Statutes §429.081, the above-named Appellants hereby appeal from
the assessment for Improvement Project No. 584 Street and Utility
Improvement, levied by Respondent against the following described
property:
Outlot A, Woodhaven Addition, according to the recorded plat
thereof, Dakota County, Minnesota, identified as Parcel No.
10-84700-010-00. •
The assessment was levied by Respondent for Street and Utility
Improvement Project No. 584 in the total principal amount of
Twenty-two Thousand Five Hundred Twenty-five and 45/100
($22,525.45) Dollars, plus interest. The assessmentwas finally
approved and adopted by Respondent on June 18, 1991.
This appeal is taken upon the following grounds:

1. That Respondent lacked authority to levy the assessment
because of failure to comply with statutory requirements relating
to notice to affected property owners and other statutory and
constitutional requirements for due process.
2. That the assessment was adopted in an arbitrary and
capricious manner without regard to the special benefits conferred,
without rational support in the record for any determination of
benefit conferred and without proper findings.
3. That the assessment was calculated in an arbitrary and
capricious manner in that a standard formula was applied uniformly
to properties not similarly situated and not in the same class,
without regard to actual benefit conferred or other proper
restrictions on the amount which properly can be assessed.
4. That the assessment exceeds the special benefits conferred
and is excessive and arbitrary and constitutes a taking of
Appellants' property without just compensation therefor, in
violation of the Minnesota Constitution, Article 1, Section 13.
5. That the assessment is discriminatory and violates
Appellants' constitutional rights of equal protection and due
process.
In accordance with the above-cited statute, please furnish the .
undersigned with certified copies of objections filed, the
assessment roll, exact minutes authorizing the assessment,
affidavit of publication of notices involved herein, copies of all
feasibility studies, reports, addendums and other documentation
which is part of the record on which Respondent based its actions
in ordering the improvement and adopting the assessment appealed

subject property. No environmental impact studies
were requested or conducted in the completion of
this report.
The undersigned has no knowledge of whether the
property has been used for storage or disposal of
any hazardous substance, or high concentrations
of pollutants or contaminants, as defined in 42

U.S.C. Sections 6903, 6921 or in the so-called
"Minnesota Super Fund Act" (M.S. Chapter 115B); and
the owner has no knowledge or belief that any other
person has so used the property.
The undersiqned has no knowledge of whether or not
there is the presence of radon on the subject
property.

PURPOSE OF THE APPRAISAL:
The purpose of this appraisal is to determine the
Fair Market Value of the acquisition by the City of
Eagan, as of the date of the appraisal.
Fair Market Value is defined as the price which the
property will bring in a competitive market under
• all conditions requisite to a fair sale, which '
would result from negotiations between a buyer and
a seller, each actinq prudently, with knowledge and
. without undue stimulus.
, Regardless of the exact wording of the definition,
Fair Market Value contemplates the consummation of
a sale and the passing of full title from seller to
buyer by deed, under conditions whereby:
1. Buyer and seller are free of undue
, stimulus and are motivated by no more than the
reactions of typical owners;
2. Both parties are well informed or well
advised and act prudently for what he considers his
own best interest; ' -
3. A reasonable time is allowed to test the

market; and
4. Payment is made in cash or in accordance
with financing terms available in the community for
the property type in its locale.

AREA ANALYSIS:
The subject property is located in the City of
Eagan, which is located approximately 15 miles
south of the Minneapolis/Saint Paul downtown area.
The 1988 estimated population of the area is
2,200,321 and the population is increasing. The
Twin Cities are located on the Mississippi River,
and the metropolitan area encompasses the Minnesota
River. Both Minneapolis and Saint Paul have major
urban renewal projects in progress.
The community is served by an excellent trans-
portation system which includes 9 railroads,
12 buslines, and major interstate freeway systems.
This area is also served by river barge traffic on
the Minnesota River. The Army Corp of Engineers
maintains a 9 foot channel for this purpose. This
excellent system has aided in establishing the area
, as the largest distribution and wholesale center in
the Upper Midwest.
The area is also served by an excellent airport
which is one of the largest in the nation. There
are 6 national airlines, 10 regional and commuter
air carriers, 10 air cargo airlines and 20 charter
airlines serving this area. The airport is easily

accessible due to the extensive freeway system.
There are many fine colleges and universities in
the area, including the University of Minnesota
which has an enrollment of over 50,000 students.
This area is also served by many vocational
institutes and community colleges.
The communications system serving the area consists
of 2 daily newspapers, with many weekly papers
serving the various suburbs and surrounding areas.
There are approximately 35 radio stations serving
the area with 5 television stations and an
extensive cable network.
The metropolitan area includes 22 lakes, with many
parks which offer a multitude of recreational
facilities for the entire family. This area is
represented in professional sports by the Minnesota
Vikings, Minnesota Twins, North Stars, and the
- Timberwolves.
In addition, the area is the cultural center of the
Upper Midwest with the Saint Paul Chamber
Orchestra, the Minnesota Orchestra, the Walker Art
Institute, Minneapolis Institute of Arts, the

Tyrone Guthrie Theater (an excellent repertory
theater - one of only four resident repertory
theaters in the nation), the new Ordway Music
Theater, and many other theaters and museums.
There are many attractions which directly affect
the area surrounding the City of Eagan. The
Minnesota Zoological Gardens is located in Apple
Valley and covers 480 acres. The zoo's design has
set new standards for exhibits, cost in excess of
$30 million dollars to build and has approximately
900,000 visitors a year. Va11ey Fair, a 6-Flags
type amusement park located in the Community of
Shakopee was opened in 1976 and draws over one
million visitors a year. Canterbury Downs, the $67
million dollar horseracing track across the street
from Valley Fair, opened in June, 1985. Canterbury
had 125 days of racing in 1987 and drew over
, 1,107,000 visitors. Other attractions in this area
include the Minnesota Renaissance Festival,
Murphy's Landing and the Chanhassen Dinner Theatre
in Chanhassen. All of these attractions have
caused a great deal of attention and activity to be
focused in the Dakota/Scott counties area.

CITY AND COUNTY ANALYSIB:
EAGAN
Eagan is situated in northern Dakota County. In
terms of physical size, it is a relatively larqe
community. The city encompasses an area of approx-
imately 35 square miles, or 22,440 acres. Eagan is
in the second tier of suburbs of the metropolitan
area.
Eagan's population has increased over 100 percent
in the last 10 years. The 1989 estimated popula-
tion is 46,000 compared to a population of 3,382 in
1960, 10,398 in 1970 and 20,700 in 1980. Eagan is
the fastest growing suburb in the Twin City area.
When Interstate 35E was opened in 1985 and I-494 in
1986, commercial and residential developers started
looking to the Eagan area. There are many develop-
ments of shopping centers, residential and office
space being proposed. Only 50$ of the available
land in Eagan has been developed.
Several large companies are located in Eagan.
Northwest Airlines has a new 300,000 square foot
headquarters with plans to expand, Cray Research
plans to build a new facility of 1,200,000 square

feet and Wachovia Bank and Trust is building a
94,500 square foot office/warehouse. Other large
companies located in Eagan are Unisys, West
Publishing, U. S. Postal Service's bulk mail '
facility, Coca Cola Bottling Corp., Blue Cross Blue
Shield of Minnesota and United Parcel Service.
Eagan is served by the school districts of
Burnsville, Rosemount and West St. Paul. The
curriculum for the three districts includes
emphasis on math, science, music, and computer
literacy. The Board of Education for the Rosemount
School District recently approved the construction
of several new schools. The Eagan High School and
Dakota Hills Middle School have been constructed at
Diffley Road and Lexington Avenue. -Dakota Hills
Middle School opened its doors in September, 1989.
Eagan High School is scheduled to open in the Fall
, of 1990.

There has been a tremendous increase in residential
growth due, in part, to the opening of I-35E. This
freeway made Eagan accessible to downtown St. Paul
and I-494, which permitted easy access to
Minneapolis, Richfield and Bloomington. Easy
access is also provided to the Minneapolis-St. Paul

International Airport using the Cedar Avenue
bridge.
There is a mayor/council form of government with
the administration being handled by a City
Administrator. There is adequate fire and police
protection. There are churches of all major
denominations, plus amenities to afford the Eagan
citizens a comfortable lifestyle.
DAROTA COUNTY
Dakota County is growing rapidly, with an estimated
1988 population of 254,017 compared to the 1980
census of 194,279. Dakota County was the fastest
growing metropolitan county with a 24 percent
increase in the seven-year period. Along with the
population growth has come the expansion of
business and industry to provide the goods,
services, and employment necessary to serve the
population.

- ' HI.GHEST AND BEST USE
"Highest and Best Use" is defined as that use which
will tend to produce the highest net return, or
that use which will tend to produce the highest
present value.
It is my opinion that the highest and best use of
the subject property is commercial.

APPROACHES TO VALUE:
There are three recognized approaches to value; the
Sales Comparison, Income, and Cost Approaches. The
Cost Approach utilizes estimating the replacement
cost now of the improvements deducting for
diminished utility of these improvements due to
wear and tear and obsolescence, and adding the
value of the land. The Income Approach utilizes
capitalization of the income stream to obtain an
indicated Market Value. The Sales Comparison
Approach compares the subject property with similar
properties which have recently sold, making
adjustments for dissimilarities between the subject
and comparable property to obtain an indicated
value of the subject property. When reliable sales
data is available, this approach is considered very
reliable in that it reflects the actions of buyer
and seller in the current market place.
For purposes of this appraisal, I have used the
Sales Comparison (Market) Approach.

COMMENTS AND CONCLUSIONS:
The subject property is in a remote area of the
interchange of Cedar Avenue, Silver Bell Road, and
Highway 13. It is located just south of Firstar
Eagan Bank, First Minnesota, condominiums, and an
office building. To the west is a strip center; to
the east is a park.
The subject property is located in an older
commercial district of the City of Eagan. In the
last few years it has declined as far as a high use
. commercial district as these districts have moved
to the Pilot Knob-Yankee Doodle-35E interchange and
the Rahn Road-Cliff Road-35E area of Eagan.
There are empty buildings in the area, such as Rax
Roast Beef and Pizza Hut. The nearby Cedarvale
Shopping Center has had a difficult time keeping
tenants.
Comparable sales included in this report are along
Highway 13--one has commercial zoning; the other
two have light industrial zoning, but their use is
basically along Highway 13 and are being used as
commercial.
The City of Eagan is taking a permanent easement on

the subject property for a storm sewer and a
temporary construction easement for said storm
sewer and the reconstruction of Rahn Road.
In my opinion, the permanent storm sewer easement
has minimal effect on the subject property. It is
being installed along the south boundary of the
property, and there is residential development to
the south. Since this property is zoned Community
Shopping Center, there is a 50-foot side yard
easement next to the residential property;
therefore, no building can be constructed within 50
f eet of the lot line.

Mary and Daie,
The CDA is refinancing the bonds for the View Pointe and HighPointe Apartments at 3898 Rahn
Road. A few years ago when they flnanced the buyout of the properties, they contacted us for
comments and to see whether there were code issues that needed to be addressed as part of the
improvements of he property. As they process the refinancing, they are again asking us as the
host community if there are issues with the property that need to be addressed. To the best of
my knowledge, the improvements that were done several years ago addressed our physical
property concems and, to the extent that I do not recall any recent mention of the property in the
code enforcement reports or focus reports, I believe that the property is now being well
maintained and well managed from the City's perspective.
Please respond to let Andrea and me know whether there are any current or recen# issues of
which the CDA should be aware. If they are code compliance issues, I expect that the CDA will
require the ovmer to acfdress them in order to secure the finanang as they did previously and, if
they are management issues, I expect that the CDA will require the owner to indicate how they
will commit to resolve those issues as well.

RE: Proposed Bond Refunding for the View Pointe Apartments Project
Dear Mr. Hedges:
The purpose of this letter is to give notice of a proposed bond refunding and to provide an
opportunity for community review and comment.
The Dakota County Community Development Agency (CDA) issued $16,865,000 in multifamily
housing revenue bonds in 2004 to finance the acquisition and substantial rehabilitation of the
View Pointe Apartment Project, a 327-unit multifamily development project, located at Valley
View Drive and Rahn Road. The development was constructed in 1970 and is comprised of 13
residential buildings with separate garage structures.
The previous owners had defaulted on their financing and the property suffered from high vacancy
rates, deferred maintenance :isssues, a general, run-down appearance; and community safety
concerns on the,part of the City. View Pointe Apartments, LLC (the "Owner") consulted with the
City prior to beginning the renovation project and addessed the City's concerns. Attached is a
summary of the rehabilitation work completed, totaling $4.8 million. The project is now operating at
more than 95% stable occupancy:
The Owner requests that the CDA issue tax exempt bonds in an amount of $16,865,000 to refund
the existing debt and issue additional taxable bonds of approximately $2.2 million to reimburse
part of the Owner's equity contribution and pay costs of issuance. The proposed refinancing is
estimated to have a net present value savings of 6°Io.
The CUA's policy related to such requests is to inform the city in which the development is
located and provide an opportunity for review and comment. The CDA will not approve
requests for funding where a community indicates that the development is not consistent with a

View Pointe Apartments, LLP
Apartmerit Rehabilitation Summary
In 2004, View Pointe Apartments, LLP acquired a 327 unit apartment complex in Eagan,
Minnesota. At the time the property was purchased there were 57 vacant apartments and the
property itself was in a state of despair. The acquisition of this property required a renovation of
the property to modern standards with many improvements such as roofs and siding replacement,
paving replacement, window development, concrete replacement, and improvements to the
interior common areas and apartment units. In addition, a new management office and
community center were built on site and improvements were made to the gar`age banks.
At the onset of the redevelopment, the property was split into two distinct apartment complexes.
Five buildings on the North side of the property have view of the river valley, comprising of 125
units. These buildings remained under the name View Pointe Apartments and involved a rehab
which consisted of upscale amenities and improvements, resulting in a higher price point for
these units. The remaining buildings were renamed HighPointe Apartments and were also
renovated, but at a more modest level.
Improvements for View Pointe Apartments
The old roofs were replaced with hip roofs to modernize the buildings and to extend the life of
the roof. The old vinyl siding on the buildings was replaced with hardie plank siding with hardie
board accenting trim. The balconies were replaced with aluminum deck railings and old windows
were replaced with energy efficient ones. In addition, all the patio doors were replaced as well as
the damaged gutters and downspouts.
The interiors of the buildings were also renovated. New air conditioners were installed in all
units and the boilers were repaired and modernized with appropriate controls. All units received
plumbing renovations consisting of new sinks, stools and tubs and electrical upgrades were made
relative to new baths and kitchens. New light fixtures were installed in all units along with new
ceiling fans. The renovations to all units consisted of new carpet and flooring, new cabinetry and
countertops, and new appliances. Also, all the common area hallways were resurfaced with
Knock-Down Texture in an effort to update and modernize interior appearance of the building.
Improvements for HighPointe Apartments
The roofs were replaced and repaired as needed based on the condition at the time of acquisition,
however some of the HighPointe buildings received new hip roofs. New aluminum siding was
installed and the balconies were replaced and repaired as needed to uniformly improve safety and
improve the aesthetic appeal of the buildings. Windows were also replaced with energy efficient
windows and patio doors were replaced as needed. All damaged gutters and downspouts were
also replaced.
Improvements to the building interiors consisted of new air conditioners in all units and boiler
repair and modernization, new sinks, bathtubs and stools in those units that required it, new
flooring and new lighting in all common areas to create a more uniform look. Knock-Down
Texture was also applied to the common area hallways, as it was in the View Pointe buildings.
Improvements and upgrades were made in select units and involved the installation of new
carpet, flooring, cabirietry and countertops, and new appliances.
Several improvements were made to the property as a whole. For instance, the asphalt parking
lots and driveways were replaced with new material, concrete curbing was installed in certain
areas to protect the. grassy areas of the property and new property signs were installed to
reinforce the aesthetic appeal. Aging garage doors were replaced with modern doors and new
siding was installed on the garage banks as needed to create a more uniform look. Exterior
lighting was improved by the addition of modern high efficiency lamps. In addition, a new
management office and maintenance shop was built on the property near the View Pointe
Apartments entrance.
