Dear Tom: We have been requested to check into the size of the road easement against the Huisentruit property for quarry Lane as shown on the portion of the Section map attached. It appears that that section map is in error and that it provides a 30 foot wide road easement for Quarry Iane across the Huisentruit property. The authority cited is document no. 424888 which we have procured a copy of and which does not describe the Huisentruit property. Further research indicates that the only easement against the Huisentruit property is a 16 and one-half foot road easement which has been recorded through the title to the property. The size of this easement is in accord with the present dimensions of Quarry Lane. In fairness to the Huisentruits, we are suggesting that the Council, at its next meeting, approve a Quit Claim Deed to the Huisentruits conveying to the Huisentruits the 13 and one-half feet which was in error shown to be an easement on the section map. The City would not be giving away any property or property rights, but rather would only be clearing the record as to what the correct legal description of the easement against the Huisentruit property is at this time. The Huisentruits are quite certain that it is 16-1/2 feet and the stakes should indicate the outer limit of the existing permanent road easement. Hauge skk enclosure cc: Bob Rosene CONSENT FOR CONSTRUCTION Gordon Huisentruit and Evelyn Huiaentruit, called Huisentruits, hereby grant to the City of Eagan and its contractor, the right to cut and slope the south side of property that is descri6ed below during the course of construction of Improvement Project U199 by the City of Eagan consisting of street improvements for Quarry Lane upon the conditions that are outlined in this Consent. 1. The City of Eagan will remove the flagstone, stack it during the course of construction, and replace it to as near as equal condition as existed prior to construction. 2. The City will remove the sedum plants and replace them in essentially the same location of a comparable size and type, to the satisfaction of the Huisentruits. 3, The temporary construction area will be determined between the City of Eagan engineers, City Public Works Department and the Huisentruits, so as to zvoid cutting or damaging any trees on the Auisentruit property. 4. Tt is understood that the driveway leading to the garage on the southeast corner of the Huisentruit property will not be changed unless the Huisentruits request it from the City. 5. It is also understood that no trees will be removed from the Huisentruit property during the course of construction. 6. The City will supervise all construction and cleanup work by its contractor. and xegrading will be done to the satisfaction of the Huisentruits. 7.
