As discussed in previous phone conversations, we do not concur with your position, stated in Item No. 3 of your review letter, that Space 139 is a corridor rather than an elevator lobby. All areas of this building are provided with required exits without exiting through this space, and this space is separated from the required exit corridors by either walls conforrning to Section 1005.7, or by doors complying with Section 1005.8. This space meets the requirements of an elevator lobby stated in Section 1005.10. Therefor is is our continued position that Space 139 is an elevator lobby as indicated on the original plans. Due to this difference of position in regards to this plan review item, and also because any plan change at this area will adversely effect the normal day-to-day use of these elevators by both hotel employees and guests, we respectfully request an additional interpretation of this code item as it applies in this particular case. As indicated earlier, we have been in contact with Mr. Jay Woodward of the ICBO in Whittier, Califomia in regards to this issue, and he indicated that any formal review by his office would need to be initiated by your department. Both Jay Woodward of I.C.B.O. and Scott McClullen of the State of Minnesota have indicated that they would accept the layout as is for the following reasons: l. Neither of them thought this lobby was a corridor; the spaces on each side of the lobby can act independently. 2. They said that even if you consider this a conidor, it still is not a required corridor. This entire section of 1005 is requirements for required corridors. Scott elaborated with an example of a building having a corridor for convenience that did not have to conform to the construction requirements for a rated corridor since it was not a required corridor for exiting. Scott said that if this was an office building, they could put a lobby in the required corridor with only one additional exit. With this design, you completely separate the different conidors and you have three means of exiting from the top corridor. With an R-1 occupancy, you have smoke detectors in the corridors and the bedrooms which you would not have with an office building. 4. Jay stated that with this design, they are in a way using Exception No. 3 that would allow the doors to be placed on the bulk-head of the elevator openings. Instead of putting the doors on the bulk head, they are moving the doors out in to the lobby. I realize that the State of Minnesota would not allow the application of this type of a door on the bulk-head. After reviewing these arguments, I am suggesting that we accept this design. The sound-insulating property of a partition element is expressed in terms of the sound transmission loss. The procedure for determining this quantity is to mount (and perimeter sea1) the test specimen as a partition between two reverberation rooms. Sound is introduced in one of the rooms (the source room) and measurements are made of the noise reduction between source room and receiving room. The rooms are so arranged and constructed that the only significant sound transmission between them is through the test specimen. A test vpening is constructed such that it is approximately one inch larger in size than the test specimen. The tes# specimen is placed in the test opening on a half-inch bead of "DUX-SEAL", a dense, non-hardening, clay-like material, to isolate it from the supparting base. The space befinreen the test specimen and the wall opening is sealed on both sides employing the same sealing material. The test specimen is perimeter sealed (both sides) with the same material between the two reverberation rooms. The purpase of the Sound Transmission Cfass (STC) is to provide a single figure rating that can be used for comparing the sound-insulating properties of partition elements used for general building design purposes. Verify that the entrance doors from interior conidors have an S.T.C. rating of not less than 26 - U.B.C. 1208.2. 13. U.B.C. Section 1208.3 requires an IIC of not less than 50 for the floor-ceiling assemblies. Provide a tested assembly verifying this. 14. No openings in the rated ceilings are permitted other than Exceptions 1 through 6 in U.B.C. Section 710.2. 15. Provide a space at the front desk that complies with M.S.B.C. Section 4.3.1.5. for the checkout counter. 16. M.S.B.C. The services provided included test pit observations, excavation observations, compaction testing during the site 3rading, concrete testing and test roll observations of the pavement subgrade. Our services were performed in ;eneral accordance with our cost estimate dated Septem6er 8, 1997, (proposal BABX-97-7404). Geotechnica! Report Soil borings were performed by American Engineering Testing, Inc. (AET) from 7une 23 to lune 25, 1997, for this project. Results of the soil borings were included in AET's Geotechnical Exploration and Review dated June 27, 1997, presented under job number AET #97-2041. The review ?ave a summary of the soil conditions encountered at the site and recommendations for building subgrade preparation and pavement preparation. The soil borings encountered existin; fill soils which were generally considered suitable for support of the proposed buiiding. Proposed Construction The proposed building will be a slab-on-;rade, four-story, 100-unit hoteL The building footprint is about 16,600 square feet with iinish tloor grade at elevation 929.0 feet. The building will be supported by rypical spread footings designed with a soil bearing pressure not exceeding 2,500 pounds per square foot. I/ Torgerson Properties, Inc. Test Pit Observations TesC pit observations were performed by a senior engineering assistant on September 10, 1997. The test pits were performed to a depth of approximately 5 to 6 feet with a backhoe. Soils encountered in the test pits were previously placed till soils primarily consisting of clayey sand and silty sand that were judged to be in a loose to medium dense condition. On the north end of the proposed building, the upper 3 to 4 feet of the existing fill was in a loose condition and contained a layer of topsoil till with some vegetation. We recommended subcutting the north end of the proposed building about 3 to 4 feet to approximate eievation 924 and reestablish grade with engineered fill. Attached is the Daily Observation Report submitted to Mr. Mitch Hilte of Tech Builders, Inc. after the test pit observations. Excavakion Observations and Compaction Testing The excavation observations were conducted by a senior engineering assistant on September 13, 1997. The excavation observations consisted of observing the soils exposed in the bottom and side walls of the excavation. The approximate density or consistency of the soils encounteretl were judged by estimating the force required to advance random, shallow (about 1 to 3 feet deep) hand auger probes. The soil classifications were determinetl in accordance with the American Society for Testing and Materials (ASTM) procedures while examining the hand auger probe cuttings. The layer of topsoil till was removed from the north end of the proposed building with dozers. The bottom of the excavation ranged from about elevation 924 on the north end to about eievation 925 on the south end. Soils encountered at the excavation bottom were previously p(aced till soils primarily consistin- of silty sand and clayey sand that was judged to be in a medium dense to dense condition. Approximately 2 to 3 feet of engineered fill was placed in the building area to establish subgrade elevation of 927. The till soils were on-site silty sands that were placed in about 8-inch to 12-inch thick lifts with a dozer then compacted with a large, vibratory, sheepsfoot roller. A total of four compaction tests were performetl in the engineered till placed for building support. All tests met or exceeded the minimum density requirement of 95 percent of standard Proctor density (ASTM D 698). The compaction test results and Proctor curve have been previously submitted and are attached to this report. Torgerson Properties, Inc. Project BODX-97-313C May ZI, 1998 Page 3 Prior to concrete placement, the soils at footing subgrade were also observed. The soils mainly consisted of previously placed silty sand and clayey sand till that were judged to be in a medium dense to dense condition. Concrete Testing Concrete testing was performed by an American Concrete Institute (ACI) certified Level I technician. The testing consisted of determininb the slump, temperature and air content, as weil as casting test cylinders (sets 1 through 5) for evaluation of compressive strength of the concrete. The concrete was tested as it was discharged from the truck for footings, walls and slab-on-grade. Review of the 28-day test resuits indicate the concrete represented by these cylinders has met or exceeded the specitietl minimum 28-day compressive strength. The concrete test results have been previously submitted and are attached to this report. Test Roll Observations Test roll observations of the pavement subgrade soils were performed between May 7 to May 18, 1998, by a senior engineering assistant. The test rolls were performed with a loaded double aacle tandem and a rubber tired loader with a full bucket. The subgrade soils primarily consisted of silty sand and clayey sand. Various areas of unstable pavement subgrades were observed. Due to the construction schedule the asphalt pavement was placed. It should be anticipated, that there will be some pavement areas that will require more then normal maintenance and a shorter pavement life. Attached are the Daily Observation Reports that were submitted to Mr. Hilte of Tech Builders, Inc. after each test roll. Conclusions Based on the results of our test pit observations, excavation observations and hand auger probes, it is our opinion the soils encountered in the excavation bottoms are suitable for support of the proposeti building. Based on the results of our compaction testing, it is our opinion the engineered till placed was adequately compacted for building support. Based on the results of our concrete testing, the concrete tested has met the 28-day compressive strength requirements. Based on the results of our test roll observations, it should be anticipateri that some of the pavement areas will require more then normal maintenance or a shorter pavement life due to the unstabie subgrade. ASTLEFORD as fee owner of the ASTLEFORD PROPERTY for itself, its successors and assigns hereby grants RAHNCLIFF, its successors and assigns perpetual non-exclusive easements for cross parking and access purposes over, across and between the two lots comprising the ASTLEFORD PROPERTY. 3. The access and cross parking easements created in this Agreement embrace both the right to park vehicles in certain designated portions of the easement tracts and the right to reach those portions by travel over the remaining portion of the easement tracts which remaining portions will remain open so as to allow this access. Each party will, at its own expense, maintain, repair and keep free from ice and snow the property subject to the easements created hereby. In the event of a breach of an obligation imposed upon one of the parties, the non-breaching party shall have the right upon giving ten (10) days written notice (or if an emergency existed, such shorter as is reasonable under the circumstances) to enter upon the breaching party's property to gerform, at the breaching party's expense, the work required to keep the easement tract maintained, repaired or kept unobstructed. 4. The easements and covenants granted herein shall be subject to amendment, release or termination only by mutual -2- agreement of the parties and in the absence of such amendment, release or termination shall remain in effect perpetually. Notwithstanding anything herein to the contrary, no amendment, release or termination of any of the easements and/or covenants set forth herein shall be effective or may be filed of record unless the City of Eagan consents to the amendment, release or termination. Such consent must be evidenced by a resolution duly approved by the City Council, or successor body, unless the City Attorney for the City approves in writing an alternative format to evidence that consent. The parties expressly acknowledge and agree that the City has no obligation whatsoever to approve or act upon any proposed amendment, release or termination, and may withhold or delay consent for any reason or no reason whatsoever, or may condition consent upon such terms as the City deems desirable, it being the City's absolute right and prerogative to insist that the easements and covenants granted herein remain in effect and unaltered and to permit amendment, release or termination only at such times and under such circumstances, if any, as the City deems desirable in the exercise of its unfettered discretion. Each party further agrees and covenants, consistent with this acknowledgment, not to institute any legal proceeding against the City of Eagan on the grounds that the City failed to respond appropriately to a proposed amendment, release or termination, and to indemnify the City of Eagan against any expense, including litigation costs, which the City incurs as a result of any violation by that party of this covenant.
