In response to your recent inquiry, the City of Eagan does not have any interests (legal or
othenvise) in the apparent private drainage easement that was conveyed across the above-
referenced parcel in 1912 providing for a drain tile from the Eagandale LeMay Lake 15S Addition
to LeMay Lake. We have no record and did not have knowledge of this private easement prior
to your recent information.
If there is a determination that the City of Eagan needs to provide some formal action, I would be
happy to coordinate that process. It would be helpful for the initiating pariy to be specific as to
what action would be requested.
I hope this helps you clear up the title to this property. Please let me know if I can provide any
further assistance.

RE: Pasture Easement dated Dec. 19, 1912
FROM: Larry Poppler
L a T v/10p/ /P r

As per our conversation enclosed is a page from an old abstract regarding the ahandoned
pasture easement that went ftom the west boundary of Lamay Lake addition through lot 4
of Poppler Homesteads # 1(using today's description of the land).
History: Lawrence and Aurelia Poppler have owned this property for almost 60 years.
They have farmed it in the early years. Before my parents acquired the land, a pasture
drainage easement was recorded on the property to accommodate the prior owners of the
property. The issue was lost because Opus Corporation (a commercial developer) filled in
the site and raised the building grade level. From that process (done sometime in the
1970's) the clay 6" drain tile was buried and consequently abandoned.
Next, the Healey / Remme Co, acquired the property and built the present Lemay
Lake Apartments (in 1985). The azea that the drain entrance served is now the parking lot
of building `B'. That grade was raised at least 8 or 10 feet.
The current drainage of that apartment complex was totaled re-engineered to
accommodate the Lemay Lake Addition. That drain tile was physically abandoned for a
more efficient and adaptable system.
Current: Pond DP-15 where the pasture drained to, has been a city storm water drainage
for a surrounding developed area. Consequently, the pond has been raised to a very high
level as compared to the water level PRIOR to the surrounding developmettts. That level
is not a serious problem by itsel£ However, the current level is HIGHER than the DRAIN
EXIT OF DRAIN TIL,E for this easement.
Question: Would this issue cause any problems for the city to expand more water into the
pond (referring to the Country Home Heights street and storm sewer upgrade)? Cunent
and future expansion of the drainage into the pond would make the exit of the drain even
more non-functional. We have no control over this problem. YOU DO.
Resolution and suggestion: The current owners of the Lemay Lake Apartments want to
make sure that the above easement was NOT a part of the building process. As discussed
they would like to review the Plat map of LeMay Lake Apartments. It would be further
helpful for the city to review this issue and send me a note that this drainage easement is of
no current use and the city did not rely (obviously) for the current engineering systems.
Conclusion: The said easement has no use to anyone. Once the owners of LeMay Lake
Apartments are presented with all the information they would be more that willing to
release this antiquated, non functional drain easement.
Enclosure: Item #29 from an abstract describing the easement at issue.

RE: Lots 4 and 5, Poppler Homestead
Our File No. 206-4768
Dear Bruce:
OFCOUN$EL:
JOHN E. VUI(E6ICH
I have recently received a letter from Rollie Crawford, the attorney
for the Popplers, a copy of which I have attached hereto. Mr.
Crawford has attached a letter from you to him dated April 10, 1990
expressing concern by the City to acquire an additional permanent
easement over property now encumbered by a temporary easement.
My understanding of the facts are that the temporary easement arose
out of the construction of a sanitary sewer sometime during the early
1980s. That the property in question is part of land that was
previously platted by Mr. Poppler. Although I do not have the
document in front of ine, I would have to assume that the temporary
easement designated purpose was for the construction of the sanitary
sewer line.
Based on the foregoing facts, I sincerely concur with the arguments
raised by Mr. Crawford in his letter that the easement has expired as
a matter of law, and without anything further, the City has an
obligation to remove any potential cloud on title. Under the present
law, Mr. Crawford could request the City to release their interest in
the temporary easement and if the City failed to do so, Mr. Crawford
could brinq an action against the City and obtain an order of the
court requiring the City to pay for any and all costs incurred by Mr.
Crawford in obtaining the release. If my understanding of the facts
is mistaken, would you please let me know. Otherwise, since the
easement is temporary in nature, a vacation of the easement would not
be required but rather an affidavit executed by somebody with actual
knowledge of the termination of the purpose for the easement would

Re: Poppler Homestead
Gentlemen:
The above-named subdivision was given preliminary approval by
the City Council in January, 1990. In our discussions and
correspondence with staff leading to the final platting
procedure we have encountered a serious situation. In our
desire to sell some of the existing previously platted lots to
raise the cash to meet the demands of the new project, we
discovered an existing temporary easement that had never been
released.
While I believe that the easement has expired as a matter of
law, and I could obtain such a ruling, the covenient way for
this to be handled would be for us to be given a release for
recording by the City. City staff has refused to do so on the
basis of "policy." Please note the copy of the letter dated
April lOth from Bruce Allen attached. If the letter correctly
states the policy, I would like to see that policy in writing,
when it was adopted by the Council, and the statutory authority
for it.
If, as I suspect, there is no such policy, perhaps I could
receive an executed release of the easement within five days of
the date of this letter.
Mr. Allen states in his letter that the
certain other permanent easements, and we
other "financial requirements" in connect
plat. We will be most happy to discuss
Poppler can achieve their mutual goals
release of the temporary easement.

This letter is to provide you with a written record of the City of Eagan's policy
on releasing easements. As a rule, the City does not release permanent or
temporary easements until replacement easements thaL- may be required have heen
granted.
The temporary easement (Document #378234) that you have requested being released
by the City sits on both sides of a 10' wide permanent easement. This easement
sits over a 22' deep sanitary sewer. The ideal easement width is 2 times the
sewer depth. As this is often impractical, we wi11 normally ask for somewhac
less than this. In your case, we would want at least a 30' wide easement. This
would add an additional 10' of pezmanent easement to both Lots 4 and S.
As these are quice wide lots, we feel a 15' easement on each shouid not affecc
any future building placemenc.
In addition to the increased easement over lots 4 and 5, the City, as part of
the proposed replat of Poppler Homesteads, will require an additional ucility
easement in the northwest corner of Outlot A. The attached plat map shows a 30'
x 40' easement that will be required for future storm sewer. This can be
dedicated on Lot 9 on the new plat of Poppler Homesteads No. 2.
Please cor.tact me or Ed Kirscht at the City offices concernir.g drawing up a new
easeRent and releasing the older temporary easemenc. Contact us a 454-8100.
I have enclosed a map uf this easement and the proposed additional easement.
Sincerely, ours,
Bruce Allen

RE: 3046 POPPLER LANE, REVISED CERTIF'ICATE OF SURVEY
Deaz Mr. Strauss:
This letter is being sent as a reminder to you about your obligation to supply the
City of Eagan with an accurate, revised Cerificate of 5urvey for the property listed
above. This document was requested of you last 7uly 19, 2004 when I observed a
change in the first floor elevation of approximately 2.5 ft. higher than the previously
submitted Certificate of Survey. IYs been nearly one year later and I've not received
a revised copy for this property.
Further, the residence is in violation of city turf establishment ordinances,
construction does not appeaz complete, and the house has not had it's final
inspection from City Building Inspections as required under the Building Permit.
Because of the situation, I have ordered a HOLD on this property for a Certificate
of Occupancy until the above, non-completed items aze resolved. Please take
corrective action immediately, upon receipt of this letter, to bring this property into
compliance.
Non-compliance after receiving this letter may result in whatever consequences
occur when one is in violation of a misdemeanor. Please contact Mary Crranley at
651-675-5690 should you have questions regarding City Code, or me at 651-675-
5642 if you have any other questions concerning this issue.
5incerely,

Dear Mr. Sfraus:
In msponse to your requesk, we have carricd out the structural engineering that you
directed: we have analyzed the cantilevered dcck joists in the master bedroom and
analyzed the Qorch roof for the residence idenrified above. We have based our design
upon the (7) page plau by Architectural sesources, Inc. I have also visited the sitc on

Our design follows the requirements of the Minnesota State Bmilding Code and the

adequafe to support the loads indicated above and shall be fastened to the wood I-Joists
according to the joist rnanufactwers requiremeats.
The porch mof system has been hand framed using 11 7/8" deep I'JI Pro 230's at 24" o.c.
with a 1'/a" LVL ridge board. The hip end of t}re ponch roof is framed with 11 7/8° TIl

Ta1lFree: 888-248-0373
In response io your request, we have carriefl out the sfructural eagineerireg that you
directed: we have determined the requirements far the garage shear wall to replace the
brace wall pauel requirements in Section R602.10 in the Internationa] Residential Code,
2000 edirion for the residazce identified above. We have based our demgn upon the (7)
page plan by Archiiectural resources, Ine. I have also visited the site on November 16,
2004.
Our design follows the requiremenrs of the Minnesota State Building Code and the
IntemaUOnal Residenrial Code, ZUDO ediflon. This includes a vrinrl load of 80 mph,
exposute B.
The front garage wail does not have braced wal] paneis as required by the Inteznational
ltesidential Code, 2000 editiop. The front of the garage has Uaree wail scgments
measuring 1'-6", 4'-8" and 1'-6" as shown vn the enclosed details on pages 3- 4 of 4 0£
this reQort. The 4,_S" wall segmeut will be ased to resist the wind forces acting on the
endwall. The wall segment has bcen framed with 2x6 LSL studs at 16" o.c.. with '/,"
APA cxterior sheathing. For the wall segment to meet the wind load requirements, 'h"
APA sheathing will have to be fastened to the insidc as showa on the enclased detail on

page 4 of 4 of Uvs report. The %s" APA walt sheathing must be fastened with 8d wmmon
nails or equivalent u 4" o.c. at panel edges and 12" o.c, at intermediate points.
Our involvemeztt in the design of this struciure is limited to the inslividual membecs
addressed azsd speeiW in this report. All otheC engineering and design remains the

RE: Hand Frained Roof Analysis above the Front Entry Door
3046 Poppler Lane
Eagan, MN
Dear Mr. Straus:
In response to your request, we have carried out the sti'uctural engineering that you
directed: we have analyzed the hand firaming above the front entry doox for the residence
identified above. We have based our design upon the (7) page plan by Architectural
Resowces, Inc. I have also visited the site on November 16, 2004.
Our design follows the requirements of the Minnesota State Building Code and the
Intemafional Residential Code, 2000 edition. This includes a roof snow load of 35 psf.
Tlae hand &aming above the front entry door is 8'-0" x 8'-0" and consists of roof trusses
at 24" o.c., 2x4 hand &amed ra8ers, and 2x6 fascia boards which are desigied as beams.
The 2x6 fascia shall be attached to the trusses and 2x4 hand framing with (1) Simpson
A35 framing angle and at one location a Simpson LUS26 face mount hanger as shown on
the enclosed detail on page 3 of 3 of t6is report. The roof sheathing call be continuous
over the framing and sha11 be fastened according the Intemational Residential Code, 2000
edition. When the front entry has been framed according the enclosed detail the roof
system will meet the requixements noted above_
