MAPLEWOOD DEVEI:OPMENT AND CONSTRUCTION, INC., a Minnesota
corporation, hereinafter referred to as "Landowner" and the CTTY OF EAGAN, a
municipal corporation, organized under the laws of the State of Minnesota, hereinafter
referred to as the "Gity".
WITNESSETH:

good and valuable consideration, the receipt and sufficiency of which is hereby
aclmowledged, does hereby grant and convey unto the City, its successors and assigns, a
25-foot perpetual easement for drainage and utility purposes, over, across and under the
following described premises, situated within Dakota County, Minnesota, to-wit:
Lot 29, Block 2, BLACKHAVJK FOREST, according to the
recorded plat thereof.
The centerline of said easement is described as follows:
Commencing at the northeast comer of said Lot 29; thence on an
assumed bearing of North 82 degrees 38 minutes 02 seconds West,
along the northerly line of said Lot 29, a distance of 179,00 feet, to
the point of beginning of the centerline to be described; thence
South 36 degrees 21 minutes 58 seconds West a distance of 46 feet
more or less tn the northerly right of way line of Red Fox Road and
said centerline there terminating. The side of said easement shall be
p:alonged or shortened zo terminate in the ao:*.Fl I1nC Cf gairl T o± 29
and said northerly right of way line.
Together with a perpetual easement for drainage and utility
purposes over, under and across that partof the, above described
property which lies southerly of a line drawn westerly,
perpendiculaz to the east line of said Lot 29 from a point on the east
line of said L,at 29 distant 31.00 feet northerly from the southeast
corner of said Lot 29.
See also Exlubit "A" attached hereto and incorporated herein.
The grant of the foregoing permanent easement for drainage and utility purposes
includes the right of the City, its contractors, agents and servants to enter upon the
premises at all reasonable times to construct, reconstruct, inspect, repair and maintain
pipes, conduits and mains; and the fiuther right to remove trees, brush, undergrowth and
other obstructions. After complerion of such construcrion, maintenance, repair or.
removal, the City shail restore the premises to the condition in which it was found prior
to the commencement of such actions, save only for the neoessary removal of trees,
brush, undergrowth and other obstructions.
And the Landowner, its successors and assigns, does covenant with the Ciry, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good
right to grant and convey the easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be
executed as of the day and year first above written.

1. A nosing is not required where the tread depth is a
minimum of 11 inches (279 mm).
2. The opening between adjacent treads is not limited on
stairs with a total rise of 30 inches (762 mm) or less.
