repair and bring your deck into compliance with the Miwiesota Building Code and the Eagan City Code.
Mr. Meyer fiuther advised me that Mr. Bauer will commence his worN this weekend, August 8, 1998, and is
to be completed within 1'h weeks.
Accordingly, I agreed to extend your dead7ine to Answer the Cit}rs Snmmons and Complaiut to Monday,
August 24, 1998. It is expected that Mr. Bauer's work in repairing and bringing your deck into compliance
will be completed no later than Friday, August 21, 1998. By copy oftlris letter, I will request Dale
Schoeppner, Eagan Senior Building Tnspector, to inspect the deck on Friday, August 21, 1998 and advise
me as to whether your deck has been brought into compliance with the Minnesota Building Code and Eagan

This is a follow up to correspondence I sent you on September 23, 1997 regazding the property at
4044 Pennsylvania Avenue. The City has had ongoing issues with this resident in that he
constructed a deck without a building permit and will not comply with the City's Weed Ordinance.
Our department has made numerous attempts to resolve these issues and feel it is now time to begin
legal proceedings against Mr. Meyer.

As of this date, no inspection requests have been scheduled with our office in regard to
the deck under construction on your property at 4044 Pennsylvania Avenue. Building
permit #31177 was issued on December 2, 1997 under the terms that work would
commence within 90 days. Follow-up inspections revealed that continuance of work did
not occur within the 90 days. Efforts to resolve this matter have been unsuccessful thus
far.
Mr. Meyers, it is in the best interest of a11 involved parties to resolve this issue by
completing the deck and for this deparhnent to perform a final inspection. I look forward

July 3,1997: Brought to my attention that a deck was being constructed at 4044 Pennsylvania
Avenue. Record checking indicated that no building permit was ever issued.
7uly 7, 1997: A visual inspection was conducted at the site with the following results: A partial
built deck that appears to have been abandoned exists along nearly the entire length of
the home. Although a few floor decking boards were installed, work was halted after
framing. The height of the deck surface above the grade would require a code
complying guardrail. None exists. (Estimated deck height is 5'6", code requires
guardrails for surfaces 30" or higher). In addition to the abandoned deck project, the
inspection revealed an abundance of tall weeds growing under the structure.
A phone conversation was held by myself and the homeowner of 4044 Pennsylvania
Avenue, Scott Meyer. Refer to phone log attachment and Doug Reid memo.
July 9, 1997: Letter was sent to Scott Meyer requiring removal of the partial built deck - see
attachment.
July 25, 1997: Inspection was conducted for compliance on deck removal (July 24 deadline) - deck
removal not performed.
July 31, 1997: Spoke with Swtt Meyer about nomcompliance on deck removal. He stated to me that
he has decided not to remove the deck, but to submit building permit apptication and
required submittals necessary to complete work. He said he stated this intention in a
letter to Tom Hedges dated July 16, 1997. I asked for a copy of that ]etter. Scott
agreed to provide me a copy, but that never occurred.

In a July 7, 1997 phone conversation with Scott Meyer, owner of 4044 Pennsylvania Avenue, he
advised me that he would be removing a partially built deck that was constructed on his property
without a building permit in the very near future. If, or when, he decides to rebuild a deck, he will
submit plans and apply for the necessary building permit.
I also spoke with him about the weeds on his property and he advised me that his wife had mowed
the weeds and he plans to til] the yard in preparation for planting grass seeds. I will make a visual
inspection today to verify this.

In a July 7, 1997 phone conversation with Scott Meyer, owner of 4044 Pennsylvania Avenue, he
advised me that he would be removing a partially built deck that was constructed on his property
without a building pernilt in the very near future. If, or when, he decides to rebuild a deck, he will
submit plans and apply for the necessary building pernvt.
I also spoke with him about the weeds on his property and he advised me that his wife had mowed
the weeds and he plans to till the yazd in preparation for planting grass seeds. I will make a visual
inspection today to verify this.

Failure to remove this deck within this time frame may result in the City contracting removal

On Monday, August 7, I inspected the property at 4044 Pennsylvania and spoke by telephone with one
of the owners, Ms. Marie Meyer. Ms. Meyer had contacted your office on Friday, August 4, to express
a concern/complaint regarding the seemingly inconvenient nature and method by which the City's weed
control ordinance has been enforced.
The City has been working with the Meyer's since 1993. The following is a chronology of the events to
date and a brief synopsis of each (also see attachments):
September 9, 1993 (Attachment 91)
Based upon a complaint, the Meyer's were given notice that their lawn did not comply with the
City's weed ordinances. The home had recendy been completed, and no lawn establishment had
taken place during the time allowed by the ordinance.
October 21, 1993
A number of City employees, including Assistant City Attorney Sharon M11s, met with the Meyer's
at their residence to discuss the requirements to bring their lawn into compliance with the
ordinance. The City indicated that informarional assistance pertaining to lawn establishment could
be provided to the Meyer's upon request. They were also given the option of establishing a natural
planting on the steepest, most difficult area of the yard. Staff agreed that the deadline for
completion would be November 1, 1993.
• October 26, 1993 (Attachment #3)
City staff delivers lawn establishment reference materials to the Meyet's.
• Early November, 1993
An early season snow storm prevents the Meyer's from sodding the lawn. They aze granted an
extension into 1994.
• May, 1994
The Meyer's are asked by the City for proof that they have retained a company to install a lawn.
• May 25, 1994 (Attachments #4, #5, #6)
The Meyer's send a certified letter to City Weed Inspector, LeRoy Berg, containing a quotation for
the sodding of their lawn. The total cost appears to have been $2,800, rather than the $5,000
being refeaed to by the Meyer's.
Early 7une, 1994
City staff contacts the sod company to verify that they will be completing the project and
emphasize the importance ofthe project.
Mid-June, 1994
The sod is delivered to the Meyer residence on the Friday prior to Father's Day. A heavy afternoon
rain prevented all the sod from being installed. The sod would remaitt on the pallets until the
following Monday. According to the Meyer's, the high temperatures that weekend damaged much
of the sod. It was, however, installed.
7une - September, 1994
The Meyer's take the contractor to conciliation court contending the sod was of poor quality when
installed and the workmanship was substandazd.
Weeds had begun to grow between the seams of the sod, and much had died. The Meyer's and the
landscape company provide the mowing.
Early Summer, 1995
I received a call from the Meyer's asking why their neighbors did not have to comply with the weed
ordinance. LeRoy Berg was sent to the site to review the conditions. He indicated that the area in
question was undisturbed, thus was exempt from compliance as per the ordinance. LeRoy
indicated that he had asked one of the owners of the property to trim the grass back from the fence
line .
July 18, 1995 (Attachment 97, #8)
The Meyer's are sent the Cit}'s standard "non-compliance" letter indicating the need to mow. By
7uly 25, the Meyer's have mowed the lot as per the request.
August 4, 1995 (Attachment #9)
The Meyer's contact the City with a concern/compiaint regarding the handling of the case and
apparent inconsistency.
August 7, 1995 (Attachments #10, #11, #12)
I conduct a site visitation of the Meyer's property and the adjoining lots. In my opinion, the area
being questioned by the Meyer's' is "undisturbed". The rocks, depressions and mounds would tend
to indicate that no grading had taken place. This unmaintained area was contiguous with other
undisturbed areas which meandered through the subdivision.
I called Ms. Meyer and explained the difference between disturbed and undisturbed areas as
described in the ordinance. She seemingly understood my explanation and concurred with my
analysis. I discussed the option of creating a meadow area in the slope area of their yard and
offered the City's assistance in deternuning species and an appropriate installation method. A copy
of the ordinance with explanations of the pertinent sections was also sent to the Meyer's.
In the afternoon, I received a call from Mr. Meyer. He indicated that he fett the City was harassing
them and might consider contacting an attorney. I eacplained that LeRoy, as the Weed Inspector,
was obligated to follow up on those azeas which had generated complaints or had been a concern.
He said he understood this.
I explained the defvritions of the ordinance to him and offered the City's assistance to provide
informarion pertaining to alternarive landscapes. He indicated that "he did not want to cause
uouble for his neighbors" and hoped to plant sumac on his back slope.
City staff will continue to monitor the Meyer's lot to ensure ordinance compliance and will provide any
information they request. The undisturbed areas will also be check on a regular basis for noxious weed
growth.

StaFf discussed with the Meyer's the background of the turfgrass ardinance, desuibed the requirements to bring
the property into compliance with the ordinance, and discussed various options for establishing suitable turfgass
in the back yard area John VanDeLinde indicated that staff and the City Cauncil had met to discuss the issue,
and that it was the Council's wis6es to bring this issue to a resolution before the end oF this fall. John clarified
tkat only the back yard portions of the property that will be occuQied, used, and maintained needed to be
landscaped in suitab(e [urfgrass. The side slope azea an the east side of the baclc lot and steeper rear pordons
of the lat would not require turfgrass. Mr. Meyer indicated that these azeu had been plamed for sumac aad? ?

Jim McGuffee calculated that the cost of contracting the turf establishmeat througL a seeding operation wauld
be in the range of 5300-$350. If the cost of sodding were an issue, staff suggested to the Meyer's that this would
be an acceptable alterna[ive means for turfgrass establishmeut. Jim McGuffee offered to gather together some
informatioa on soil preparation and seeding operations for their lawu. He will be stopping by their residence
on Friday, October 22nd to drop this information ofL They seemed very appreciaave oF thic offer by the City.
Following the meeting, Shazon Hills indicated that she would be in contact with City Adminisuator Hedges to
discuss the outcome of the meeting with Mr. and Mrs. Meyer. She will thcn be issuing a]etter to the Meyer"s
to inform them of their responsibility to seed or sod their backyard area prior to November lst. Staff agreed
[hat if the Meyer's failed to comply witL this request that a court summons would be issued for violation of
Section 10.21 of the City Code. Options would also need to be explored at that point from imposing the Citys
autharity to establish turfgrass and to chazge these costs baclc to the property owner throug6 property taz

T'he City of Eagan has a'tiveed control" ordinance which governs the maintenance of weeds and
grasses growing on any lot or land pazcel within the City. This ordinance has been in effect since
April 21, 1981. The intent of the ordinance is to control weeds and grasses wluch may be a
nuisance or danger to the health, safery, and welfare of the City. The City is also responsible for
enforcing the state's Noxious Weed Law (Minnesota Statute 18.171).
The property located at: has been found To be in
violation of the City Weed Ordinance (City Code, Section 7.08 and Section 10.21). A copy of the
ordinance is enciosed for your reference. In compliance with the ordinance you aze being asked
to cut or eradicate these plants, within seven (7) days of official receipt of this notice, to a height
of not more than six inches.
If you fail to take the appropriate action, the City will. be forced to arrange the work with an

July 3, 1997: Brought to my attention that a deck was being constructed at 4044 Pennsylvania
Avenue. Record checking indicated that no building permit was ever issued.
July 7, 1997: A visual inspection was conducted at the site with the following results: A partial
built deck that appears to have been abandoned exists along nearly the entire length of
the home. Although a few floor decking boards were installed, work was halted after
framing. The height of the deck surface above the grade would require a code
complying guardrail. None exists. (Estimated deck height is 5'6", code requires
guardrails for surfaces 30" or higher). In addition to the abandoned deck project, the
inspection revealed an abundance of tall weeds growing under the structure.
A phone conversation was held by myself and the homeowner of 4044 Pennsylvania
Avenue, Scott Meyer. Aefer to phone log attachment and Doug Reid memo.
July 9, 1997: Letter was sent to Scott Meyer requiring remova] of the partial built deck - see
attachment.
July 25, 1997: Inspection was conducted for compliance on deck removal (July 24 deadline) - deck
removal not performed.
July 31, 1997: Spoke with Scott Meyer about non-compliance on deck removaL He stated to me that
he has decided not to remove the deck, but to submit building permit application and
required submittals necessary to complete work. He said he stated ihis intention in a,
letter to Tom Hedges dated July 16, 1997. [ asked for a copy of that letter. Scott
agreed to provide me a copy, but that never occurred.

In a July 7, 1997 phone conversation with Scott Meyer, owner of 4044 Pennsylvania Avenue, he
advised me that he would be removing a partially built deck that was constructed on his properry
wichout a building pernut in ihe very near future. If, or when, he decides to rebuild a deck, he wili
submit plans and apply for the necessary building permit.
I aIso spoke with him about the weeds on his property and he advised me that his wife had mowed
the weeds and he plans to till the yazd in preparation for planting grass seeds. I will make a visual
inspection today to verify ttus.

Dear Mr, Meyer:
In follow-up to our telephone conversation of July 7, 1997, I spoke with the Chief Building
Official regarding the construction of your deck without a building permit. It was
determined that the City will require removal of this deck within 15 days or no later than
July 24, 1997. At that time, we will make a visual inspection to insure proper removal.
Failure to remove this deck within this time frame may result in the City contracting removal
and assessing all related costs to your property.

As of this date, no inspection requests have been scheduled with our office in regard to
the deck under construction on your property at 4044 Pennsyh-ania Avenue. Building
permit #31177 was issued on December 2, 1997 under the terms that work would
commence within 90 days. Follow-up inspections revealed that continuance of work did
not occur within the 90 daps. Efforts to resolve this matter have been unsuccessful thus
far. Mr. Meyers, it is in the hest interest of all involved parties to resolve
completing the deck and for this department to perform a final inspection.

T'he Eagan City council has adopted a series of ordinances which regulate the establishment and maintenance of turf grass
and the contol of noxious weeds gowing on lots or land parcels within the City. These ordinances were most recently
reviewed and re-adopted by the Eagan City Council on August 16, 1994. The intent of the ordinance is to protect and
promote t6e health, safery and general welfare of the City through the abatement of hazazdous and nuisance conditions.
The City is also responsible for the enforcement of the State Noxious Weed Law (MId Statute 18.171).
Please consider this norice that the property lxated at ADFOMIff LVA.-V`,J ! 14- has been found to be in
violation of ihe City ordinances pertaming to the maintenance of turf and the eradicaaon of weeds (City code, Section 7.08
and Secdon 10.21). A copy of an ordinance summary has beea enclosed for your reference.
To bring your property into compliance with the ordinances, you aze requested to wt any turf gtasses or weeds that have
eacceeded six (6) inches in height and maintain them regulazly at a height of less than six (6) inches. Any noxious weeds
must be eradicated with herbicide or by removal. Please complete the initial cutting or eradication within seven (7) days of
receipt of this notice.

In a July 7, 1997 phone conversation with Scott Meyer, owner of 4044 Pennsylvania Avenue, he
advised me that he would be removing a partially built deck that was constructed on his property
without a building permit in the very near future. If, or when, he decides to rebuild a deck, he will
submit plans and apply for the necessary building pernut.
I also spoke with him about the weeds on his property and he advised me that his wife had mowed
the weeds and he ptans to till the yard in preparation for planting grass seeds. I will make a visual
inspection today to verify this.

In follow-up to our telephone conversation of July 7, 1997, I spoke with the Chief Building
Official regarding the construction of your deck without a building permit. It was
detern?ined that the City will require removal of this deck within 15 days or no later than
July 24, 1997. At that time, we will make a visual inspection to insure proper removal.
Failure to remove this deck within this time frame may result in the City contracting removal
and assessing all related costs to your property.

The purpose of this letter is to inform you that we have received the
written notice sent by you dated September 9, 1993, concerning the City
Weed Ordinance and that we wish to contest the time allowed for
compliance due to extenuating circumstances.
We have no intention of failing to take appropriate action. We need time
to make responsible financial arrangements. We cannot afford to have the
City arrange the work with an independent contractor.
We have rouEinely eradicated weeds, grasses and plants which may be a
nuisance or danger to the health, safety and welfare of the City.
We have made genuine efforts to have our property landscaped by reliable
and affordable contractors without success. We are attempting to make
financial arrangements with extended family memebers to assist with our
financial responsibilities.
While we understand the City's need to enforce compliance, at this time,
we are financially unable to do so.
We have six children, ages 5-14, to care for and their health and welfare
is our priority. We are doing the best we can with monthly house payments,
medical bills, food expenses, clothing expenses, educational expenses and
transporation expenses.
We respectfully request that the City grant us an extension until June 30, 1994
to landscape our property.
