Hruestle asked qaestions concerning the storm sewer assessment on thei^
property on Pilot Rnob Road and they appeared to be satisfied with answers by
the Special Assessment Committee. Wachter moved, Egan seconded the motion to
accept the Special Assessment Committee's recommendation to reaPfirm the final
assessment for the Bruestle property under Pro,ject D297. All voLed yes.
4. Leo MurphY, Beerwood Drive. A request was received from Mr. Murphq
Por deferment of the trunk area storm sewer assessments under the Blackhawk
Lake Project 0297. Mr. Murphy was present and requested that the assessments
be deferred due to the fact that they are eligible Por Green Acres. Mr.
Colbert reviewed the options inc2uding deferment and that it be assessed at
some future time as opposed to having the property assessed and that it be
deferred as Green Acres property at the ePfective interest rate in 1982 of
12.5%• Mr. Murphy requested tho former and upon motion 6y Smith, seconded
Wachter, it Kas resolved that the request of Mr. Murphy be granted and that
the trunk area storm sewer assessments under Pro,ject #297 be deferred and not
assessed at the present time, but that the assessment be levied in the t'uture
at such time as the property loses its Green Acre status, is so1d, or is
developed. Furtaer, tha£ aa agreement be entered into with Mr. Murphy con-
cerning these assessments.
5. Carol Lindo, Vienna Woods. Carol Lindo has again requested defer-
ment of interest and penalties levied against Lots 10 and 11, Block 2, oP
Vienna Woods, noting financial hardship, as explained in her letter to the
City that was dated duly 2, 1982. It Has noted that,her requests have been
reviewed by the City Council at earlier times, and that she has a unique
hardship generally experienced by other property owners in the City. The
mortgage company asserted the first lien on the sale of the Pirst lot. After
discussion, Wachter moved, Egan seconded the motion to authorize the accrument
of interest and penalties for the two lots, Lot 10 and 11, Block 2, Vienna
Woods, as requested, noting the special hardship provisions and that the
Council would eliminate the penalty, but that interest would continue to run
on the assessments. All voted in favor.
6. George Dougherty. A request from Mr. and Mrs. George Dougherty for
Senior Citizen Deferment for assessments Ievied under Pro3ect #297 on their
property on Deerwood Drive was then considered by the Council. The reports
Prom the Dakota County Veteran's Services oPPice and Dakota County Human
Seryices aPfirming the Senior Citizen deferral request were reviewed. Egan
moved, Waehter seconded the motion to approve the request for Senior Citizen
deferment for Mr. and Mrs. Dougherty. All voted yea.

In the letter of objection frnn Mr. & Mrs. Bruestle, they state that they are
heing assessed for "this water area" on their 1981 property tax statenent. The
assessrnszts associated with Project 297 are for tnmk stoxm sewes area assessments
and that the "water area" that is referred to in their letter is resulting frcn the
tn.mk area water assessment levi.ed Lmder Project 24 in 1976 for a 10-year period.
