VURELICH Dear Bruce: I have recently received a letter from Rollie Crawford, the attorney for the Popplers, a copy of which I have attached hereto. Mr. Crawford has attached a letter from you to him dated April 10, 1990 expressing concern by the City to acquire an additional permanent easement over property now encumbered by a temporary easement. My understanding of the facts are that the temporary easement arose out of the construction of a sanitary sewer sometime during the early 1980s. That the property in question is part of land that was previously platted by Mr. Poppler. Although I do not have the document in front of ine, I would have to assume that the temporary easement designated purpose was for the construction of the sanitary sewer line. ; Based on the foregoing facts, 2 sincerely concur with the arguments raised by Mr. Crawford in his letter that the easement has expired as a matter of law, and without anything further, the City has an obligation to remove any potential cloud on title. Under the present law, Mr. Crawford could request the City to release their interest in the temporary easement and if the City failed to do so, Mr. Crawford could bring an action against the City and obtain an order of the court requiring the City to pay for any and all costs incurred by Mr. Crawford in obtaining the release. If my understanding of the facts is mistaken, would you please let me know. In our discussions and corxespondence with staff leading to the final platting procedure we have encountered a serious situation. In our desire to sell some of the existing previously platted lots to raise the cash to meet the demands of the new project, we discovered an existing temporary easement that had never been released. While I believe that the easement has expired as a matter of law, and I could obtain such a ruling, the covenient way for this to be handled would be for us to be given a release for recording by the City. City staff has refused to do so on the basis of "policy." Please note the copy of the letter dated April 10th from Bruce Allen attached. If the letter correctly states the policy, I would like to see that policy in writing, when it was adopted by the Council, and the statutory authority for it. If, as I suspect, there is no such policy, perhaps I could receive an executed release of the easement within five days of the date of this letter.
