The City has received a request from Mr. Hank Brustle Jr, in regard
to a building permit located on Parcel No. 10-01600-013-79 in part
of the SE; of the SE; of Section 16.
In reviewing Mr. Bruestle's request, City staff has determined that
a building permit could not be issued because the property is pre-
sently zoned Agricultural and is unplatted at the.present time.
Therefore, any building permit will have to be issued by the Eagan
City Council. The parcel Mr. Bruestle has acquired contains approx-
imately 1.15 acres and is Agriculturally zoned. It is the City's
understanding that Mr. Bruestle has been displaced by condemnation
of 35E rights-of-way. Mr. Bruestle has to be off his present loca-
tion as of December 15, 1983. Any time beyond the December 15th
schedule, Mr. Bruestle would then have to rent his home from the
Minnesota Department of Transportation until he has relocated him-
self to a different location.
In review of this particular parcel, the proposed home meets all
setback requirements in accordance with the City Code. Mr. Bruestle
has also informed the City that he will tie into existing utilities
(sanitary sewer and water), so no well or septic system will be re-
quired with this existing permit. Therefore, a location has been
reviewed by staff, and it does appear that Mr. Bruestle is meeting
the intent of the City in regard to all requirements except the
platting of the property.
In regard to the platting, it is the City's understanding that once
35E has been constructed and this area developed, there will be in-
fill development of this property and surrounding property and plat-
ting can occur sometime down the line. The're£ore, it is not essen-
tial that platting be done at this particular time as there will be
future development in the area in which the lots can be platted in
addition to other plats or development around this particular pro-
pe"rty.
If approved, the building permit should be subject to the following
conditions:
1) The applicants connect to City services (sanitary sewer and
water) prior to occupancy of the homestead.
2) Cash dedication shall be paid for the newly-created home
for park dedication.

December 6, 1983
Roger Lee, Larry Kraning, Dave Kleimola, Larry Wenzel and Thomas Strehlow. In
addition, five real estate persons indicated an interest, including Michael
Schumacher, Tom Ellingson, Tom Davis, John Klein, and Mark Parranto. The
schedule aas submitted by the City Administrator with nine different business
criteria and upon motion by Blomquist, seconded Smith, it was resolved the
following persons be appointed to the Commission:
1. Plant Manager/Industrial Owner: John MeCall
2. Financial Profession: Dick Stevenson
3• Local Media: Edna Street
4. Local Utilities Service: Roger Lee
5. Local Retail Trades: Larry Kraning.
6. City Gavernment Services: Tom Hedges
7. City Service Area: David Kleimola
S. Ad Hoe: Larry Wenzel.
All voted in favor. The Council then took a vote on one representative
for the real estate profession and Mark Parranto was elected..
A9AR HRUESTLS - HIIII.DING PEEMIT
An application was submitted by Henry Bruestle, Jr. for building permit
for single family residence on unplatted property of less than 5 acres in
Section 16, west of Pilot Knob Road. Mr. Bruestle xas present and indicated
that his home had been displaced by the I-35E construction, which caused the
hardship. After review, Blomquist moved, Wachter seconded the motion to
approve the building based upon the hardship described above and on th8
following conditions:
1. The applicants connect to City services (sanitary sewer and water)
prior to occupancy of the homestead.
2. Cash dedication shall be paid for the newly-created home for park
dedic3tion.
3• Mr. Bruestle for himself and his suceessors shall agree to plat his
existing lot when the area ad,jacent to his lot develops.
All voted yes.

The application from Dale Wagnild for 10 foot front set6ack varianee to
the 40 foot requirement on Lot S, Block 1, Oak Ridge Acres was presented to
the Council. Mr. Wagnild was not present and Smith moved, Blomquist seconded
the motion to continue the application to the December 20, 1933 meeting. A11
voted in favor.
