The Eagan City Council has adopted an ordinance pertaining to outdoor storage and
display. As a result, outdoor storage/display is not a permitted use. This ordinance
requires a Conditional Use Permit for a11 outdoor storage/display. In an effort to allow
existing businesses time to comply with this requirement, the City Council allowed until
March 2, 1993 before enforcement would begin.
For your convenience, I have enclosed a copy of the new ordinance which defines outdoor
storage/display and lists minimum requirements to lie met. Conditional Use Pernut
applications are available at City Hall should you wish to apply for this permit. Until then,
please remove all outdoor items within 10 days from the date of this letter as they are in
violation of the City Code.

I have reviewed for code compliance the plans submitted for the
above-referenced project. The comments listed below refer to
documents which make up the Minnesota State Building Codes and
applicable codes and ordinances of the City of Eagan. Certain code
deficiencies inay not have been included in this report, but this
shall not be construed as an approval of such code deficiencies nor
relieve the responsible parties from complying with said codes.
Review Comments
1. FIandicap parking spaces must be identified by a sign visible
from inside the vehicle parked in the space as required (Minn.
Ss. 169.346).
2. Because water-resistant gypsum board must not be used over a
vapor barrier, an approved alternate material must be used on
the exterior walls of the work and toilet rooms. For example,
see ICBO Evaluation Report Number 1820 and others.
3. Coolers and freezers with foam plastic insulation must conform
to the provisions of UBC Section 1712(b)3.
4. Draft stops shall be installed in attics, mansards, overhangs,
false fronts set out from walls, and similar concealed spaces
so that the area between draft stops does not exceed 3,000
square feet and the greatest horizontal dimension does not
exceed 60 square feet (UBC 3305(b)).
5. Provide attic accesses which comply with the provisions of UBC
Section 3205.

6. Avoid projecting bond beams (such as those detailed on sheet

compacted granular fill (MSBC 1305.5400).

This correspondence ie to confuin receipt of the nlane and of our aubsequent phone
conversation covering the PDQ Foad Store, #214, to be located at Pilot Knob Road and
Diffley, Eagan, Minneaota.
The plans and apecificatione appear to be in general conformity with the atandarde of the
Minnesota Retail Food Store Aules and with thia department; however, the following
itema, additions and/or clarifications are necessary:
1. All food service equipment must meet the applicable Standarda of Construction of
the National Sanitation Foundation (NSF).
2. All heating appliancee which generate either excessive heat, vapora, condeneation,
greases, odors or fumea muet be properly aituated beneath a mechanical exhaust
canopy. We will mt at this time require the inatallation of an NSF approved
mechanical ventilation exhauet canopy above the proposed convection oven for the
use of heating cookiea and muffine Qnly. However, if it is determined upon
inspection by the regulatory authority that the daily uee of thia oven preaente a
problem with respect to accumulations of either excessive heat, grease,
condensation, odore or fumes, we reaerve the right to require the inatallation of
these ventilation facilitiee on demand.
3. The walls and ceiling in the food preparation, utensil washing and toilet room
areas muat be smooth, non-abaorbent, and easily cleanable. Provide an approved
ceiling above the fast food counter.
4. The floo:s in the food preparation, food storage, utensil washing and toilet roome
muet be of a smooth durable material with a coved base at the walUfloor junctures.
It ie our undezstanding the floor will coneiat of quarry tile with a quarry tile
bull-nosed base.
b. A three compartment uteneil washing sink with integral drainboards at both ends
must be provided for the proper cleaning and sanitizing of all multi-uae equipment
and utensils. The aize of the aink compartment must be large enough to
accommodate the largeat uteneiUequipment which is to be cleaned and sanitized.
NOTE: Bar glaeswashing sinke would not be considered acceptable in food service
operations.
Ensure that all expoaed wood areas of the custom fabricated faet food counter and
front deli eervice counter are covered with a pressure laminated plastic material
and ia in conformance with NSF Standard No. 35 (Laminated Plaetics for Surfacing
Food Service Equipment).

7. The food storage shelving used in the walk-in refrigerators must be NSF approved
etainleas ateel, factory pre-coated epoxy or Metroseal@ or other approved material
designed for this type of environment. Chrome or zinc-plated shelving without an
approved factory applied hard-baked protective coating is not approved for this
purpoae.
8. The plana and specifications indicated a Hatco hot holding unit for displaying
hotdogs. Additional information ie required covering equipment provided for
heating hotdoge. Heating hotdogs in the I-Tatco hot holding unit would not be
approved.
9. Provide an area for atorage of employee's personal belongings that is separate from
food, clean equipment and single aervice supplies. ?
10. All plumbing muat be installed according to the Minnesota P1_umbing Cade and by a
licensed plumber. In addition, plumbing plans muat be eubmitted to the Minneaota
Department of Health far review and approval prior to inatallation.
11. If a poet-mix beverage syetem ie provided, an approved presaure type back flow
preventer upstream from the control valve on the carbonator (water line to the
carbonator) is required.
12. Provide and routinely uae a chemical teat kit to determine the etrength of the
sanitizing agent in the final rinse water of the three compartment eink.
13. All annular openings around pipea and other conduite where they paes through the
walls and floors muat be sealed (caulked).
14. If conduit pipes are provided for beverage lines they muat extend at leaet three to
four inchea above the finiahed floor elevation at both enda and the annular opening
between the beverage linea and the conduit pipe sealed with a hard material and
provided with a cleanable finieh.
15. Lights over exposed food etorage, food preparation, food dieplay facilitiea, and
utensil cleaning and storage areae muat be ehielded or shatter-resistant.
16. Provide a product stem-type thermometer for checking the internal temperatures of
potentially hazardoua fooda.
17. The internal temperature of notentially hazardous food must be maintained at
40°F or below, or 150°F or above, except during preparation. Exception: Poultry,
poultry atuffings, etuffed meats must be cooked to a minimum of 165°F.
Thermometers must be provided in all coolers, freezers, and hot holding unite
where potentially hazardous food is stored, and muet be located in an area that is
repreaentative of the true air temperature.
18. All junctures between the wall aurface and the edges of attached equipment muat
be sealed with an approved caulk/sealing compound (e.g. three compartment sink,
hand ainka, etc.).
19. Adequate Mtoyed NSF or equivalent shelving covering the food aervice operation
must be provided to ensure that food products, utensils or aingle service articles are
stored at least auc inches off the floor.
20. In accordance with the Minneaota Clean Indoor Air Act, this establishment shall be
posted as NO SMOHING ALLOWED. 5igne shall be place at public entrances.

and an appropriate license is iesued by this Department.
This facility may not be conatructed, remodeled or converted except in accordance with the .
plans and specifications as approved by this Department. Please contact me for approval

APPLICATION SUMMARY
Separate applications have been submitted requesting a
conditional use permit to allow motor fuel sales in. a
neighborhood business district, a pylon sign, and a 6' pump
island canopy variance for a free-standing PDQ facility located
at the northeast intersection of Pilot Knob Road and Diffley
Road.
In June 1987, a conditional use application for a car wash/tune-
up shop and a variance for a building with a lot coverage above
20$ were denied by the Advisory Planning Commission. The
applicant then withdrew the item before it was heard by the City
Council. This proposal shifts the existing PDQ at the west end
of the strip center onto lot 3 as a free-standing facility. The
existing area will be leased to other neighborhood business-type
users.
SITE PLAN
Access to this site will be provided through a new right in/right
out along Pilot Knob Road, the full movement location from Berry
Ridge Road to the north that has a frontage road in front of
Beautiful Savior Lutheran Church and the existing drive
connecEing to Hilltop Lane.

The"3;500=square-foot building will be constructed with brick and
have a.gabled roofline and wood facade to match the existing
strip center. The lot coverage, including the canopy, is 15$ in
a 20%-allowable district. The 6' canopy variance is along the
Diffley Road side. If the canopy and pump islands were shifted
to the north slightly, the variance would not be necessary. The
applicant is proposing this plan with the idea that two more pump
islands may be requested in the future. A variance for that
canopy would definitely be necessary. All other code parking and
building setbacks have been satisfied. Code requires twenty
parking stalls; twenty-two have been provided, with 9'-wide
stalls for employee-only use on the south side of the building.

blow-drying capabilities. The proposed pylon sign at the
southwest property line contains 88 sq. ft. of signage area per
side and has a 20' maximum height.
At the City's request, a landscape plan has been prepared for the
entire length of the Pilot Knob Road property line instead of
just the subject area. This plan reflects the standards that
have been established since the time of the strip center
construction. The plan is well-done and will add an aesthetic
cohesiveness to the neighborhood retail complex.
GRADING/DRAINAGE/EROSION CONTROL: The proposed site was
previously rough graded with the initial development of the
Hilltop Plaza. Minimal grading is required to develop the
proposed facility.
The proposed drainage plan shows that the entire site generated
storm water runoff be surface drained northerly to the existing
storm sewer located in the northerly adjacent bituminous parking
lot. The existing storm sewer lines are of adequate size to
handle the additional site generated runoff, but the two existing
catch basins are not of sufficient capacity to handle the
increase in the runoff. The development will be required to
either reconstruct the two existing catch basins to handle the
increase in runoff or otherwise construct a catch basin at the
northeast corner of the proposed development and connect to the
existing 18" storm sewer line northeasterly of the catch basin.
No erosion and sediment control plan was submitted as a part of
this application.
UTILITIES: A 6" water stub is located at the northeast corner of
the property and is of adequate capacity and pressure to serve
the proposed development. A sanitary sewer service will need to
be constructed to the east and connect into the existing 8"
service line located easterly of the development.
STREETS/ACCESS/CIRCULATION: No public street access is
immediately adjacent to the proposed development. Access will be
from the adjacent parking lot located on, the north side.
Circulation within the proposed development will flow from west
to east with a one way proposed along the easterly side of the
building. The proposed one way along the easterly side should be
at least 18' wide. This 18' wide width is sufficient to allow a
car to pass around a stalled car if the need arises.
EASEMENTS/RIGHTS-OF-WAY/PERMITS: Sufficent right-of=way for
Pilot Knob Road and Diffley Road has been provided.
Restricted access has been dedicated along the southerly and
westerly sides of the development in accordance with requirements
from Dakota County.
The development will be responsible to provide the appropriate
drainage and utility easements to accommodate the proposed
utility construction.
The development will be responsible for acquiring all regulatory
agency permits within the appropriate time frame as required by
the affected agencies.

CONDITIONS
1. All signage shall be subject to the one-time sign fee of
$2.50 per square foot.
2• No exterior sales displays or loudspeaker advertising shall
be permitted.
3. All trash shall be contained within the building.
4. The landscaping along the entire length of the Pilot Knob
Road property line shall be installed with this development.
4• The development is required to provide an additional catch
basin for collection of site qenerated storm water runoff
and convey it to the existing storm sewer system.
5• The development is required to construct a sanitary sewer
manhole in place of the proposed clean out.
6• The proposed 16 foot wide one-way driving aisle is required
to be 18 feet wide.
7• This development shall accept its additional assessment
obligations as defined in the staff's report in accordance
with the final plat dimensions and the rates in effect at
the time of the conditional use permit.
8• A detailed grading, drainage, erosion, and sediment control
plan must be prepared in accordance with current City
standards and approyed by staff prior to conditional use
permit approval. .
9• 'I'his development shall be responsible for the acquisition of
all regulatory agency permits in the time frame required by
the affected agency.

I have reviewed for code compliance the plans submitted for the
above-referenced project. The comments listed below refer to
documents which make up the Minnesota State Building Codes and
applicable codes and ordinances of the City of Eagan. Certain code
deficiencies may not have been included in this report, but this
shall not be construed as an approval of such code deficiencies nor
relieve the responsible parties from complying with said codes.
Review Comments
1. Aandicap parking spaces must he identified by a sign visible
from inside the vehicle parked in the space as required (Minn.
Ss. 169.346).
2. Because water-resistant gypsum board must not be used over a
vapor barrier, an approved alternate material must be used on
the exterior walls of the work and toilet rooms. For example,
see ICBO Evaluation Report Number 1820 and others.
3. Coolers and freezers with foam plastic insulation must conform
to the provisions of UBC Section 1712(b)3.
4. Draft stops shall be installed in attics, mansards, overhangs,
false fronts set out from walls, and similar concealed spaces
so that the area between draft stops does not exceed 3,000
square feet and the greatest horizontal dimension does not
exceed 60 square feet (UBC 3305,(b)).
5. Provide attic accesses which comply with the provisions of UBC
Section 3205.

6. Avoid projecting bond beams (such as those detailed on sheet
A7) unless the soil under the projection is well-drained,
compacted granular fill (MSBC 1305.5400).
7. Provide floor level landings on both sides of doors D•6 and
D•7 which comply with the provisions of UBC Sections 3304(h)
and (i).
