The part of their indnstrial operation that intrudes ' or. the residential inte.?rity and visibly ciolates the ordinance can be moved to their industrial land in less than an hour or txo. Their claim to a hardship does not hold water, for they have admitted to owning over 20 acres of industrially zoned land in the Sibley Terminal Industrial Park less than trro miles away. For some reason they feel secure in violating Eagan's laws, and that the Council will not'- enforce them. A building permit was issued for the construction of a residence at the property owned by Roger and Shirley Olson on September 15, 1964. Presumably, the use of this property, known as Lot 9 Block 9 Cou?? Home Heig ts and 2850 Pilot Knob Road, for the storage of heavy duty commer- cial type trucks commenced at some later date. It appears that the above described property was on that date, and has con- tinued to be, zoned as a R-1, residential district. For an undetermined number of years the Olsons have used their property for the parking of several trucks of a coffinercial type. It has been alleged by the Olsons that Roger Olson is the only person who drives these trucks. The property has access only onto Pilot Kno6 Road and there is little or no natural screening of the property from Pilot Knob Road. Ordinance Provisions. Ordinance No. 6, the Eagan Zoning Ordinance. in effect at the commencement of the parking of trucks on this property, states that only one single family dwelling structure and garage shall be permitted upon any such lot. This would imply the exclusion of a business run out of an R-1 area. No accessory coffinercial uses, conditional uses or special uses are allowed by the ordinance in an R-1 zoned area. Ordinance No. 52, the present Eagan Zoning Ordinance, allows only one single family detached dwelling to exist in an R-1 zoned area and allows as condi- tional uses: golf courses, country clubs, tennis clubs, nursery schooZs and day care centers and beauty parlors. None of these conditional uses would appear to apply to the present situation. Ordinance No. 52, Subd. 3, allows the continuation of a non-conforming use if it would have conformed with the provisions of former Ordinance.No. 6. We have already mentioned that there does not appear to be conformance with Ordinance No. 6 and, therefore, the continuation of a non-conforming use does not appear authorized. For reasons described in my letter of December 18, 1978, it would not appear that the City is precluded from enforcing the ordinances due to the long continued use of the property. : Mr. Thomas Hedges May 15, 1979 Page 2. Minnesota Law. Minnesota Statutes Section 462.357, Subd. 6, states that the city governing body may hear request for variances from the literal provi- sions of the ordinance in instances where the strict enforcement would cause undue hardship; however, the governing hody "may not permit as a variance any use that is not permitted under the ordinance for property in the zone where the affected person's land is located." Conclusion: The Eagan City Zoning Ordinances, Numbers 6 and 52, do not pro- vide for a conditional use, or variance from the established use, under the ordinance, which would allow the storage of heavy duty commercial vehicles in an R-1 zoned area. The provisions of the Minnesota Statutes would appear to state that the Eagan City Council is without the power to grant either a conditional use permit or a use variance for the storage of trucks under these circumstances. In researching the past histoxy of the Eagan Zonina Ordinance, it appears that Ordinance 6, the first zoning ordinance, was adopted February 3, 1960 and published March 3, 1960. Dear Dale: With reference to the parking of large trucks in an R-1 residential area by Roger and Shirley Olson, it would seem everyone is in agreement that such use could be restricted under Ordinance 52.06, Subdivision 19(E), if the use had been comnenced after the enactment of Ordinance 52. Ordinance 52, Sub- division 3, specifically states that a use which does not comply with that ordinance, and which pre-dates that ordinance, can be continued if it would have conformed with Ordinance 6. The threshold question then.is whether the usage hy the Olsons would have complied with Ordinance 6? One argument would appear to be that, while Ordinance 6 does not specifically preclude the parking of large vehicles in a residential area, an R-1 lot is limited to one single family dwelling structure and garage. This would imply the exclusion of abusiness run out of an R-1 area. If the Olsons are running a business out of their home, and if the parking of these trucks is pursuant to such a business, this use would seem to be precluded in an R-1 residential area. Assuming that Eagan determines that the parking of large trucks in a residential area is not in compliance with Ordinance 52 or 6, there still remains the question of whether the Olsons could claim a right to park their trucks due to the long uncontested usage of this area. The general rule, within which this situation would seem to fall, seems to be that where a municipality has not acted upon a zoning violation for some time, or even where a permit has been wrongfully granted in the past, the municipality is not prevented from enforcing the ordinance or withdrawing a permit previously issued. This rule seems to be based on four considerations: (1) Lack of authority on the part of the administration officer to issue a permit other than in strict accordance with the terms of the ordinance; (2) The general public interest in the protection of the zoning ordinance which transcends the harm to the one against whom the ordinance is being enforced; s December 4, 1978 City of Eagan 3795 Pilot Knob Road Eagan, Minnesota 55122 Attention: Dale Runkle Zoning Administrator Dear Dale: We are in receipt this date of your letter dated November 30, 1978. Roger is the only person who drives these vehicles, they are all in his name, and are not in storage. Commenting in general about Ordinance #52, I would like to point out that this ordinance was originally dated February 18, 1975 according to the copy of the amendment dated July 20, 1978, however the legal published in the Dakota County Tribune states it was adopted February 18, 1972, and the actual copy of the ordinance carries no date. You state that in order to be grandfathered in we would have to supply proot that these vehicles were here prior to March, 1960. The first Section of Ordinance #52 (which would be Section 52.01) reads: "Section 6.01 through and including Section 6.06 as amended, in each Section's entirety, are hereby and herein repealed." I cite this as I believe the the 1960 date refers to Ordinance 6, and according to the above the City of Eagan has legally declared Ordinance #6 null and void. At some time in the near future we will be constructing a building on our property in the Sibley Terminal Industrial Park. When this is complete we will then be able to park some of our vehicles in the structure. We would do this as a courtesy to whomever the present location of these vehicles is incon- veniencing. We maintain a great rapoire with our neighbors and cannot imagine that any one of them would file such a complaint. Moving personal vehicles to open land can only lead to vandalism and theft as it would be unprotected and serve as an encouragement to criminal intent. Our Police Department does a marvelous job but cannot be expected to be at all places at all times. We appreciate the time and effort you have extended in this matter. ? Pccording to Ordinance 52.06, Subdivision 19E, it refers to parkinq lunitations on large vehicles: "The City CoLmcil may direct the remval or otheswise limit the parking of any large vehicle upon or adjacent to any residential use where it is determined that said parking has a detrimental effect upon residential use. Said large vehicles shall include, but not limit to, buses, motor homes, cruisers or trucks." The same Ordinance stated above nlay also apply to Mr. Olson's storage.
