KULAS RETAINING WALL
MEMO
Recentiy, you forvvarded a memo to Communiry Development Director Reichert regarding
a voice mail message from Councilmember Masin conceming the retaining wall issue for
the Kulas property in the Burr Oak Hills ist Addition. Due to Peggy's vacation schedule
and my familiarity with the historical background of this development, i have offered to
prepare this response. I wili flrst specifically address the two questions contained in your
memo and then provide some general background discussion.
Did the retaining wall (ssue occur after the develoQer's bankruptcvT - The original
developers of the Burr Oak Hills subdivision were Keith and Diane Harstead. The final
plat for the 1 st Addition was approved and recorded at Dakota County on May 27, 1987.
The developers filed for bankruptcy in February, 1990. The issue regarding the
noncompliance of the retaining wall was brought to the City's attention approximately
June of 1994.
WQre there restrictions placed on the two lots that are not butlt (Lots 18 & 19) that
would reauire retainina walls or some other uroper erosion control? - A memo has
been placed in the parcei file for these two lots indicating the need to ensure that a
detailed site grading plan is submitted with the building permit application to determine
the extent of retaining walls and, 'rf necessary, ensure that it has been designed and
included as a part of the building permit issuance.
Background Iniormation
The detailed grading, drainage and erosion control plan that was submitted with the final
plat application for the Burr Oak Hills 1 st Addition was more than what is required by City
Code. This grading plan showed building pads and final grades for the majority of the
subdivision and referencing the installation of approximately 300' of retaining wall for Lots
18, 19, 20, and 21, Block 2 of Burr Oak Hiils ist Addition. If the subdivision were to be
graded according to the proposed grading pian, it would require the instatiation of this .
retaining wall. However, the developer provided stabilized slopes of approximatety 2:1
in lieu of the retaining watl which does meet the City's minimum erosion controi and
8radin8 standards. Many times, developers will leave the installation of retaining walls to
the builders and future homeowners' architeCtural discretion to inCOrporate ft into their
final building design. A revised grading plan to eliminate this retaining wall and replace
R with the stabilized 2:1 slopes that presently exist would be approved if submitted even
to this day.
Shamrock Development Corporation purchased ail remaining undeveloped lots from the
bank who obtained titie as a part of the bankruptcy proceedings. They realized they
purchesed the lots 'as is` and then sold them to builders only. In e recer?t meeting with
Jim Stenton, of Shamrock Development, he indicated that he sold these particular lots at
s reduced price from comparable lots in the development due to the steep topography
in the rearyard area. When the particular lot for the Kulas property was sold to Chase
Builders, it was sold 'as is°. Subsequently, Chase Builders included a clause in the
purchase agreement with the Kulas' that the instailation of any retaining walls, 'rf
necessary, would be the responsibility of the Kulas'. This was agreed to by the Kulas'
when they purchased the lot.
There presentiy is no financial security avaiiabte for the developmerit coMract. Shamrock
Developmerit Corporation is merely a landholder who purchased these lots through the
bankruptcy sale and shculd really not be considered a developer. It appears that Mr. &
Mrs. Kulas have reached an impassee with Shamrock Developmerrt in their discussions.
Mr. and Mrs. Kulas presentiy have an obligation to construct a retaining wail to properly
stabilize the embankment before it affects edjacent properties through erosion in addition
to the Identifiable safety concerns. The construction of a walk-out on this tot further
exacerbated the need for a retaining wall. In reviewing the site plan submitted with the
building permit application, the land surveyor for the applicant did not properly reference
the elevations either as they existed at that time or were proposed with the development
greding plan. Based on the information received, the staff processed and (ssued a
building permit which did nct show anything out of the ordinary.
In hindsight, there may have been an opportuniy for the City staff to be more eware of
this issue to possibly prevent the concerns presentty being experienced by Mr. and Mrs.
Kulas. However, with the limited staff resources and the volume of developmerrt, building
permits and developers meeting varied levels of compliance at differing timeirames, this
was a situation that staff was not able to prevent.
However, we have put a speciat notation in the parcel file for the two remaining vacartt
bts to ensure that Uhese issues are addressed as a part of the building permit Issuance "
to avoid a similar reoccurrence in the future.
In summary, it does not appear that the Ciry has any liability or obligation to assist in
providing a retaining wall for the Kulas property, especially in light of their written
agreement to do so as e part of their purchase of the lot. If the City Council should
choose to provide assistance, they should be very specific as to the reasons for providing
any financial assistance to avoid estabiishing a precedence for many other lots in this
community where the building of custom homes often times require the installation of
substaritial landscaping and retaining wall improvements.
