The Mayor forwarded your letter of May 28 to my office to prepare a response regarding
the concerns you have with the property at 3070 Poppler Lane. I asked the Building
Inspections Division to perform an on-site inspection to address your issue with garage
height.
The peak of the garage appears to be at an elevation higher than the house when
referenced from Poppler Lane; however, this is not the reference point that is to be used.
Eagan City Code, Section 11.10, Subd. 5 states in part , "...... no accessory building shall
exceed the height of the principal building." City Code does not include a definition of
"heighY'. The 1994 Uniform Building Code, as adopted in Section 4.01 of the Eagan City
Code, defines height as follows:
Height of building is the vertical distance above a reference datum measured
to the highest point of the coping of a flat roof or to the deck line of a
mansard roof or to the average height of the highest gable of a pitched or
hipped roof.
The handbook to the Uniform Building Code states, "1Nhere the building is stepped or
terraced, the code intends that the height of such building is the maximum heic,ht of anv
seament of the buildina."
According to field measurements, the height of the house is 28'6" and the garage is 28'
high; therefore, the height of the garage is consistent with City Code requirements.

Another concem raised in your letter was the timing of the issuance of the building permit.
Although there was a question regarding the property line, the building permit was issued
based on the fact that the required information was provided to the City by Mr. Ekblad and
his licensed land surveyor. The setbacks on the survey and on site were verified to meet
City standards. As such, the Ciry had no legal basis for delaying or denying the permit or
failing the inspections after the permit was issued.
Your letter also mentioned that the City's residential setback requirements allowed Mr.
Ekblad to extend a garage into said setbacks for property located at 2860 Pilot Knob Rokl:;?
The setback requirement was deviated from by a formal Variance granted by the Eagan
City Council at its regular meeting of November 15, 1983.
As referenced in Mayor Egan's July 31, 1995 letter to you and City stafPs recent on-site
survey inspection, Mr. Ekblad's garage is in conformance with City Code. Larry, I
understand your concern that the zoning laws appear to have been ignored; however, City
staff has expended a substantial amount of time over the last several years verifying that
the zoning laws have been properly complied with and have also been very attentive to
your concems.

This letter is in response to our conversation last week regarding
the above matter. Tius is a formal notice requesting that this location(s)
be reviewed for residential code violations. This particular location
at 2930 Pilot Knob Rd. is the location of a earth moving and landscape
business. There has been dump lrucks, loaders, piles of processed
dirt at this location. Recenfly the owner has installed a partial stone hedge
with a for sale sign on it for custom work. This location is hardly a
residence with this type of activity and appearance. The stone hedge may
even be on the easement right of way. The piles of gravel and black dirt
has been observed to be sold out of that sight.
I am requesting that inspections and monitoring be done, as I understand
that a written request by someone is necessary for something like this to be
looked into. There are also commercial type vehicles continually occupied
at 2.860 PilotKnob Rd. This issue affects the aesthetic value of the
residential azea on a main artery road of the city.
I would like to request confirmation and results of any follow-up
regarding these locations.

At the regular council meeting of November 15, 1983 the Eagan City Council
granted you the 23 foot streetside set6ack variance needed for the referenced
building. It is now necessary for you to obtain a building permit for the
structure. The average cost for construction of a building that size is $7,000.
I have enclosed a building permit application with the fees already calculated.
In addition to a building permit fee of $66.00 I will need verification that
the precast concrete planks that comprise the roof-ceiling floor assembly meet
State Building Code requirements of Table 23A, Item 3. The referenced table
requires live loads of 60 pounds per square foot. Please provide us with the
load calculations and the permit fees as soon as possihle.
