has completed the proceedings of vacatfon of certain street easements lying
over and across the following described property:
The East twenty-five (25) feet of Lot 8, Highview Acres,
Dakota County, Minnesota.
That said proceedings were iaken and completed by the City of Eagan,
Dakota County, Minnesota, and that the description of the real estate and
land affected by the vacation of said street easements is contained in the
Resolution vacating said easements, of which a copy is attached hereto and
made a part hereof and marked as Exhibit "A".

WHEREAS, a regular meeting of the City Council of the City of Eagan, Dakota
County, Minnesota, was held on the 15th day of September, 1981, at 7:00 o'clock
p.m. at the City Hall located at 3795 Pilot Knob Road, Eagan, Minnesota; all mem-
bers being present; and
WHEREAS, pursuant to M.S.A.9412.851, the Mayor convened the public hearing
to consider the proposed vacation of certain street easements lying over and
across the property located in HIGHVIEW ACRES as hereinafter described; and
WHEREAS, the Council at a regular meeting on the 18th day of August, 1981,
accepted a Petition to vacate sa3d street easements pursuant to a petition of
the adjacent land owners and scheduled a public hearing on the vacation for the
15th day of September, 1981, at 7:00 o'clock p.m. at the City Hall; and
WHEREAS, an Affidavit of Publication of notice of hearing in the Dakota
County Tri6une, dated September.3 and September 10, 1981, relative to the pro-
posed vacation was submitted; and
WHEREAS, said Notice of Hearing was posted at the City Hall, on the 3rd day
of September, 1981; and
WHEREAS, there appearing no objection to said vacation and the Council de-
siring to vacate said street easements; and
WHEREAS, it having been determined that there are no other parties other
than petitioner having an interest in said street easements, and it appearing
that it is in the public interest to vacate such easements, and there being no
objections; ?
NOW, THEREFORE, upon motion by Thomas Egan , seconded by
Theodore Wachter , all members voting yes, it was RESOLVED that the cer-
tain street easement described as follows be, and hereby are vacated:

On January 23, 1979 7 made aaplication to divide_LQt-8,
Highview Aeres into two equal size lots. As a conditi.on to
the "ity Council's aporovsl of subdivision I was compelled to
dedicate an additional twenty five feet of right-of-way on
Pilot Knob side of lot. Lot 8 is on corner of Pilot Knob and
Highviecv Ave.-Ne+., lot faces Highview. I had at this time
already paid all as3essments on Lot-8 including the twenty
five feet in question. I think in a11 fairness I sholzld be
rebated t.".e amount paid on twenty five feet I donated for
additional rignt-of'-wa,y.
A'ly intention of splitting lot was to provide land for my
daughter and son-in-law to build a home in oizr community.
I have been a resident and taxpayer in Eagan since 1946 and
I think I was reaLly given prett,y roiigh treatment in all areas
of subdivision orocess.
