TRAIL EASEMENT
THIS INOENTURE made and entered into this lst day of May, 1987,
by and between JEROME E. VASHRO and MARYANN K. VASHRO, husband and
wife and AIILLIAM HUTTNER, a married person as Grantors, and the CITY
OF EAGAN, Dakota County, r4innesota, as Grantee.
WITNESSETH WHEREAS, said Grantors are the owners of the tracts
of land in the City of Eagan, Dakota County. Minnesota, legally
described as follows:
All that part of the SW 1/4 of Section 15, Township 27, Ranqe
23, lying 15 feet northerly of the following described line to
wit:
Commencing at the NE corner of Outlot A, Pilot Knob Heights lst
Addition, according to the recorded plat thereof, on file in
Dakota County, Minnesota; thence South 0 degrees 00 minutes 02
seconds East, assumed bearing, alonq the east line of said
Outlot A, a distance of 138.97 feet; thence South 0 degrees 00
minutes 02 seconds East a distance of 740.00 feet; thence North
89 deqraes 53 minutes 08 seconds, West, a distance of 98.65 feet
to the point of heqinning of the line to be described; North 40
degrees 55 minutes 08 seconds West, a distance of 86,14 feet;
thence North 88 degrees 22 minutes 56 seconds West, a distance
of 123.37 feet; thence South 46 degrees 27 minutes 16 seconds
West, a distance of 98.81 feet, and said line there terminating.
Together with a temporary easement for park trail construction
lying 25 feet northerly of the above described line.
Said temporary construction easement to expire October 31, 1967.
NOW THEREFORE, the said Grantors in consideration of One ($1.00)
Dollar and other good and valuable consideration to them paid by
Grantee, receipt whereof is hereby acknowledged, hereby convey,
warrant and dedicate to said Grantee, its heirs and assiqns, for
trail ourposes, togethec with the unrestricted right to improve the
same, free and clear of all encumbrances, the above described tracts
of land.
The Grantors, for themselves, their heirs, executors,
administrators and assigns, do covenant never to cut, damage,
destroy or remove any tree or shrub or other natural growth upon the
hereinbefore described premises for the continuance of this
easement, and do hereby grant and convey to the said City of Eagan
all grasses, shrubs, trees and natural growth now existing on said
lands or that may be hereafter planted or grown thereon.
The Grantoes, for themselves, their heirs, executors,
administcators and assigns do hereby release the said City of Eagan,
its successors and assigns, from all claims for any and all damages
resulting to the lands through and across which the parcel of land
hereby conveyed is located by reason of the location, grading,
construction, maintenance, and use of a public trail over and upon
the premises hereby conveyed and from the uses incident thereto, and
the said City of Eagan shall have the tight to use and remove all
earth and other materials lying within the parcel of land hereby
conveyed and the right to construct and maintain, upon the lands
adjoining the parcel hereby conveyed, such porta?ble snow fences
during such months as weather conditions make necessary.
All stumps and other debris resulting from the clearing of the
right-of- way will be disposed of by Grantee by burning or
otherwise, according to law.
The Grantee shall have the right to post such signs and posters
along said trail as are deemed necessary and suitable to define the
above lands and locate them for public use.

Dear Mr. Bauer:
In our conversation of January 12, 1989, you had indicated there
should not be a problem in relocating the electric meter which is
presently on a post between property lines at 3672 Pinecrest
Court. 'I'his relocation would be next to an existing electric
meter on a garage at the same address. Since out conversation, I
have contacted the City's Parks Department regarding this
relocation wherein it was indicated they would consider this
relocation if the costs were within reason. With this direction,
it is my understanding that the Parks Department will obtain an
estimate of the cost to relocate this meter and if reasonable,
the relocation will take place sometime early spring. Hopefully,
this concurs with our discussion and if you have any questions or
concerns, please contact me.
