Subdivision L Definitions. For the purposes of this section, the terms used in
:his cection have the meanings given them ip this subdivision.

(b) "Political subdivitiic,n" means a city, town, or county.
(c) "Road authoru," has the meaning given it in section 160.02, subdivision 9.
Subd. 2. I.icense. No person may operate as a building mover in this state
unles, licensed by tha commissioner.
Subd. 3. License application. To obtain a license to operate as a building
mo%er an applicant shall file an application with the commissioner specifying thr
name and address of its otTcers and other information as the commissioner may
reasonably require. The commissioner shall issue the license upon compliance by
the applicant wi[h insurance cequirements and payment of an initial SI50 tiling fre.
A license once granted continues in full force and effect, subject to a$100 annual
reneHa) fee and compliance with insurance requirements, unless revoked or suspend-
rd.
Thr cummi;sioner, upon approval of a license for a building mover, shall issue a
swTicient number of cab rards to each licensed mover to provide one cab card for
tach power unit used in moving buildings. The fee is $10 for each cab card issued.
The cab card must be carried at all times in a readily available place in the cab of the
poaer unit for which it was issued. The building mover may also purchase up to
;ive tloater cab cards for a fee of $100 for each floater card issued. Cab cards are
et'tecti%e for a 12-month period and continue from year to year thereafter upon
pa* yment of the reyuired fee. Cab cards are only good for the period for which the
li.rnse i, et7ecti?e.
Jubd. 3a. lnsurance. Each building rnover shall have in effect the following:
(a) comprehensi?z general liability insurance including completed oprrations,
under¢round property damage, and collapse coverage in the amount of at least
5500•lXx) ('or bodily injury or propeny damage; and
(b) motor vehide liability insurance in the amount of at least $5(X),000 for
bodily injury or property damage.

of .14innesota. Each building movei shall Cile with the commissioner a certificat:
e?idencing the insurance. The insurance policy must provide that the policy may
not be canceled without the insueer first giving 30 days written notice to the
commissioner of the impending cancellation.
Subd. 3b. Local permits. A building ?nover may not move a building on or
across a street or highway without ftrst obtaining a permrt from the road authority.

building may not be granted to a building mover who does not pussess a current
license issued by the commissioner.

Subd. 3c. Local regulation. No license to move buildings or bond, cash
deposit, or insurance coverage may be required by a political subdivision of the state `•
other than the license and insurance coverage required by the commissioner. A
road authority may charge a fee for services perFormed and may require a permit
which reasonably regulates the hours, routing, movement, parking, or speed limit for
a building Riover operating on streets or highways under its jurisdiction. A building
mover shall comply with the state building code in jurisdictions which have adopted
tlie state building code, and with local ordinances which regulate the moving or
removing of buildings. A building mover may not be reyuired to pay a route
approval fre tu, or obtain a permit for the movement of a building on strerts ur
highways from, a political subdivision which is not also tht ruad authority. This
sertion does not prohibit a poiiticel subdivision from charging a permit fee for
regulation of activitirs which du not invulve the use of pubtic streets or highwayti.
Neithrr thc state nor a political subdivision may regulate rates chargrd by buildirig

Subd. 4. License revocation, susprnsion, denial. The rommissionrr, after
nuure and a hearing, may revoke, suspend, or deny a licrntie for:
(a) failurc of the applicant vr license hulder to reimbursr the road authority for
d:,mage to public hiEhwap,, roads, streets, or utilities which are not paid for by the
license holders insurer,
(b) cunduu of the applicant or license holders that endangers the health and
,:,fety of users of the public highways, raads, streets, or utilities;
(c) wndurt of the applicant or lirrnse holder that obstructs traffic in a manner
uther than as authorized in the permit;
(d) violation of the provisions of this section; or '
(e) faiture to obtain required local moving permits or permits required by
section 169.86.
Subd. 5. Suspension by commissioner. The commissioner shall suspend a
license without a hearing for the following reasons:
(a) failure to pay the renewal fee; or
(b) failure to comply with insurance requirements.
The suspension continues until the fees are paid and the insurance requirements
are satisfied.
Subd. 6. Penalties. A penon who violates, or aids or abets the violation of,
any of the provisions of this sectioa is guilty of a misdemeanor. Every distinct
?iolation is a separate offense.

Please let this serve as a formal claim with the City of Eagan to recover the cost of repair work done on
the water line at the home of Robert and Leah Lencowski, 1383 Rainier Lane, Eagan, MN 55121, on
July 29 and 30, 2009. The cause of this leak was due to previous repair work done by the city.
In 1994, the city repaired a leak on the city's side of the water valve in the homeowner's yard. In the
process of fixing the leak, the city punctured the water line on the homeowner's side of the valve. At
that time the city removed a two-foot piece of copper pipe from the city curb stop/valve to the
homeowner's house. When the homeowner removed this two-foot section to repair the current leak, it
was discovered that the quality of the previous repair was very poor and there had never been a proper
connection to the curb stop. The flare on the two-foot copper pipe was little to non-existent. It became
evident, with the damage to the pipe and curb stop, that there had been slow-leaking for several years.
In addition to the improper seal, the city valve was coming out of the ground from the water line at a
severe angle and the two-foot section had score marks from the previous dig and backfill, further
compromising the integrity of the line.
Before discovering the extent of damage due to the years of leakage, the homeowner's plan was to fix
the "minor" leak by exposing the pipe on their own and having a plumber repair the leak coming from
the city's valve to the homeowner's line. Unfortunately, the extensive damage required that the city's
curb stop and the city's valve also had to be replaced, something the homeowner could not do on their
own. Wenzel Plumbing was hired by the homeowner to replace all the necessary parts to regain water
service at the homeowner's residence.
Enclosed is a detailed timeline of events, pictures documenting the lack of flaring on the two-foot
section, the boulders that were resting on the piping and removed during the dig, and severe angle of the
valve from connection to surface. Also enclosed are copies of receipts for rental of a backhoe and the
cost of Wenzel Plumbing to replace the city curb stop and valve. (At the time of the repair, the city
could not provide parts to complete the repair.) The homeowner is asking to be reimbursed for the cost
of backhoe rental and the services of Wenzel Plumbing, a total of $969.62. This dollar amount does not
include the homeowner's labor to expose and remove the two-foot section, or the cost of sod to repair
the yard next spring.

• Many vendors were surprised to hear city policy that up to homeowner to hire
vendors.
• Frustrated with the lack of options, homeowner determined that they could, with
help of family and friends in the trades could repair minor leak.
o Contacted Crown Rental to rent backhoe

o Contacted brother-in-law, Darrell Olson, plumber and pipe fitter to repair
leak once exposed.
Wednesday, July 29th
• Contacted city to come turn off water, at 8:00 a.m.
• City employee (Troy) turned off water 11:15 a.m.
• Rented Backhoe and dug hole
o Discovered big boulders sitting on pipe
o Valve was crimped at bottom, severe angle from point of connection to
surface
• Plumber and Pipe fitter, Darrell Olson, came to repair leak
• Removed piece of pipe that city had broken and repaired several years ago
o Discovered lack of flare on connection to curb stop and extensive damage
to pipe.
• Robert Lencowski and Darrell Olson went to Murr Plumbing and Heating in
Newport to have new two-foot section with proper flaring made.
o Opinion of both plumbers that pipe was never sealed properly to valve and
leaking had been occurring for several years.
¦ NOTE: We have never had good water pressure in our house, it
has improved
• Darrell Olson replaced damaged two-foot section with new pipe. The curb stop
valve was still leaking. Evident that after years of slow leakage, damage was
more extensive and curb stop must also be replaced.
• Homeowner contacted city as now city parts must be replaced due to lack poor
workmanship done by city in 1994.
• Homeowner contacted City of Eagan Public Works Hotline
o City refused to come and look at situation since leak was on
"homeowner" side
o Homeowner explained extensive damage was now evident and cause was
city workmanship.
o City agreed to come and look in the morning, 7:15 a.m. on 7/30.
• Homeowner kept water off, even though slow leak, to make it easier for city to
see problem.
• Homeowner acquired 6-foot fencing to surround the hole for safety.
Thursday, July 30th
• City came to inspect leak
• At this time city employees became aware that city had damaged and improperly
repaired a leak several years prior.
o Clearly viewed improper flair
o Evident valve was angled
o Obvious damage was more than just to two-foot section and now required,
at minimum, replacement of city curb stop
• On-site city employees contacted city offices to determine next steps in this
unique situation since city had improperly repaired.
o Without observing situation, city employees at office determined it was
homeowner's issue.
o Homeowner can file claim with city insurance company
• With no other options to get water service restored, homeowner contacted Wenzel
Plumbing and heating who agreed to come immediately (homeowner had been
without water since previous day)
• Wenzel came to repair curb stop
o Noted very poor work on flare
o City curb stop and valve had to be replaced
o City employees went to city offices to retrieve new valve
¦ City was out of Valves - had replaced six the previous week!
o Wenzel had to send additional man with valve
o Wenzel completed repair work replacing two-foot section, curb stop and
main valve
• Wenzel backfilled by hand around pipe.
• Homeowner completed backfilling - eliminating all the rock and boulders
• Water turned back on approximately 1:00 p.m. by city employees
o Better water pressure in house!

CLAIM FOR WATER SERVICE DAMAGE REPAIRS

The City has received a claim for costs to repair an existing water service connection and
related water shutoff valve/standpipe. The homeowner discovered the damaged service pipe
while attempting to repair a leak on the homeowner's side of the shutoff valve on July 29,
2009.
The City's work repair history indicates that the City repaired a similar leak on the City's side
of the shutoff valve/standpipe on Nov. 10, 1994. Recollections of staff indicate that, during
the City's repair operations, the backhoe operator "hooked" the water service pipe damaging
several feet of the private water service line. This was subsequently repaired as part of the
City's repair operations.
In reviewing the portion of the City's previous repair on the private water service line
(approx. 2' in length), it is obvious that the flared collar connection of the water service pipe
to the shutoff valve performed by the City in 1994 was insufficient to avoid a gradual long
term leak and deterioration to the point of failure. The condition of the water shutoff
standpipe also appeared to be damaged and compromised requiring it to be replaced by the
homeowner's repair operations on July 29, 2009.
