requesting a Variance from the 50' right-of-way setback for Pilot Knob Road. These items are
scheduled for consideration by the City Council at its September 16 meeting.
City Code, Section 4.10, Subdivision 4C requires that the recommendation of the Chief of Police

The Public Works Department has reviewed the following tax forfeit

Potential additional future right-of-way dedication
requirements may render this property unbuildable from
a setback and/or area requirement basis. Due to its
present location being situated between City and State
public right-of-way, it seems most practical that this
property could be best utilized by the City for potential
future right-of-way and/or ponding easements. Therefore,
we recommend that this be retained by the City.

The original purpose was to provide pedestrian access to
Rahn Park. No engineering concern, but the Parks
Department should respond.

These parcels serve as public access for Lots 1 through
14 of the 2nd Addition. However, they are substandard
in size and design and were required to be owned and
maintained as a private access by the homeowners
association. Subsequently, it should have been recorded
and legally tied to each of the 14 lots within that
development to ensure adequate and proportionate
ownership and related responsibilities. If this is not
the case, a legal opinion should be obtained as to
whether the City should accept these for public right-
of-way and then vacate them through a public hearing
process to the 14 lots within that subdivision to
accomplish the original intent for this development.

There is presently a need for a ponding easement over the
southwest corner of this parcel. The residual of the
property was originally dedicated with the intention of
open space preservation. The Parks Department should
comment on acquisition for City benefit.

The property at 1405 Oster Drive is a tax forfeited, vacant lot. The previous owner of the
property was allowed to develop the property into a marketable lot under the guidelines set
forth by the City of Eagan. Several years later, Dakota County widened Pilot Knob Road and
created an extra 50' setback from the street. The City of Eagan has a required 30' setback
from the street in front of the house. If you subtract the 50' easement and the 30' setback
from the 90' depth of the lot, you are left with a building site of about 10'.
With these restrictions, it is easy to see why the previous owner had to relinquish the
property to the county for taxes. The odd sized !ot has now been made unbuildable and
probably unsaleable. In studying this problem, I noticed that the lot next to this lot is identical
and that there is a good sized home buiit on it. The home next door was allowed to be built
14' into the 50' setback or easement of Pilot Knob Road.
In light of this discovery, Dakota County feels it would oniy be fair to grant the same variance
for this lot as was granted for the lot next door. With this variance granted, we would be able
to purchase and build on this Iot. This would be a win-win situation for all of the parties
concerned. The city and county would have their back taxes paid in full. They would earn
revenue from the newly improved property. The property would be maintained by the new
homeowner instead of at the county's expense. The neighbors would no longer have to call
the county to complain about the eyesore of all the weeds in the vacant lot. Taxpayers would
not have to pay for crews to come out to cut the weeds from the lot. All this can be done by
simply granting equal consideration to this lot a5 that given to the identical lot next door.

AUTHORITY FOR REVIEW
City Code Chapter 11, Section 11.40, Subdivision 3C states that the Council may grant a vanance
and impose conditions and safeguazds therein if:
1. The Council shall determine that the special conditions applying to the structures or land in
question are peculiaz to such property or immediately adjoining property and do not apply
generally to other land or structures in the district in which said land is located, and that the
granting of the application is necessary for the applicant.
2. The granting of the proposed variance will not be con[rary to the intent of this Chapter and the
Comprehensive Guide Plan.
3. That granting of such variance will not merely serve as a convenience to the applicant, but is
necessary to alleviate demonstrable hazdship or difficulty.
CODE REOUIREMENTS
City Code Section 11.24, Subdivision 6 requires a minimum 30 to 50 foot building setback along a
public right-of-way, depending on the street classification; a ten foot setback from the side property
line for a dwelling unit; and a five foot setback from the side propeRy line for an accessory structure
(oarage or other accessory structure) in a single-family zoning district. Additionally, buildings
cannot encroach into any easements so the side yard setback from the south property line is 15 feet.

for a Variance and Building Move Permit FINDINGS OF FACT
for Property Located at 1405 Oster Drive CONCLUSIONS AND
(Lot 6, Block 1, Oster Addition). RESOLUTION
This matter came before the Eagan City Council at its 5eptember 16, 1997
meeting. The Council received, considered and discussed input from staff and residents,
the planning report and the input of the applicant's representative.
Based upon a11 the files, records, proceedings and input which was presented at the
meeting, the City Council makes the following Findings of Fact, Conclusions and
Resolution.
FINDINGS OF FACT
1. A request for a Variance from the setback requirement from Pilot Knob
Road for Lot 6, block I, Oster Addition is properly brought before the Eagan City
Council.
2. A request for a Building Move Permit which would allow the relocation of
a 36' by 24' one-story house and a 24' x 24' detached garage to Lot 6, Block 1, Oster
Addirion is properly before the City Council.
3. The City's protective inspections division conducted a site inspection of the
house and garage and determined they aze structurally sound. However, the house will
need to be bmught into compliance with the Uniform Building Code by being rewued,
repairing the plumbing, new furnace installation, new egress windows, new smoke
detectors and a new attic access.
4. The other eight houses on Oster Drive are at least 20 years newer than the
house to be relocated. All the other houses have attached garages, and each has

5. Oster Addition was subdivided and platted in 1982.
6. Lot 6, Block 1, Oster Addition is a buildable lot of record since a dwelling
can be reasonably located on it without a variance.
7. T'he proposed location for the relocated house requires a variance to the
setback from Pilot Knob Road.
CONCLUSIONS
1. These matters are properly brought before the Eagan City Council.
2. Lot 6, Block 1, Oster Addition is a buildable lot of record.
3. The house with detached gazage proposed to be relocated is at least 20
years older than other houses in Oster Addition; has a detached garage while other houses
on Oster Drive have attached garages; has significantly less square footage than the other
houses in Oster Addition; and is not proposed to be situated within the buildable azea of
Lot 6, Block 1, Oster Addirion.
