We have no record and did not have knowledge of this private easement prior to your recent information. If there is a determination that the City of Eagan needs to provide some formal action, I would be happy to coordinate that process. History: Lawrence and Aurelia Poppler have owned this property for almost 60 years. They have farmed it in the early years. Before my parents acquired the land, a pasture drainage easement was recorded on the property to accommodate the prior owners of the property. The issue was lost because Opus Corporation (a commercial developer) filled in the site and raised the building grade level. From that process (done sometime in the 1970's) the clay 6" drain tile was buried and consequently abandoned. Next, the Healey / Remme Co, acquired the property and built the present Lemay Lake Apartments (in 1985). The azea that the drain entrance served is now the parking lot of building `B'. That grade was raised at least 8 or 10 feet. The current drainage of that apartment complex was totaled re-engineered to accommodate the Lemay Lake Addition. That drain tile was physically abandoned for a more efficient and adaptable system. Current: Pond DP-15 where the pasture drained to, has been a city storm water drainage for a surrounding developed area. Consequently, the pond has been raised to a very high level as compared to the water level PRIOR to the surrounding developmettts. That level is not a serious problem by itsel£ However, the current level is HIGHER than the DRAIN EXIT OF DRAIN TIL,E for this easement. Question: Would this issue cause any problems for the city to expand more water into the pond (referring to the Country Home Heights street and storm sewer upgrade)? Cunent and future expansion of the drainage into the pond would make the exit of the drain even more non-functional. We have no control over this problem. YOU DO. Resolution and suggestion: The current owners of the Lemay Lake Apartments want to make sure that the above easement was NOT a part of the building process. As discussed they would like to review the Plat map of LeMay Lake Apartments. It would be further helpful for the city to review this issue and send me a note that this drainage easement is of no current use and the city did not rely (obviously) for the current engineering systems. Conclusion: The said easement has no use to anyone. Once the owners of LeMay Lake Apartments are presented with all the information they would be more that willing to release this antiquated, non functional drain easement. VUI(E6ICH I have recently received a letter from Rollie Crawford, the attorney for the Popplers, a copy of which I have attached hereto. Mr. Crawford has attached a letter from you to him dated April 10, 1990 expressing concern by the City to acquire an additional permanent easement over property now encumbered by a temporary easement. My understanding of the facts are that the temporary easement arose out of the construction of a sanitary sewer sometime during the early 1980s. That the property in question is part of land that was previously platted by Mr. Poppler. Although I do not have the document in front of ine, I would have to assume that the temporary easement designated purpose was for the construction of the sanitary sewer line. Based on the foregoing facts, I sincerely concur with the arguments raised by Mr. Crawford in his letter that the easement has expired as a matter of law, and without anything further, the City has an obligation to remove any potential cloud on title. Under the present law, Mr. Crawford could request the City to release their interest in the temporary easement and if the City failed to do so, Mr. Crawford could brinq an action against the City and obtain an order of the court requiring the City to pay for any and all costs incurred by Mr. Crawford in obtaining the release. If my understanding of the facts is mistaken, would you please let me know. In our discussions and correspondence with staff leading to the final platting procedure we have encountered a serious situation. In our desire to sell some of the existing previously platted lots to raise the cash to meet the demands of the new project, we discovered an existing temporary easement that had never been released. While I believe that the easement has expired as a matter of law, and I could obtain such a ruling, the covenient way for this to be handled would be for us to be given a release for recording by the City. City staff has refused to do so on the basis of "policy." Please note the copy of the letter dated April lOth from Bruce Allen attached. If the letter correctly states the policy, I would like to see that policy in writing, when it was adopted by the Council, and the statutory authority for it. If, as I suspect, there is no such policy, perhaps I could receive an executed release of the easement within five days of the date of this letter. As a rule, the City does not release permanent or temporary easements until replacement easements thaL- may be required have heen granted. The temporary easement (Document #378234) that you have requested being released by the City sits on both sides of a 10' wide permanent easement. This easement sits over a 22' deep sanitary sewer. The ideal easement width is 2 times the sewer depth. As this is often impractical, we wi11 normally ask for somewhac less than this. In your case, we would want at least a 30' wide easement. This would add an additional 10' of pezmanent easement to both Lots 4 and S. As these are quice wide lots, we feel a 15' easement on each shouid not affecc any future building placemenc. In addition to the increased easement over lots 4 and 5, the City, as part of the proposed replat of Poppler Homesteads, will require an additional ucility easement in the northwest corner of Outlot A. The attached plat map shows a 30' x 40' easement that will be required for future storm sewer. This can be dedicated on Lot 9 on the new plat of Poppler Homesteads No. 2. We have based our design upon the (7) page plan by Architectural Resowces, Inc. I have also visited the site on November 16, 2004. Our design follows the requirements of the Minnesota State Building Code and the Intemafional Residential Code, 2000 edition. This includes a roof snow load of 35 psf. Tlae hand &aming above the front entry door is 8'-0" x 8'-0" and consists of roof trusses at 24" o.c., 2x4 hand &amed ra8ers, and 2x6 fascia boards which are desigied as beams. The 2x6 fascia shall be attached to the trusses and 2x4 hand framing with (1) Simpson A35 framing angle and at one location a Simpson LUS26 face mount hanger as shown on the enclosed detail on page 3 of 3 of t6is report. The roof sheathing call be continuous over the framing and sha11 be fastened according the Intemational Residential Code, 2000 edition.
