After mulfiple accidents and also referred to those of us who drove cars with manual transmissions, especially those who could be on a hill and not roll backwards when the light turned green. I still drive a"stick", but judging from the number oF people inches from my rear bumper, I guess people don't leave room anymore for the backwards roll. While I'm good on a hill with a clutch, I don't shift fast enough for the drivers of automatic, fuel-injected, high performance, hurry-now-and- wait-at-the-next-light cars... zoom, zoom, zoom. Perhaps "street smarts" can also refer to defensive driving, interprering traffic patterns for safe lane-changing, anticipating alternaHve routes during rush hour or construcrion detours. March 13, 2002 Dear Friends of St. John Neumann, Please allow me to make a few comments on the recent presence of the Eagan police at the Pilot Knob entrance to our pazking lot; . • The decision to ticket people as they entered or left the church pazking lot was made by the Eagan police._ That decision was made after several weekends of various warnings, including a sign indicating "no left turn, " police cars parked outside the lot, waxning tickets issued to violators; cones to make a left tum impossible, and waznings in the St. John Neumann parish bulletin. • I am told that the issue is pubIic safety. There is no left turn lane at that entrance to the lot. The danger we talked about is rear ending a car stopped in an active traffic lane so close to the intersection, sudden huns into another active lane azound cazs stopped to turn left, and cars suddenly darting to make a left turn across an opposing active lane of traffia: I am told that the massive traffic flow before and after Mass with widespread disregard of the "no left tum" sign was a serious accident waiting to happen. • Ignoring a"no left tum" sign couldresult in a fine as high as $80, at any time of the week. • I am told that the language of some af those stopped was quite foul. I was. presented with both a tape and a transcript of some examples. Encounters with the police are a matter of public record for the protection of everyone involved. We all understand and share your concern with this type of tuming movement at this location for the very reasons you mentioned. Both our agencies have worked with the Church in the past to try and eliminate this movement through education and signage. However, I have noticed that there currently is no signage at that entrance that would inform a vehicle that a left turn from Pilot Knob Rd. at that location is not allowed. The church has made internal circulation improvements to try to minimize any adverse impacts to this important County Road. For the most part, considering the number of trips into and out of this facility, it does operate fairly well. However, we also realize that it only takes one vehicle making this improper tuming movement to create the concern you mentioned. Completely closing this entrance is not the perfect solution as it is important to continue to accommodate the heavy right- in free flowing movement during those peak times which helps the efficiency of the signalized intersection. Only a raised center median to physical prohibit the left-turn movement would be the most effective and that would require a major reconstruction of Pilot Knob Rd and right of way acquisition. The City will request the County to install the additional signage and I will contact the Church requesting them to remind their parishioners about this safety concern and the turn restrictions. I will also inform our Police Department to be aware of this restriction and to enforce it as they may observe it. If you ever happen to jot down the license number of a vehicle making this improper turning movement, please feel free to contact our police department and they can send a letter to the owner informing them of this hazardous situation and the observed improper movement. Why are there left turns allowed off of Pilot Knob into St. John Neumann's parking lot? I believe this is the only section of Pilot Knob that allows left turns without a light or a left turn lane. It seems that the reason for no left tum lane is obvious - its too dangerous! There is already a northbound left turn lane going west on Deerwood which is often infringed on by traffic waiting to turn east into the parking lot. Since there is no left turn lane they either creep over into the northbound left tum lane or stop in the thru lane of the southbound lane!!! goth are situations that are very dangerous. Since there is a functioning left turn arrow at Deerwood & Pilot Knob, why can't this be the only way to enter the parking lot? Based upon your letter of May 28, 1991 and my research of applicable law, I have concluded that the church has fulfilled its storm sewer connection fee obligations in full. I understand the facts behind this case as follows: In 1979, as a condition of platting the church property, the church was required to pay a storm sewer connection fee in the amount of $13,773.66. The storm sewer connect fee is based upon Eagan City Code §3.07. Storm Water Drainaae Connection and Availabilitv Charae which states in relevant part: Subd. 3 Storm Sewer Utility Fee. Storm Sewer Utility fee for connection and availability of the starm sewer iaciliLies shall be determined by resolution of the Council and shall be just and equitable . . . Subd. 4 Adjustments. The Council may adopt, by resolution, policies and standards for the adjustment of the fee for parcels. Such adiustments shall not be made retroactivelv. (Emphasis Added) The figure of $13,773.66 was calculated in 1979 at the single family rate of $.03 per square foot on 459,122 square feet of property. The city now contends, without adequate support or proof, that the church's connection fee was substantially miscalculated in 1979, and that the church is liable for an additional fee of $15,484.40. The errors, according to the city, ? MEIER, KENNEDY & QU[NN Eugene J. VanOverbeke July 18, 1991 Page Two consist of an incorrect calculation of the square footage of the property and an incorrect property designation associated with determining the connection fee rate. The city believes that the church should be charged using the commercial and industrial rate rather than the single family rate. The city arrived at the $15,484.40 amount by using the 1990 connection fee rates multiplied by the "correct" square footage of the property (573,496.4 square feet). However, the city proposes that the original square footage amount be used in the calculation while maintaining the 1990 commercial rate charges for a total extra assessment due of $12,396.29. For the following reasons, it is my conclusion that the church does not owe any further obligation to the city for the storm sewer connection fee. To begin with, the original fee was calculated in 1979 based upon the standards and policies at that time. As a result of those then existing standards and policies the city calculated a"just and equitable" connection fee of $13,773.66 which has been paid in full. The city is now attempting to recalculate the church's original connection fee by usinq 1990 standards and policies. This is not only impermissible as a matter of law, but in violation of your own ordinance which prohibits retroactive adjustments. Finally, the original connection fee was calculated in 1979, and it was not until 1991, twelve years later, that the city made any attempt to notify the church of a perceived error in the oriqinal connection fee calculation. If the city had indeed erred in calculating the connection fee, it should have immediately notified the church. To now attempt to collect the excess fee based on current figures is highly inappropriate.
