Per our ielephane conversatian of April 16, 1996, the following items must be addre5sed in order
to reoeive a building permit 4n the abvve mentioned project. Attached is a Change Request ihat
has been issued to the General Cantractor that addresses the issues noted befaw.
1. The method of determining occupancy was discussed. The buitding is fully sprinklered
and ihe A3 Occupancy calculation is acceptable. No revision required.
2. Type 5N buifdings require sprinklering al1 concealed spaces. Take special nate of the
space above the entry way an detaif 1/A62. No drawing revision required, we witl verify
that this is p'scked up on spr;nkler drawings.
3. Special Inspection schedufe has not been received yet. Tach Builders will submit.
4. lnformation on EIFS system must be submitted which shows smoke develapment and
ilame spreaci infarmation . This information will be provided under separate cover.
5. A one hour separation must be provided between the building and the trash enclvsure.
(See Change Raquest #1).
6. A one-hour shaft must be provided around the kitchen hvod. Tha plan nates this but it
should be more clearly identified, (See Change Request #1).
7. Provide a 24" x 30" minimum window in the offioe door. (See Change RequeSt #1)
S. Provide glazing irt doubte swing doars - 200 square inches minimum. (See Change
reque5t #1)
9. Provide 5 exit lights; one each over 4 doors plus a directional ane to door 118. (See

Thank you once again for taking the time to meet with me on January 29th. I have made the
corrections to my code summary that we discussed, and have enclosed a copy for your records.
To summarize, I removed the allowable area increase due to the building being sprinklered.
Below I have listed additional comments from our meeting which will be incorporated into the
drawings.
Item 1 All toilets must be accessible. The employee toilet will be modified to be so.
Item 2 The toilet stall door in the women's room will be modified to provide better clearances.

CROSS PARKING EASEMENT AND ACCESS EASEMENT AGRE

THIS EASEMENT AGREEMENT entered into this ? day of July,
1989, by M.G. ASTLEFORD COMPANY, a Minnesota General Partnership,
("ASTLEFORD"), witnesseth the following:
R E C I T A L S
WHEREAS, ASTLEFORD is the fee owner of real property located
in the City of Eagan, County of Dakota, State of Minnesota, legally
described as:
Lot Two (2), Block One (1), Rahncliff 3rd Addition
and
Lot One (1), Block Two (2), Rahncliff 2nd Addition
("ASTLEFORD PROPERTY"), see also Exhibit "A" attached hereto, and
WHEREAS, ASTLEFORD is executing this Easement Agreement to
fulfill the access and parking requirements of the City of Eagan
made in conjunction with the development of the ASTLEFORD PROPERTY.
NOW, THEREFORE, in consideration of the foregoing facts,
ASTLEFORD does hereby agree as follows:
1. ASTLEFORD as fee owner of the ASTLEFORD PROPERTY for
itself, its successors and assigns hereby agrees that if at any
time in the future any portion of the ASTLEFORD PROPERTY is
conveyed to a separate owner, ASTLEFORD, its successors and assigns
agrees to grant perpetual non-exclusive easements for cross parking
and access purposes over, across and between the two lots
comprising the ASTLEFORD PROPERTY.
2. The access and cross parking easements contemplated in
this Agreement embrace both the right to park vehicles in certain

designated portions of the easement tracts and the right to reach
those portions by travel over the remaining portion of the easement
tracts which remaining portions will remain open so as to allow
this access. The easements contemplated herein shall be subject to
review and approval by the City of Eagan. Notwithstanding anything
herein to the contrary, no transfer of any portion of the ASTLEFORD
PROPERTY shall take place without the approval of the City of
Eagan. This approval will be conditioned on the grant of the
easements described herein.
3. This Agreement shall be recorded with the Dakota Caunty
Recorder so as to provide notice to the owners and future owners of
the ASTLEFORD PROPER'I'Y. The owners shall provide and execute any
and all docwments necessary to implement the recording of this
Agreement.
4. ASTLEFORD recognizes and agrees that all terms and
conditions of this recordable Agreement shall run with the land
herein described and shall be binding upon the heirs, successors,
administrators and assigns of the owners referenced in this
contract.

CROSS PARKING EASEMENT AND ACCESS EASEMENT AGREEMENT
?
THIS EASEMENT AGREEMENT entered into this ? day of July,
1989, by RAHNCLIFF CROSSINGS, INC., a Minnesota corporation,
("RAHNCLIFF") and M.G. ASTLEFORD COMPANY, a Minnesota General
Partnership, ("ASTLEFORD"), witnesseth the following:
R E C I T A L S
WHEREAS, RAfINCLIFF is the fee owner of real property located
in the City of Eagan, County of Dakota, State of Minnesota, legally
described as:
Lots One (1) and Two (2), Block Three (3), Rahncliff 2nd
Addition, and
Lot One (1), Block One (1), Rahncliff 3rd Addition
("R.AHNCLIFF PROPERTY"), see also Exhibit "A" attached hereto, and
WHEREAS, ASTLEFORD is the fee owner of real property located
in the City of Eagan, County of Dakota, State of Minnesota, legally
described as:
Lot Two (2), Block One (1), Rahncliff 3rd Addition
and
Lot One (1), Block Two (2), Rahncliff 2nd Addition
("ASTLEFORD PROPERTY"), see aZso Exhibit "A" attached hereto, and
WHEREAS, the parties are executing this $asement Agreement to
fulfill the access and parking requirements of the City of Eagan
made in conjunction with the development of the RAHNCLIFF PROPERTY
and the ASTLEFORD PROPERTY.
NOW, TFiEREFORE, in consideration of the foregoing facts, the
parties do hereby agree as follows:

1. RAHNCLIFF as the fee owner of the RAHNCLIFF PROPER'I'Y for
itself, its successors and assigns hereby grants ASTLEFORD, its
successors and assigns perpetual non-exclusive easements for cross
parking and access over, across and between the three lots
comprising the RAHNCLIFF PROPERTY.
2. ASTLEFORD as fee owner of the ASTLEFORD PROPERTY for
itself, its successors and assigns hereby grants RAHIdCLIFF, its
successors and assigns perpetual non-exclusive easements for cross
parking and access purposes over, across and between the two lots
comprising the ASTLEFORD PROPERTY.
3. The access and cross parking easements created in this
Agreement embrace both the right to park vehicles in certain
designated portions of the easement tracts and the right to reach
those portions by travel over the remaining portion of the easement
tracts which remaining portions will remain open so as to allow
this access. Each party will, at its own expense, maintain, repair
and keep free from ice and snow the property subject to the
easements created hereby. In the event of a breach of an obligation
imposed upon one of the parties, the non-breachinq party shall have
the right upon giving ten (10) days written notice (or if an
emergency existed, such shorter as is reasonable under the
circtunstances) to enter upon the breaching party's prbperty to
perform, at the breaching party's expense, the work required to
keep the easement tract maintained, repaired or kept unobstructed.
4. The easements and covenants granted herein shall be
subject to amendment, release or termination only by mutual

agreement of the parties and in the absence of such amendment,
release or termination shall remain in effect perpetually.
Notwithstanding anything herein to the contrary, no amendment,
release or termination of any of the easements and/or covenants set
forth herein shall be effective or may be filed of record unless
the City of Eagan consents to the amendment, release or
termination. Such consent must be evidenced by a resolution duly
approved by the City Council, or successor body, unless the City
Attorney for the City approves in writing an alternative format to
evidence that consent. The parties expressly acknowledge and agree
that the City has no obligation whatsoever to approve or act upon
any proposed amendment, release or termination, and may withhold or
delay consent for any reason or no reason whatsoever, or may
condition consent upon such terms as the City deems desirable, it
being the City's absolute right and prerogative to insist that the
easements and covenants granted herein remain in effect and
unaltered and to permit amendment, release or termination only at
such times and under such circumstances, if any, as the City deems
desirable in the exercise of its unfettered discretion. Each party
further agrees and covenants, consistent with this acknowledgment,
not to institute any legal proceedinq against the City of Eaqan on
the grounds that the City failed to respoad appropriately to a
proposed amendment, release or termination, and to indemnify the
City of Eagan against any expense, including litigation costs,
which the City incurs as a result of any violation by that party of
this covenant. The City may, at any time, give up the right of

approval granted hereunder, said action to be evidenced by City
Council resolution or other format approved by the City Attorney.
Notwithstanding anything herein to the contrary, the easement
areas shall not be deemed dedicated to the public or otherwise
public land, and the City of Eagan shall have no obligation and no
right, not otherwise existing, independent of this Agreement, under
the ordinances, statutes and other laws under which the City
operates, to maintain or administer the easement areas.
5. The parties mutually recognize and agree that all terms
and conditions of this recordable Agreement shall run with the land
herein described and shall be binding upon the heirs, successors,
administrators and assigns of the owners referenced in this
contract.

DRAINAGE AND IITILITY EASEMENT
This drainage and utility easement, made this day
of , 19891 between M. G. ASTLEFORD COMPANY, a
Minnesota general partnership, herein referred to as "Landowner" and
the CITY OF EAGAN, a municipal corporation, organized under the laws
of the State of Minnesota, hereinafter referred to as the "City".
W I T N E S S E T H
that the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its successors and assigns, a permanent
easement for drainage and utility purposes, over, across and under
the following described premises, situated within Dakota County,
Minnesota, to-wit: .

the plat thereof on file in the office of t1ie County Recorder,
Dakota County, Minnesota described as follows:
Commencing at the Southwest corner of Lot 1, Block 2,
Rahncliff 3rd Addition; thence on an assumed bearing of
North 0 degrees 42 minutes 53 seconds West along the west
line of Lot 1 a distance of 160.0 feet; thence North 89
degrees 17 minutes 07 seconds East a distanee of 10.0 feet;
thence North 0 degrees 42 minutes 53 seconds West a distance
of 54.92 feet; thence North 89 degrees 17 minutes 07 seconds
East along the existing easement line 36.93 feet to the
point of beginning; thence South 27 degrees 22 minutes 11
seconds East along the existing easement line a distance of
40.16 feet; thence North 53 degrees 58 minutes 04 seconds
east along the existing easement line to the intersection of
a line bearing North 89 degrees 17 minutes 07 seconds East
from the point of beginning -thence South 89 degrees 17
minutes 07 seconds West along said line to the point of
beginning.

The grant of the foregoing permanent easement for drainage and
utility includes the right of the City, its contractors, agents and
servants to enter upon the premises at all reasonable times to
construct, reconstruct, inspect, repair and maintain pipes, conduits
and mains; and the further right to remove trees, brush, undergrowth
and other obstructions. After completion of such construction,
maintenance, repair or removal, the City shall restore the premises
to the condition in which it was found prior to the commencement of
such actions, save only for the necessary removal of trees, brush,
undergrowth and other obstructions.
And the Landowner, its heirs and assigns, does
City, its successors and assigns, that it is the
premises aforesaid and has good right to grant
easement herein to the City.

Smoke detector shail be a System Sensor i'Series model number listed to Underwriters Laboratories UL 268 for Fire Protection Signaling Systems.The
detector shall be a photoelectric type(Model 2W-B,4W-B)or a combination photoelectric/thermal(Model 2WT-B,4WT-B)with thermal sensor rated at 135°F
(572°C).The detector shall include a mounting base for mounting to 3%z-inch and 4-inch octagonal,single gang,and 4-inch square back boxes with a plaster
rinq,or direct mount to the ceiling using drywall anchors.Wiring connections shall be made by means of SEMS screws.The detector shall allow pre-wiring of

ENCROACHMENT AGREEMENT
This Encroachment Agreement ("Agreement") is made and entered into this -)I' - day
of March, 2023, by and between the City of Eagan, a Minnesota municipal corporation (the
"City"), and Southern Social Land and Building LLC, a Minnesota limited liability company (the
"Owner"). The City and Owner are hereinafter referred to as the "Parties."
WHEREAS, the Owner is the fee owner of certain property located in the City of Eagan
and legally described as Lot 2, Block 1, Rahncliff 0' Addition (hereinafter the "Property"); and
WHEREAS, the Owner desires to maintain a non-structural retaining wall, patio, sidewalk
and landscaping (the "Improvement") within the in the City's existing drainage and utility
easement along the southerly property line (the "Easement") located on the Property as depicted
on Exhibit "A" attached hereto; and
WHEREAS, in connection with placement of the Improvement, it is necessary for the
Owner to encroach within the Easement; and
WHEREAS, the City is willing to allow Owner to encroach within the Easement all upon
the terms and conditions contained herein:
NOW, THEREFORE, the City and Owner agree as follows:
l . ENCROACHMENT. The City hereby authorizes Owner to construct, maintain
and repair the Improvement within the Easement.
2. No WAIVER. Nothing in the Agreement shall be deemed a waiver or
abandonment of the City's rights in the Easement.
3. COSTS. The Owner shall be responsible for all costs relating to the
construction, maintenance and repair of the Improvement.
4. ASSUMPTION OF RISK. Owner acknowledges that the future maintenance,
repairs within the Easement could possibly damage the Improvement. By
entering into this Agreement, Owner assumes the risk of any and all damage
to the Improvement that may result from any work performed by the City
and/or its agents within the Easement.
5. DEFAULT. If the Owner fails to take any action required in connection with
this Agreement, the City will provide a written notice of default to the
Owner giving Owner a 30-day cure period. Notice need not be given in the
event emergency repairs are needed. After the 30-day cure period, the City
may take action and bill the Owner for the costs thereof. If the Owner fails
to reimburse the City for the costs thereof within ten (10) days after receipt
of the bill, the City may take any action permitted by law to collect the
amount owed plus the costs of collection, including, but not limited to
attorneys' fees.
6. NOTICES. All written communications shall be directed to Owner at:

7. VALIDITY. If any portion, section, subsection, sentence, clause, paragraph
or phrase of this agreement is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portion of this
Agreement
8. BINDING AGREEMENT. The parties mutually recognize and agree that all
terms and conditions of this recordable agreement shall run with the land
herein described and shall be binding upon the successors and assigns of the
parties hereto.
9. GOVERNING LAW. This Agreement shall be governed by and interpreted
under the laws of the State of Minnesota.
