marshall Dale
Wegleitner about the applicable laws conceming recreational fires. He said several State
Statutes and International Fire Codes regulate recreational fires not the Eagan City
Codes. Recreational fires aze allowed in the City of Eagan and do not require a permit. I
was given copies of the appropriate statutes and codes as well as a Recreational Fire
Siurunary Sheet provided by the City of Eagan to residents.
In reviewing these documents, it would seem Mr. Johnson was technically in violation by
not attending the fire while it was buming and leaving the fire smoldering rather than
extinguishing it. If Officer Nelson had been aware of the requirements to attend and
extinguish the fire, I'm certain he would have informed Mr. Johnson. The police
depar[ment does not deal with recreational fires very often and officers may not Inow
every requirement. I will pass this information along to our patrol supervisors to inform
their officers.
On Mazch 13, 2004, I had Sergeant Kevin McGrath respond to Mr. Johnson's residence
and speak to him about the guidelines for recreational fires. Mr. Johnson was given a
copy of the statutes, codes and surnmary sheet to ensure future compliance when having a
recreational fire. The same documcnts are enclosed with this ]etter.
I hope my response adequately addresses the concerns stated in your e-mail to the City
