WHEREAS, Matthew Hope and Mary W. Hope, husband and wife, own
property described as the north one-half of Lot S, Carlson Acres,
Parcel No. 10-16400-082-00 (Subject Property); and
WHEREAS, the Subject Property was assessed by the City of Eagan
on July 10, 1990 for Public Improvement Project No. 466 for storm
sewer and street improvements; and
WfiEREAS, the sum of the assessments was $5,572.00; and
WHEREAS, Matthew Hope and Mary W. Hope brought an action in
District Court appealing the sum of the assessments, known as Matthew
Hone and Marv W Hope v The Citv of Eaaan, Court File No.

WHEREAS, the storm sewer assessment was in the amount of
$3,800.00 and the street assessment was in the amount of $1,772.00
for a total assessment sum of $5,572.00; and
WHEREAS, the parties have aqreed to reduce the assessment against
the north one-half of Lot 8, Carlson Acres, to the total amount of
$5,000.00. NOW, THEREFORE, the parties do hereby enter into the following:

STIPULATION
1. The storm sewer assessment against the north one-half of Lot
8, Carlson Acres in the amount of $3,800.00 shall be reassessed in
the amount of $3,514.00.
2. The street assessment against the north one-half of Lot 8,
Carlson Acres in the amount of $1,772.00 shall be reassessed in the
amount of $1,486.00.
3. Appellants shall waive notice of hearing and hearing on the
reassessments.
4. Respondent shall direct the Dakota County Treasurer to
recompute Appellants' real estate tax statement using the new
assessment figures.
5. Following execution of the Stipulation, Appellants shall
cause this action, Court File No. C4-90-7852, to be dismissed with
prejudice.
