At 7:00 p.m. on June 6, 1989, the Mayor opened up the public
hearing associated with the adoption of the final assessment roll
for the above-referenced project. After reviewing and discussing the
verbal objections presented by only one property owner, the City
Council closed the public hearing, adopted the final assessment
roll as presented and authorized its certification to the County
for collection through the property tax rolls.
Therefore, this letter is to inform you that the written objection
you submitted to staff at approximately 8:15 p.m. on the same
evening will not be forwarded to the Special Assessment Committee
for further review. The City Council has determined that all costs
proposed to be levied by this project were appropriate and
correspondingly adopted the final assessment roll as presented.
You will have 30 days from June 6th to pay off any portion of the
final assessment allocated to your property. At the end of that
30 day period, any unpaid balance will be certified to the County
for collection with the taxes payable in 1990 with interest being
calculated at the rate of 9.0% interest from the date of final
assessment adoption, June 6, 1989.

This Assessment Deferral Agreement ("Agreement") is made this day of ,
1999, by and between MICHAEL FRATTALONE, a single person, (hereinafter "Landowner"), and
the CITY OF EAGAN, a Minnesota municipal corporation (hereinafter "City") (hereinafter
collectively referred to as the "Parties").
WHEREAS, Landowner is the fee owner of property located in the City of Eagan, County
of Dakota, State of Minnesota and legally described as:
That part of the SEl/4 of NE'/4 and of the NEl/4 of SE'/4 of Section 36, Township 27,
Range 23, described as follows, to-wit: Commencing at the SW corner of said SE'/4
of NE'/4; thence 330 feet north along the west line of said SE'/4 of NE'/4; thence east
and parallel with the south line of said SEl/4 of NE'/4, a distance of 429 feet; thence
south and parallel with the west line of said SE'/4 of NE'/4 and of said NE'/4 of SE'/4,

Assessment or the Deferred Assessment, pursuant to Minn. Stat. §429.081
and further waives notice of hearing on this Agreement.
4. This Agreement shall be binding upon and inure to the benefit of the Parties'
heirs, successors and assigns and shall run with the land.

WHEREAS, Landowner is the fee owner of property located in the City of Eagan, County
of Dakota, State of Minnesota and legally described as:

Range 23, described as follows, to-wit: Commencing at the SW corner of said SE'/4
of NE'/4; thence 330 feet north along the west line of said SEl/4 of NEl/4; thence east
and parallel with the south line of said SE'/4 of NE'/4, a distance of 429 feet; thence
south and parallel with the west line of said SE'/4 of NE'/4 and of said NEl/4 of SE'/4,
a distance of 528 feet; thence west to a point on the west line of said NEl/4 of SE'/4,
distant 198 feet south of the place of beginning; thence north to the place of

WHEREAS, as part of Public Improvement Project No. 673R (hereinafter the "Project"), the
Property was proposed to be assessed for the following:

WHEREAS, the City is willing to defer a portion of the Proposed Assessment as requested
by Landowner all upon the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the
Parties do hereby agree as follows:
1. The Property shall be immediately assessed for the following:

The Immediate Assessment shall be payable over a term of fifteen (15) years at 61/2
percent interest.
2. The remaining portion of the Proposed Assessment, namely:

(hereinafter the "Deferred Assessment")
The Deferred Assessment shall be deferred and said deferment shall end if the
Property connects to city sewer and/or water services or until December 31, 2028,
whichever occurs first. Then, the Deferred Assessment, or an amount equal to the
then prevailing connection rate in effect at the time of the end of the deferment,
whichever is greater, shall be immediately payable.
3. The Landowner hereby waives his right to object or appeal to the Immediate
Assessment or the Deferred Assessment, pursuant to Minn. Stat. §429.081
and further waives notice of hearing on this Agreement.
4. This Agreement sha11 be binding upon and inure to the benefit of the Parties'
heirs, successors and assigns and shall run with the land.

THIS PONDING EASEMENT, made and entered into this 4th day of
october , 1996, by and between MICHAEL J. FRATTALONE, a single person,
herein referred to as "Landowner" and the CITY OF EAGAN, a municipal corporation
organized under the laws of the State of Minnesota, hereinafter referred to as the "City".
WITNESSETH:
That Landowner, in consideration of the sum of Sixteen Thousand Six Hundred Fifty-
seven and 63/100 ($16,657.63) Dollars and other good and valuable consideration, the receipt
and sufficient of which is hereby acknowledged, does hereby grant and convey unto the City,
its successors and assigns, a permanent easement for ponding purposes over, across and under
the foiiowing described premises, situated within Dakata County, Minnesota, ta wit:

The grant of the foregoing permanent easement for ponding purposes includes the right
of the City, its contractors, agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes, conduits, mains or ponds.
Landowner retains the right to use the premises for any lawful purpose, and the right to
grant other easements over, under or across the premises, provided such use does not interfere
with the ponding purposes of this easement.
IN WITNESS WHEREOF, the Landowner has caused this easement to be executed as
of the day and year first above written.
