SITE PLAN SUMMARIES: The Eagan Fire Department has submitted
plans to revise the site plans for Fire Stations l, 2, and 3.
Enclosed is a summary of the proposed changes.
Station 1
The blacktop area on the north side of the station would be
enlarged to accommodate more firefighters' automobiles. The back
(east) side and the front sides would be enlarged to allow for
easier truck movement. No new concrete curbing would be
installed.
The enlargement of the blacktop area on the back side of the
station is to allow for easier access to the rear entrance doors
of the station by larger trucks. The remaining qrass areas to be
removed are to allow for more area for cars and trucks. No new
concrete curbing would be installed.
Station 3
The small enlargement at the corner of the driveway and parking
area is to "fill-in" the hole that has been 'created by the trucks
cutting across the grass. This will then make a nearly straight-
out exit from the station to Pilot Knob Road for the emergency
vehicles. No new concrete curbing would be installed.

City Councilmember Wachter was contacted on March 21, 1982 by a
member of the volunteer fire department to review a number of items
at Fire Station #1 that require repair work. City Councilmember
Wachter contacted the Director of Public Works on March 22, 1982
and asked that he coordinate the various items that he visually
inspected and feels are in need of repair. Councilmember Wachter
should have contacted this office; however, as chairman of the
public works committee, he apparently felt that this was an item
that was coordinated by that department. In any event, I requested
a memorandum from Public Works Director Colbert listing the concerns
that were addressed by Councilmember Wachter. See the attached.
I would like for your to coordinate the repair work as outlined
in the attached memorandum and also City Councilmember Wachter
would like an analysis of the heating bills at Fire Stations #1
and #3, specifically ##1, to evaluate the savings, if any, since
the Co Ray Vac heating system was installed approximately two (2)
years ago. This is possibly an assignment for one of the interns.
City Councilmember Wachter feels that if there is adequate savings,
the Co Ray Vac heating system should be considered for Fire Station
#2. '
I would like a report on how you plan to approach the correction
of these items so I can copy City Councilmember Wachter and assure
him that the work will be accomplished.

Councilman Ted Wachter contacted me on March 22nd informing me of several
cancerns he had pertaining to Fire Station No. l. 'I'hese concerns are list-
ed as follaws:
STRUCTtJRAL
1) 'I'he facia on the west edge of the building has come loose and pulled
away from the faoe of the building creating a potential hazardous sit-
uation near the main entrance.
ENERGY CONSERVATION
1) All access doors to the fire statiari should be adequately weather-
stripped. ,
2) 'I'he two windaws on the east side, the one, window on the south side
together with the glass above the existing doors should be boarded up
to conserve energy and minimize heat loss.
3) The holes drilled into the Plexiglas covering the dispatcher's windaw
on the west side should be plugged up to help minimize heat loss.
MATWFNAN('F'
1) 'I'he majority of the trim and Masonite siding on the west side should
be scrapped and repainted. The existing paint is severly blistering
and peeling.
2) 'I'he trim around the entranee door on the north side of the building
should be painted.
3) Interior water pipe distribution system against the outside wall for
the middle addition should be insulated to prevent potential freeze
ups.
4) It was notioed that there are no heaters in the back workshop area
on the east side of this ocniplex. '1'his ma.y create a potential for
frozen water pipes in the future. Councilman Wachter suggested that
possibly a space heater should be installed regulated by its awn
thernmstat in this back room to prevent this possible frozen water
pipe situation.
I am forwarding t-his request to your attention due to the fact that it
involves suggestions for repair work that wouid norma.lly fall under either
the Fire Departnent or the Protective Inspections Department and any =

The purpose of this policy is to establish uniform dollar amounts upon con-
tracts which sha11 or may be entered into by the City on the basis of compe-

Bid Requirements
Compefiitive bidding must be used when the amount of a contract is estimated
to exceed $10,000 for the sale or purchase of supplies, materials, equipment
or the rental thereof, or the construction, alteration, repair or maintenance
of real or personal property. Requests for competitive bids are required
to be gublished once at least ten (10) d"ays before the last day for submis-
sion of bids. Specifications on the merchandise, materials, equipment,
etc. , shall be on file in fihe office of the City Clerk. Copies of the speci-
fications will be furnished on request to any prospective bidder upon a
monetary deposit to guarantee their safe return. Bids shall be directed
to the Clerk, securely sealed and endorsed upon the outside wrapper with
a brief statement describing the property on which the bid is being submit-
ted. The Eagan Council reserves the right to reject all bids.
.. Quotation- Requirements
Competitive quotations must be used when the amount of a contract is esti-

chase of supplies, materials, equipment or the rental thereof, or the eon-
struction, alteration, repair or maintenance of real or personai property.
At least two sealed quotations must be received on specifications prepared
by individual department heads. As long as two or more quotations are
received, the City is not required to advertise far bids or otherwise comply
with the requirements of competitive bidding. It is, however, advisable
to advertise to the best of the department's ability so that' competitive
quotatioris may be received. Quotations that are received shall be kept
on file for a period of at least one year after receipt thereof. The Eagan
Council reserves the right to reject all quotations.

AI1 proposals and specifications in either the quotation/bidding process
must be so framed as to permit free and full competition and must be suf-

Contracts that are awarded as a result of the quotation/bidding process
shall be awarded to the "lowest responsible bidder".

STRUCI'URAL
1) The facia on the west edge of the bui.lding has cca*e loose and pulled
away frcan the faoe of the buildi.ng creating a potential hazardous sit-
uation near the ma ixi entranoe.
IINERGY CdNSERUATION
1) All access doors to the fire staticn should be adequately weather-
stripped.
2) The t-wn winddws on the east side, the one windaa on the south side
together with the glass above the existing doors should be boarded up
tA conserve energy and minimize heat loss.
3) The holes drilled into the Piexiglas cxovering the dispatcher's window
on the west side should be plugged up to help minimi.ze heat lass.
NQ?sTTIIVANCE
1) The majority of the trim and Masonite siding on the west side should
be scrapped and repainted. The existing paint is severly blistering
and peeling.
2) 7he trim aroimd the entrance door on the north side of the building
should be painted.
3} Interior water pipe distribution systeqn against the outside wall for
the middle ackiition should be insulated to prevent potential freeze
uPs•
4) It was notioed that there are no heaters in the back workshop area
ari the east side of thi.s ccroplex. 7his may create a potential for
frozen water pipes in the future. Councilman Wachter suggested that
passibly a space heater should be installed regulated by its awn
thermostat in this back nxgn to prevent tlzis possible frozen water
pa.pe situation.

SUBJECT: REPAIR WORK ON FIRE STATION #1
CiCy Councilmember Wachter was contacted on March 21, 1982 by a
member of the volunteer fire department to review a number of items
at Fire Station #l that require repair work. City Couneilmember
Wachter contacted the Director of Public Works on March 22, 1982
and asked that he coordinate the various items that he visually
inspected and feels are in need of repair. Councilmember Wachter
should have contacted this office; however, as chairman of the
public works committee, he apparently felt that this was an item
that was coordinated by that department. In any event, I requested
a memorandum from Publio Works Director Colbert listing the concerns
that were addressed by Councilmember Wachter. See the attached.
I would like for your to coordinate the repair work as outlined
in the attached memorandum and also City Councilmember Waehter
would like an analysis af the heating bills at Fire Stations #1
and #3, specifically #1, to evaluate the savings, if'any, since
the Co Ray Vac heating system was installed approximately twv (2)
years ago. This is possibly an assignment for one of the interns.
City Councilmember Wachter feels that if there is adequate savings,
the Co Ray Vac heating system should be considered for Fire StaCion
#2. '
I would like a report on how you plan to approach the correction
of these items so I can copy City Councilmember Wachter and assure
him that the work will be accomplished.

At the regular City Council meeting on May 18, 1982, City Council-
member Wachter expressed concern that the City have a tight
inspection program on the installation of portable fireplaces.
Apparently, the assembly of chimney sections on?portable fireplaces
is often less than desirable and can create a fire hazard. It
might be well that you provide some narrative on how you inspect
those types of units and, more importantly, the fact that many
times these units are installed without a building permit, totally
unbeknown to the City.
I also feel that some morning it would behoove you and I to meet
with Fire Chief Childers and Doug Reid to discuss and go over the
various improvements that are required for City
Councilmember Wachter is not satisfied that the improvements have
been made that he discussed with Jerry Adam and I would like to
geC a handle on this issue to satisfy City Councilmember Wachter.

"EAGAN CITY POLICY FOR OBTAINING QUOTATIONS/BIDS"
The purpose of this policy is to establish uniform dolldr amounts upon con-
tracts which shall or may be entered into by the City on the basis of compe-
titive bids, quotations or purchase or sale in the open market. It is an
attempt to clarify and define the City's specific requirements that are to
be used in the quatation/bi.dding process. Although the following is the
required policy, any deviations should be clearly documented and recorded
as to special circumstances necessitating the deviation.

Bid Requirements
Competitive bidding must be used when the amount of a contract is estimated
to exceed $10,000 for the sale or purchase of supplies, materials, equipment
or the rental thereof, or the construction, alteration, repair or maintenance
of real or personal property. Requests for competitive bids are required
to be published once at least ten (IO) days before the last day for submis-
sion of bids. Specifications on the merchandise, materials, equipment,
etc,, shall be on file in the office of the City Clerk. Copies of the speci-
fications will be furnished on request to any prospective bidder upon a
monetary deposit to guarantee their safe return. $ids shall be directed
to the Clerk, securely sealed and endorsed upon the outside wrapper with
a brief statement describing the property on which the bid is being submit-
ted. The Eagan Council reserves the right to reject all bids.
Quotation Requirements
Competitive quotations must be used when the amount of a contract is esti-
mated to exeeed $2,000 but remains less than $10,000 for the sale or pur-
chase of supplies, materials; equipment or the rental thereof, or the con-
struction, alteration, repair or maintenance of real or personal property.
At least two sealed quotations must be received on specifications prepared
by individual department heads. As long as two or more quotations are
received, the City is not required to advertise for bids or otherwise comply
with the requirements of competitive bidding. It is, however, advisabie
to advertise to the best of the department's ability so that competitive
quotations may be received. Quotations that are received shall be kept
on file for a period of at least one year after receipt thereof. The Eagan
Council reserves the right to reject all quotations.

FIRE STATION 1 - REROOFING

This work does not include new addition.
GENERAL
Remove existing roofing and reroof. Add necessary insulation to
meet a U-Value of .06.
MATERIALS
1. Wet and damaged base insulation to be replaced by "in
place" equivalent.
2. Combination board insulation, such as, Fesco Foam by John
Mansville or approved equal tapered to provide drainage
to scuppers.
3. Fiberboard 2" by Mansville or approved equal.'
4. Pressure treated wood nailers as needed to meet height.

5. Roofing: Built-up asphalt and gravel roofing dead level
shall be as manufactured by John Mansville or an approved
equal. Roof shall consist of base felt and 3 layers of
15 lb. felt, 60, lb. floor coat and gravel 1/4" to 5/8",

6. Sheet metal to be equal to existing and replaced only
with Building Inspector's approval.
INSTALLATION
GENERAL
Conform to best roofing practice, accomplished by skilled
mechanics. Exercise special care at openings through roof and
at roof edges. SPILL NO ROOFING MATERIALS ON OTHER BUILDING
MATERIALS. Any spilled materials on exposed surfaces will require
roofer to repair, resurface or replace stained work. Perform
work under best conditions and in a manner consistent with the
work progress, weather conditions and methods which will insure
a proper application without damage to roofinq materials, mem-
brane or any part of the building. -
Roofer shall perform all work in strict accordance with roofing
material manufacturer's standards and specifications. After
commencing work, roofer will be responsible for completing
installation as rapidly as possible, maintaining complete water
integrity of the roofing membrance, providing periodic progress

checking of the installation to insure compliance with the speci-
fications to insure a minimum satisfactory roof life of not less
than 10 years. Roofer shall:
Not apply roofing membrane under conditions which are not
satisfactory, including weather, to permit the application
of the roofing assembly in accordance with.best recommended
practices.
Examine roof deck and other surfaces with Building Inspector
for_suitablity prior to commencing work.
Maintain careful control of bitumen temperatures within
range recommended by manufacturer.
Establish method of control and supervision of the instal-
lation to insure compliance with the specifications and
quantities of materials scheduled for use.
Resolve with Building Inspector any questionable work
prior to commencing installation.
PREPARATION
Decks and other surfaces must be smooth, firm, clean, dry and
free of all loose material and foreign matter. Do not start
work during threatening weather nor proceed with work over frosty
or damp surfaces. Remove snow and/or ice from decks and dry
thoroughly before starting work. Notify Building Inspector of
any areas unsuitable for roofing and do not proceed with work
until unsuitable areas of work have been corrected.
FOLLOW-UP INSPECTIONS
Just prior to acceptance of entire project by Owner, roofer shall
inspect entire roof, remove all debris, nails, wire, cut metal
and respread and add gravel as needed over all bare spots. Remove
any drips of asphalt. Confirm to Owner in writing that this
inspection has been made. Repair any defects by cutting open
and repairing roof in accordance with original specificati.ons.
GUARANTEE
Furnish to the Owner in a form acceptable to the City of Eagan,
a five-year (5-year) written guarantee covering roofing, built-
up flashing materials, metal flashings and workmanship used in
the construction of this roof.
Guarantee shall be signed by the Roofing 'Contractor. Guarantee
shall commence with date of final acceptance of project by the
City of Eagan and shall cover the following items:
1. Weather and water tightness of roof, against normal wear and
tear of elements or as may be caused by defective"materials
workmanship or both.

2. Damages to building contents caused by failure of any item list-
ed in (1) above.
Guarantee shall exclude the following items:
1. Damage to roof caused by fire, lightning, tornado, hurricane,
gale or hailstorm.
2. Damage to roof caused by significant settlement, distortion
or failure of roof deck, walls or foundations of building.
3. Damage to roof caused by mechanical abrasion or abuse not
caused by Roofing Contractor.
Roofing Contractor and/or General Contractor shall promptly make
any and all repairs to roofing installation at their own expense
following notification of a failure by the Owner. If Roofing
Contractor is unable to or unwilling to immediately repair or
correct the defect(s) in the roof, Owner shall have the option
and right to arrange for such repairs as he deems necessary
to protect the building and its contents and to charge such costs
to the Roofing Contractor or General Contractor, or both, in-
cluding any damages to the building or its contents.
Roofing Contractor_ shall inspect roofing twelve (12) months and
after acceptance of the building with Owner or Owner's representa-
tive to determine if there are any noticeable defects in the
roofinq installation.
Should any defects be found, they shall promptly be repaired
at roofing contractor's expense to a condition consistent with
the original roofing installation. Such corrective measures
shall not waive the guarantee or its conditions.

have been insulated and paneled on both sides. .
4. All overhead doors are weatherstripped.
5. The exposed waterpipe in the shop area is insulated.
6. The west office window has been reglaced with l" insulated glass (Thermopane).
The exterior painting is to be done when the weather is warmer and the replace-
ment steel doors are on order with delivery expected next week. -
I have approved an extra of one lock set keyed to match the existing locks and to
replace the one that is not repairable.

sian meeting held on Tuesday, August 24, 1982.

Discussion and Acticn
The Advisory Planning Ccamnission reviewed the applicaticro sulamitted for the variance
request to allaa a 10' front setback for Lots 19-26, Block 1, Wedgwood lst Addition.
It was brought forth that the original plat approved indicated th,at no variances
would be granted unless for vegetation or topographic hardships. The applicant in-
dicated that this is the reason they are before the Ccnnission on August 24th. Af-
ter review of the topography and the trees, the APC had indicated that the-re':we.re top-
ographic problems and were preserving trees and the APC reccamnended approval of the
variances for Lots 19-26, Block 1, Wedgwood lst Addition. This itEn has beP_n sched-
uled for the September 21, 1982 City Council agenda for final consideration.

Discussion and Action
The Advisory Planning Ccmnissian talked over the application request for a condition-
al use for carzy out food. It was brought out that the delicatessen proposed would
be in conjiuzction with the bakery located in the Silver Bell Shopping Center. Also,
clarification that there would be no sit-dawm facilities on the pren.ises because of
construction restraints regarding the addition of rest roans was also discussed.
Therefore, the staff report was inaccurate and that there will be no sit-dawn facili-
ties with this conditional use. The APC received clarification of the'Neighborhood
Business District zoni.ng in regard to sit-dvwn and fast food facilities and noted
the conditional use was the right application to grant the delicatessen. The APC
recomiended approval of the oonditional use and this itEn has been rectuested to be
plaoed on the September 7, 1982 City Council agenda for final consideration.
C. DAVID R& PATRICIA BCDELL for preliminary plat, Odell's Addition, consisting of
approximately one acre and containing 2 single family lots in part of Lot 2,
McCarrhy Ridge Addition, Section 9.
Discussion and Action
There was a lengthy discussion held by the Advisory Planning Ccmmission in regan3
to Odell's Addition. It was requested that staff update the APC on the waiver of
plat which was originally subanitted in May of 1982. Staff had indicated that the
waiver of plat was reocmnended for denial by the APC and denied by the City Cotmcil
because there was no hardship. Staff also indicated that the preliminary plat is
a neaa application and the City Council had addressed the platting process when the
waiver of plat was denied. Therefore, the applicant sutsnitted an application for
the platting process. The Advisozy Planning Ca[uttission also brought forth that

there really has not been a change in the request except for the applicatiari process.
The restrictive covenant was also brought up and the City Attorney indicated that the
City should not take.the oovenant into account when considering this application.
There were a rnmnber of residents at the public hearing and all residents requested
that the APC deny the application for this proposed subdivision. After a lengthy de-
bate, the APC reccmaciended denial of the preliminazy plat because it is the second
time the applicatian is before the Ccmnission and it was not appropriate to replat
an existing platted lot and the majority of the property awners surrounding the pre-
liminary plat were in opposition of the subdivision. This iten has been scheduled
for the September 21, 1982 Citv Cotmcil a enda for final consideration.
D. GABBERT DEVEL,OP= INC. for preliminary plat, Sheffield Addition, consisting
of approximately 11.36 acres and oontaining 44 single family lots located in
part of the F}2 of the SF}4 of Section 26.
Discussion and Action
The Advisory Planning CcTnissim reviewed in detail the application for preliminazy
plat of Sheffield Addition. The Advisory Planning Ccurussion brought'forth that
there have been a rnm-ber of applications processed by the City for smaller single
family lots but noted that this was the first application where single family lots
had a 50' lot width or smaller. Staff ha.d addressed the.smaller lot concept being
allowed through the planned develognent process and that lot widths have varied in
other subdivisions processed by the City. The Advisory Planning Camission was al-
so concerned about the easterly access to SYveffield Addition and reccmTkending that
the easterly access be aligned with the easterly access of Oakwood Heights. After
the detailed review, the APC reccmnended approval of the preliminary plat subject
to the conditions listed i.n the staff report with the addition that only 42 lots
be approved rather than 44 and that all lots in the subdivision have a minimun of
50' of frontage on a public street. Staff assured the Planning Ccmiission that the
removal of the 2 lots would enable the developer tA obtain a 50' width on the public
street. This itEn has been scheduled for the SeptFSnber 21, 1982 City Council agenda
for final aonsideration. . E. CONTINUID PUBLIC HEARINGS to consider the adoption of the follawing ordi.nances:
1. Wind F1lergy Systems - The APC reviewed the Wind Ehengy Systen Ordinance and
it was brought out that Lloyd Krob had reviewed the Ordinance with Dale
Haggert who was an amateur radio operator. After this review, there were
no problems regarding this Ordinance and the APC reocuriended approval and
that this Ordinance be placed on the September 7, 1982 City Council agenda
for adoption of the Wind Energy Systems and Radio/TV 'Ibwers Ordinance. 2. Subdivision Regulations = The APC noted that with the August 24 packet,
staff had requested that the APC discuss same issues where the private
developmP_nt group and City staff disagreed regarding ordinances. The
first itesn the APC discussed was cul-de-sac streets. After discussing
both issues of maintenanoe and liveability, the APC suggested that neu-
tral lanquage be plaoed in the subdivision ordinanoe regarding cul-de-
sacs that the City should not encourage or discaurage cul-de-sac streets.

The next itan of conaern was in regard to solar access and envirorurn_ntal protec-
tion section of the Subdivision Orclinance. It was noted that staff arid the
group of developers are in agreement with modifying the language in the Subdi-
vision regulations to include general policy statemerits regarding solar access
and envirornnental protection and that detailed language be reTmved and staff pre-
pare handbooks that would provide infornation to the private developers in re-
gard to solar access and environmental protection. 'I'herefore, the APC agreed
with the changing of the detailed language regarding solar access and environ-
mental protectlon, and the staff will reference that handbooks will be prepar-
ed by the City regarding these two elements. The last item.of concern the APC
addressed was the financial guarantee or escraw amotmt that the developer must
provide for public utilities. The APC discussed tax forfeiture and haw the
City could cover themselves on delinquent assessments. They noted that the
original draft requested a 75% escrow; the APC suggested that 50% be the es-
craw amount with further discussion regarding this amount be continued until
input has been received by the developer and City Council. After discussion
regarding the Subcl.ivision Ordinance, the APC recommended that a special meet-
ing be held September 15, 1982 at 7:30. P.M. to review the revised draft of
the subd.ivision Ordinance and a revised draft of the Shoreland Ordinance.

away frcan the face of the builcling creating apotential hazardous sit-
uation near the main entranoe. ?
2) Repair or replace post in-between service door and overhead door.

1) Al1 access doors tA the fire staticn should be adequately weather-
stripped.

be scrapped and repaint.ed. The existing paint is severly blistering
and peeling.
2) The trim around the entrance door on the north side of the building
should be painted.
3) Interior water pipe distribution systern against the outside wall for
the middle addition should be insulated to prevent potential freeze
ups.
4) It was notioed that there are no heaters in the back workshop area
on the east side of this c+miplex. This may create a potential for
frozen water pipes in the future. Councilman Wachter suggested that
possi.bly a space heater should be installed regulated by its cxan
' thernostat in this back roan to prevent this possible frozen water
pipe situation.

SUBJECT: PUBLIC WORKS COMMITTEE MEETING
A Public Works Committee meeting was scheduled by its chairman, City Coun-
cilmember Wachter, for 8:00 a.m. Thursday, August 26, 1982, at Fire Station
No. 1. City Councilmember Wachter has met with Fire Chief Childers on
two or three separate occasions over recent weeks to discuss energy improve-
ments to the fire stations. The proposals were submitted by contractors,
and before an award is made to a successful bidder, the Public Works Com-
mittee wanted to inspect the building and make a final determination as
to whafi type of improvement should be made so that the final decision can
be made this fall for the anticipated improvements. It may be the Public
Works Committee's recommendation to reject all quotations. If that should
occur, a new set of specifications would be deveioped for the remodling
project. .

Subd, 12. Design and Maintenance of Off-Street
Parking Areas.
A. Drainage. All parking lots except those
for less than four (4) vehicles, shall be graded according
to a drainage plan which has been approved by the City
Engineer. Catch basins, sumps, and underground storm sewers
may be required and all such'lots and driveways shall be
surfaced with a material to control dust and drainage as
approved by the City Engineer.
B. Lighting. Any lighting used to illumi-
nate an off-street parking area shall be shaded or diffused
so as to reflect the light away from the adjoining psoperty
and away from abutting traffic.
C. All off-street parking areas shall be
constructed with curbs or similar barriers to contain all
vehicles.
D. All off-street parking areas for four (4)
vehicles or more shall be constructed with concrete curbs.
E. Where a parking lot for four (4) or more
vehicles is located adjacent to or across the street from a
011 residential use, a solid screen sha21 be constructed and
, ? maintained of not less than three and one-half (3-1/2) feet
in height to capture the vehicle light beams and muffle the
vehicle noise.
F. Driveways may only exceed a grade of ten
(10) percent (10%) where approved by the City Engineer. A
level area shall be provided for an automobile in front of
the garage on residential lots.
Subd.` 13. Required Off-Street Parking. The fol-
lowing minimum parking spaces shall be provided and main-
tained by ownership, easement or lease, for and during the
life of the respective uses hereinafter set forth. Where a
specific requirement is not stated, the Council shall deter-
mine the adequacy of parking when approving a site plan.
A. Single Family Dwelling. At least two (2)
parking spaces for each dwelling unit. A garage will
fulfill this requirement.
B. Two-Family Dwellings. At least two (2)
parking spaces for each dwelling unit. A garage will
fulfiIl this requirement.

visible from the public right-of-way or adjacent land.
F. A site plan £or the lot, showing ingress
and egress, storage, parking, fencing and other neoessary
features, required to understand the operation shall be
filed for approval by the Council.

Subd. 19. Additional Requirements, Exceptions and
Modifications. The requirements and standards specified
heretofore in this Section shall be subject to the
following:
A. Height Limitations. Height limitations
as set forth in "E" and "R" Districts elsewhere in this
Chapter may be increased by fifty percent (50%) when applied
to the following:

B. Front Yard Variance. In any "R" Dis-
trict, wherever a platted block or otherwise subdivided area
has dwellings located on fifty percent (50%) or more of the
parcels located between two (2) streets, the minimum

1. Landscaping. All yards shall be
{•. landscaped or be left in a natural state. If any yards are
to be landscaped, they shall be landscaped attractively with
lawn, trees, shrubs, etc. Any areas left in a natural state
shall be properly maintained in a sightly and well-kept
condition. Yards adjoining any of the Classes of Residence
Districts shall be Iandscaped with buffer planting, if this
is not provided in the natural state. Plans of such screens
shall be submitted for approval as a part of a sxte plan and
installed prior to issuance of a certificate of occupancy
for any tract in the district. In the event this require-
ment cannot be met because of climate, a bond shall be
required to insure compliance within a reasonable time. The
: design shall make use of all land contained in the site.
All of the site plan shall be related to the multiple use,
i.e., either parking, circuZation, recreation, landscaping,
screening, building, storage, etc.
2. Drainage. The drainage of,,.storm
waters shall be provided for either on the site or in a
public storm sewer.
3. Curbs. Interior curbs shall be
constructed within the property to separate driving and
parking surfaces from landscaped areas. Interior curbs
required by this Section shall be Portland cement concrete
construction.
4. Walkways. Surfaced walkways shall
? be provided from parking areas, loading zones and recreation
areas to the entrances of buildings.
5. Surfacing. AlI interior driveways,
parking areas, loading areas, etc. shall be of blacktop or
concrete construction.
6. Burying Utilities. All utilities
including electrical and telephone lines, shall be buried in
all new subdivsions as required by Chapter 13 of the City
Code, unless otherwise approved by the Council.
7. Trash Incinerators and Garbage. No
exterior trash or garbage disposal or incineration shall be
permitted. Any exterior storage shall be enclosed within a
container and such container shall be completely screened by
a wall or equivalent visual screen.
8. Lighting. On-site lighting shall be
provided as is necessary for security, safety and traffic
circulation. Liqhting shall not be directed upon public-
rights-af-way or adjacent properties. Such illumination
shall be indirect and diffused.
9. Natural Features. The site shall
show due regard for all natural terrain features, such as
trees; water courses, historic areas or similar conditions.
10. Public Safety. All site and build-
ing plans for multiple dwellings shall be reviewed by the
Fire and Police Departments with a recommendation to the

planned development agreement, and shall make note thereof
, in the minutes at a regular meeting. If the applicant has
failed to comply with the planned development agreement, the
Council may, in its sole discretion, remove the superimpbsed
planned development zoning by resolution, after a duly
advertised public hearing, and the land area within the
planned development shall automatically revert to its prior
basic zoning classification.
Subd. 9. LB - Limited Business District.
A. Description. Limited Business Districts:
These are areas that are particularly exposed to residential
neighborhoods and are thus suitable to those businesses
compatible with nearby residential use (offices, clinics and
the like).
• B. Permitted Uses. Within any "LB" Dis-
trict, no structure or land shall be used except for?one or
more of the following uses, or uses deemed similar by the
Council:
1. Municipal buildings where the use
conducted is customarily considered to be an office use.
2. Professional offices, banks and
savings and loan.
3. Offices of a general nature where
the operations do not include retail sales or warehousing
t,??•from the site.
4. Clinics for human care.
5. Tnstitutional Uses: Library, swim-
ming pool, church, public schools, religious centers, health
centers, and community building.
6. Funeral homes and mortuaries.

7. Amusement devices not to exceed
three machines at one licensed location and which shall not
be located within 200 feet of another licensed location.
For this purpose the outside wall of each licensed location
shall be used in the measurement of the distance between
locations.

Background
Fire Station 1 —The approximately%2-acre site located at 3940 Rahn Road developed in 1963
with a 5,100 SF fire station.
Fire Station 5 —The combined 2.6-acre site located at 4701 Galaxie Avenue developed in 1988
with a 5,000 SF fire station.
Earlier this year fire operations from both stations were relocated to the new Fire Station 1
located at Blackhawk Road.
Current Status
Both buildings are vacant and the City Council directed a land use change from Quasi-Public
(QP)to Office Service (O/S) and a rezoning from Public Facility (PF) to Limited Business (LB).
State Law requires that City-owned real property cannot be sold to a private party unless the
APC makes findings that the prospective use of the property is consistent with the
Comprehensive Plan.
